27/15 Minutes

Resolved: That the minutes of the meeting held on 19 March 2015, having been printed and circulated, be taken as read and be confirmed and signed by the Chair as a correct record. Following the meeting David Jeffels verbally informed that Authority that he was not present at the March Planning Committee Meeting contrary to the minutes and should be noted under the ‘apologies’ section. The minutes were updated prior to being signed off by the Chairman as a correct record.

Members were reminded of their responsibility to declare any personal, prejudicial and/or discloseable interests relating to any agenda item prior to its consideration.

The Chairman informed Members of the Public of the emergency evacuation Procedure.

Considered:

The report of the Director of Planning.

Resolved: That the report be noted. In relation to 5(a) Members supported the notion of the Authority sending a robust letter to the Planning Inspectorate setting out our concerns in relation to the decision to award of costs against the Authority in relation to Mill Cottage, Levisham.

31/15 Applications for Planning Permission

The following members of the public addressed the meeting regarding the Plans List Items indicated:

Plans List Item 2 – John Wearmouth spoke in favour of the application, Elizabeth Cowley spoke against the application and Mr Garbutt spoke on behalf of Thornton Dale Parish Council Plans List Item 3 – Mark Stephens spoke in favour of the application

Considered:

The report listing applications and the Director of Planning’s recommendations thereon. Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters.

Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations:

List Plan No and Description of Proposal No 1. NYM/2014/0864/FL - Variation of conditions 2 (material amendment) 4, 8 and 9 of planning approval NYM/2012/0757/EIA to allow alterations to layout and landscaping design to accommodate 180 additional private spaces revisions to site opening times and siting of permanent lighting to serve additional parking spaces at OS Field 3618 bounded by Guisborough Road, A171, B1460 and Barkers Lane, for North County Council fao: Mr Rosstam Assadi, Country Hall, Racecourse Lane, Northallerton, , DL7 8AD. Decision Caroline Patmore, David Jeffels and Heather Moorhouse all declared a non- prejudicial interest in this item as North Yorkshire County Council members. Deferred as Members considered it premature to determine this proposal until the application for the minehead and mineral transport system has been determined. Members also requested that Officers engage further with the applicant on the issues of lighting, landscaping and flooding. 2. NYM/2015/0019/FL - Revised access arrangements, erection of larch clad shelter and installation of satellite mast (max height 5 meters) with associated cabinet at Pexton Moor, creation of new access to the north of Pexton Moor, revised access arrangements installation of satellite mast (max height 5 meters) with associated cabinet at Ebberston together with creation of new car park, link footpath for the visitor centre and field access and cattle pen at Sievedale at Dalby Forest for Forestry Commission fao: Mr Martin O’Vastar, Outgang Road, Pickering, North Yorkshire, YO18 7EL Decision Jeremy Walker declared a personal interest in this item as a former non- executive chair of the Forestry Commission Regional Advisory Committee for Yorkshire and Chair of the North Yorkshire Timber Freight Quality Partnership of which the Forestry Commission is a member. All Members declared that they had been lobbied. Approved with the decision delegated to the Director of Planning to clear following Officer negotiations with the applicant in relation to surfacing and landscaping of the car park together with a replacement condition no. 5 and additional condition as set out on the Members Update Sheet as follows: 5. Prior to the development being brought into use details of a landscaping scheme for the site shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall provide for enhanced bio-diversity measures, including flower rich grassland and boundary screen planting and shall include details of any existing hedges and trees to be retained on the site together with any measures for managing/reinforcing these and shall specify plant species, sizes and planting densities for any new areas of planting. The approved details shall be carried out no later than the first planting season following the occupation of the buildings, or completion of the development, whichever is the sooner, or in accordance with a programme agreed by the Local Planning Authority. The approved landscaping scheme shall be maintained in perpetuity unless otherwise agreed in writing by the Local Planning Authority. Members expressed to Officers their desire for good quality landscaping of the whole car park and placed specific emphasis on it being as green as possible. 9. Surface water draining from areas of hard standing shall be passed through a trapped gully or series of trapped gullies, prior to being discharged into any watercourse, soakaway or surface water sewer. The gully/gullies shall be designed and constructed to have a capacity compatible with the area being drained, shall be installed prior to the occupation of the development and shall thereafter be retained and maintained throughout the lifetime of the development. Clean roof water shall not pass through the gully/gullies. 3. NYM/2015/0093/FL – Creation of front parking area at Nun Cottage, 78 High Street, Hinderwell for Mr Mark Stephens, Nun Cottage, 78 High Street, HInderwell, Saltburn by the Sea, North Yorkshire, TS13 5ED. Decision Approved contrary to Officer recommendation as Members considered that the site is located within the village’s low 30mph limit, on a road which is of a good width and has an open aspect and good driving position as such felt there to be a low level of risk associated with the proposal. Members discussed the use of electric gates which were able to be opened remotely so as to reduce the amount of disturbance to the flow of traffic by cars waiting in the Highway.
