Katzt To what extent does the Constitution "follow the flag" to ter- ritories under United States sovereignty?1 Though this question has twice occupied the center stage of American law and politics,2 federal courts have yet to settle upon a single test for determining which constitutional provisions apply to United States-flag territo- ries. Federal circuit courts currently divide between two competing approaches for making this determination.3 Employing these rival standards, they have reached inconsistent results concerning the territorial force of certain constitutional rights, such as the right to trial by jury. This Comment undertakes to explain the doctrinal disagree- ment between the two federal circuits whose discord runs the deepest: the D.C. Circuit, which has jurisdiction over American Sa- moa, and the Ninth Circuit, which hears appeals from the North- ern Mariana Islands and Guam. One way to analyze their dispute is to focus on the disorder within the Supreme Court's own territo- rial jurisprudence. ' The United States' territorial system consists of five island groups that fly the Ameri- can flag but which are not states-Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. The United States also has special responsibilities for the Federated States of Micronesia, the Marshall Islands and Palau. ' The D.C. Circuit has held that all of the Constitution's safeguards of individual rights must apply to the territories of the United States, except those whose implementation proves to be "impractical and anomalous" in a given setting. King v Morton, 520 F2d 1140, 1147 (DC Cir 1975). The Ninth Circuit, on the other hand, holds that only "fundamental" constitutional rights must apply to these territories. See Commonwealth of the Northern Mariana Islands v Atalig, 723 F2d 682, 689-90 (9th Cir 1984). The University of Chicago Law Review [59:779 Common sense suggests that the Court's failure to speak with one voice has played a major role in the disharmony below. Another way to analyze the circuit split is to consider the broader moral and political concerns that might have driven the circuits to develop their jurisprudence along such divergent paths. More specifically, one might ask how the lower courts have devel- oped their accounts of territorial jurisprudence so as to reinforce the legitimacy of the United States' authority over its territories. There are many reasons why courts might feel obliged to address such concerns, since America's governance of distant, insular terri- tories has always proved morally problematic. As an initial matter, the United States asserted control over its present holdings with- out first seeking the consent of the native inhabitants.4 Moreover, unlike earlier acquisitions in North America, the offshore islands are not expected to join the Union as states. For this reason, their inhabitants will never "ordain and establish" the federal constitu- tion (and the government it created) in the manner anticipated by 5 the document itself. This Comment argues that the doctrinal dispute between the two circuits reflects a profound debate over how to justify compel- ling territorial inhabitants to obey the government of the United States. The lower courts, the Comment will demonstrate, decide how extensively the Constitution "follows the flag" to a particular territory with an eye towards explaining why its residents must fol- low (i.e., pledge allegiance to) our flag. Analyzing the case law in this manner suggests an unorthodox conclusion: perhaps this cir- cuit split should remain unresolved. The Supreme Court's failure to answer the formal constitutional question serves a larger moral- political function. It has enabled lower federal courts to maximize the legitimacy of the United States' authority in each particular territory. Section I of this Comment presents an overview of the Su- preme Court's territorial jurisprudence, focusing on the Court's two rules for analyzing the Constitution's territorial reach. Section II discusses how the D.C. and Ninth Circuits have deepened this doctrinal divergence in their application of the Constitution to ' The United States captured Puerto Rico and Guam as a result of an expansionist war, acquired American Samoa pursuant to a partition agreement with other imperial powers, purchased the Virgin Islands from Denmark, and began administering the Northern Mari- ana Islands pursuant to an agreement with the United Nations. Section III explains why the disorder within the Supreme Court's jurisprudence does not account for the circuit split, and presents a framework for appreciating the role of legitimacy