LOCATION: 54 Midland Road, Wellingborough. APPLICANT: Arshad Mahmood. PROPOSAL AND DESCRIPTION OF SITE: The application site is a commercial unit located within the Wellingborough town centre. The site is positioned within an area of the town centre which is designated as a mixed use area by the local plan. The area surrounding the site is comprised of a mix of commercial and residential uses. A row of commercial units including A1 and A2 uses is found adjacent to the site to the west. RELEVANT PLANNING HISTORY: The site is currently used as a hot food takeaway. NATIONAL AND LOCAL PLANNING POLICY: G1 and C10 of the Borough of Wellingborough Local Plan. SUMMARY OF REPLIES TO CONSULTATIONS/REPRESENTATIONS RECEIVED: 1. Highways Authority - recommends that the highway standards and planning conditions set out in the NCC document ‘Minor Planning Applications that have an effect on the highway’ be applied to this planning application. 2. Third Parties - one letter of objection and a petition, with 19 signatures, objecting to the proposal have been received. Objections raised are summarised as follows: • It was understood that residential development was to be encouraged in this part of Midland Road and further commercial development discouraged. • Granting the application would not be in line with the policy of residential development in this area. • The vast majority of properties going down Midland Road toward the rail station are residential. • Proposed taxi booking office would be best placed either near the station or directly in the town centre closer to potential customers. • Existing parking problems, including blocking of residential driveways, would be exacerbated. • Increased traffic and congestion. 3 • Speeding taxis present a safety hazard. • Increased pollution levels and increased litter. • Attract large numbers of people at night who are likely to be intoxicated. • Potentially increase in crime in the area. • Increased noise and disturbance. • Existing levels of loitering and vandalism will increase. Another letter has also been received which states that no objection is raised provided that the taxis do not park across the car park of No. 56 Midland Road or on the double yellow lines to the front of this commercial unit. ASSESSMENT: The application site is located within an area of the town centre which is designated as a mixed use area by the local plan. In such locations proposals for development must comply with Policy C10 of the local plan. Policy C10 states that: PLANNING PERMISSION FOR DEVELOPMENT WITHIN THE MIXED USE AREAS BEYOND THE TOWN CENTRE CORE WILL ONLY BE GRANTED IF IT WOULD NOT RESULT IN: 1. SUBSTANTIAL CONFLICT WITH SURROUNDING USES OR ADVERSE IMPACT UPON THE AMENITY OF ADJOINING RESIDENTIAL AREAS; 2. A CONSEQUENT LACK OF OPPORTUNITY FOR A BROAD RANGE OF USES TO BE ACCOMMODATED WITHIN THESE MIXED USE AREAS AS A WHOLE; 3. SUBSTANTIAL CONFLICT WITH THE STRATEGY OF CONCENTRATING MOST RETAIL USES IN THE TOWN CENTRE CORE AREAS; OR 4. SUBSTANTIAL INCREASES IN ON-STREET PARKING. As stated previously in this report this mixed use area is comprised of a range of uses including commercial and residential. The change of use from hot food takeaway to taxi booking office is considered to be acceptable in the proposed location in terms of the surrounding uses and residential amenity.