in United States territorial governance. Section IV employs a legitimacy-focused ap- proach to explain the apparent split between the two circuits. Sec- tion V argues that this doctrinal division should be left intact. More generally, the Comment indicates when one approach is to be preferred over the other. Lastly, this Comment suggests that the legal and moral dilemmas that underlie territorial governance are beyond the judiciary's capacity to resolve. I. THE SUPREME COURT'S TERRITORIAL JURISPRUDENCE A. The Insular Cases Doctrine The Supreme Court laid the constitutional groundwork for the modern American territorial system in the so-called Insular Cases.' This series of cases examined the constitutional issues raised by the United States' acquisition of offshore island (i.e., "in- sular") areas after the Spanish-American War of 1898. The most important of these cases is Downes v Bidwell,7 which contained a seminal concurring opinion by Justice Edward Douglas White. Ac- cording to White, territories acquired by the United States fall into two categories: "incorporated" territories, which are "an integral part of the United States," full members of "the American fam- ily,"' and likely candidates for eventual statehood; 9 and "unincor- porated" territories, which are held merely "appurtenant" to the United States, and seen as "foreign ... in the domestic sense."'10 White further argued that the application of the Constitution to a territory depends on its status under this scheme." The University of Chicago Law Review [59:779 States.12 Unincorporated territories, by contrast, need not be shielded by all of the Constitution's provisions, thus permitting the federal government to avoid certain constitutional limitations in governing them.'3 Twenty-one years after Downes, a unanimous Supreme Court embraced White's doctrine of territorial incorpora- tion, otherwise known as the "Insular Cases doctrine," as the law of the land. 4 B. The "Fundamental Rights" Test Once one accepts the principle enunciated in the Insular Cases-that not all constitutional provisions must apply to unin- corporated territories-it becomes necessary to identify those pro- visions of the Constitution which do in fact apply there. The tradi- tional approach set forth in the Insular Cases holds that only those constitutional provisions that protect the "fundamental" rights of individuals must extend overseas.' 5 Here again Justice White's concurring opinion in Downes provided the initial inspira- tion. He explained that even though unincorporated territories were to receive less than complete constitutional protection, they still benefit from "inherent, although unexpressed, principles which are the basis of all free government;" "restrictions of so fun- damental a nature that they cannot be transgressed.... "" These restrictions prohibit the government from disabling personal rights, thereby affirming those constitutional provisions that pro- 7 tect "human liberty.'1 To identify these "fundamental" provisions, White invited judges to invoke a natural rights philosophy.'8 The results of this inquiry are categorical-a right either is or is not "fundamental" in the territorial context, and its nature as such will not vary from setting to setting. A serious problem faced by every editor of symposia is that of achieving some unity to the undertaking. The editors of the present volume unified the work through the extent of their own writing, through the “ Overview and Conclusions” which pulls the whole volume together, and through the instructions to the individual contributors to guide them in the organization of the material desired. Although there is considerable variation in the extent to which the suggested outline was followed, this guide must have been an enormous aid as the contributors ap­ proached assignments any one of which could easily have de­ veloped into a book of its own. Included in the guide was a request for a selected bibliography. Since the chapters range widely over the whole field of demography, the selected bibliog­ raphy prepared by each author for his subject may well prove to be one of the most useful features of the book. In the “ Overview and Conclusions” the editors consider at some length the question as to what constitutes the science of demography, debating the merits of the restricted definition of demography as synonymous with demographic analysis, versus the more comprehensive definition embracing all population studies. They argue persuasively for the more limited defini­ tion as designating a single theoretical discipline with a co­ herent frame of reference.

Social demography deals with questions of population composition and change and how they interact with sociological variables at the individual and contextual levels. Social demography also uses demographic approaches and methods to make sense of social, economic, and political phenomena. The course is structured into two parts. Part I provides an introduction to some current debates, with the purpose of laying a common background to Part II, in which these topics are deepened by individual presentations of more specific questions. In Part I, read all the texts assigned to the core readings, plus one from the additional readings. Brief response papers (about 1 page) should identify the core question/debate addressed in the readings and the summarize evidence for/against core arguments. The response papers are due at 17:00 the day before class (on Brightspace). Similarly, the classroom discussions should focus on these topics. Holder, 1 Justice Antonin Scalia provoked audible gasps from the audience when he observed that in 2006 Congress had no choice but to reauthorize the Voting Rights Act, because it had become “a racial entitlement.”2 Later in the argument, Justice Sonia Sotomayor obliquely challenged Scalia’s surprise comment, eliciting a negative answer from the attorney for Shelby County to a question about whether “the right to vote” was “a racial entitlement.” 3 As revealed by these dueling remarks from the highest bench in the land, demography and democracy are linked in the public consciousness of Americans, but in dramatically different ways. Minority voters have learned from decades of experience that in a number of jurisdictions, the Voting Rights Act is nearly synonymous with their unfettered ability to vote. 4 Without the Act, their right to vote, American democracy’s fundamental precept, would be compromised to a far greater degree.5 So although Justice Scalia stated that, in his view, the Voting Rights Act had become a racial entitlement, that could only be because minority voters knew—as Congressional findings confirmed—that it was necessary to protect their access to the ballot.6 The powerful evidence of the Act’s indispensability in *Jacob Burns Foundation Professor of Clinical Law and Associate Dean for Clinical Affairs, George Washington University Law School. Demography as a statistical study of human population, has a significant impact on economic growth given certain area and period of time. This paper aims to include some of Islamic theory of demography and socio economics especially regarding family planning issue, along with other commonly used theories and bring them into the investigation of the long- and short- run relationship among demographic and socioeconomic variables in developing countries. Malaysia is used as a case study. This study, therefore, attempts to unravel the causality direction of demography and economic growth. We used annual data for the total fertility rate and infant mortality rate to represent demography, per capita gross domestic product and consumer price index to represent economic growth, and female labor participation along with female enrollment to secondary education percentage as links between demography and economic growth. Based on standard time series analysis technique, our findings tend to indicate the importance of female enrollment to education in finding a balance in the demography-growth nexus.

SHEPARD* The renaissance instate constitution jurisprudence has extended for nearly a generation. This movement has produced hundreds of appellate opinions, scores of journal articles, and dozens of books. These provide a substantial basis for assessing the viability of the movement and its impact on modem American law. The celebration of this renaissance is widespread, especially among state court judges and attorneys who practice civil liberties and civil rights law. There is, however, a modest countercurrent of criticism by some who express disappointment about the results of the litigation and others who question the intellectual caliber of the enterprise.     RULE OF LAW AND DUE PROCESS: A COMPARATIVE VIEW OF THE UNITED STATES AND JAPAN NORIHO URABE* I INTRODUCTION: RULE OF LAW AND RECHTSSTAAT Although this author does not know whether the phrase "Rule of Law" is popular in the United States outside of jurisprudential discussions, it seems that in Japan the term "Rule of Law" (ho no shihai) is used less often than the word Rechtsstaat (hochi-koku or hochi kokka), or "state based on law" or "ruled by law." For instance, when a serious illegal activity or crime has been committed, a prosecutor or other concerned government official often states, "This kind of illegal activity is never permissible in the state ruled by law (hochi kokka)." The hochi kokka means something like a state that preserves the public peace or protects people from crime. This is far different from the Anglo-American concept of the Rule of Law. Therefore, when Japanese legal scholars discuss the Rule of Law, the first problem to be discussed is the difference between the Rule of Law and the Rechtsstaat, both of which have been imported into Japanese law despite their disparate origins in Anglo- American and German law. Since Albert Venn Dicey advanced it as the pride of the English Constitution in the nineteenth century,' the modern Rule of Law has meant many things to many people. Therefore, it is difficult to define the meaning of the Rule of Law briefly and exactly. But we can say that the core of the Rule of Law, which has been supported consistently as a fundamental principle of the English and American Constitutions, is that governmental power be bound strictly by law in order to protect individual freedom or liberty.
