Cardozos' place in history as one of the country's most outstanding jurists and preeminent legal philosophers is secure. He is· widely acclaimed for being a successful practitioner, a brilliant legal scholar and a man who is ranked among the preemi nent American judges, along with Marshall, Kent, Story and Holmes.1 He was a giant of his era who, while spending all but six years of his pro fessionallife in New York, exerted a powerful national influence upon his own times. -

VIEWPOINT DIVERSITY IN LAW SCHOOLS ROBERT P. GEORGE* There are some people who hold the old-fashioned view that legal education does not belong in the university context; that it is, or should be, a form of essentially technical and vocational education that belongs elsewhere. They believe that universi- ties should be devoted to the disinterested pursuit and trans- mission of knowledge, rather than teaching people skills such as advocacy or working with statutes and legal texts. I am old-fashioned, but not even I am old-fashioned enough to believe that. I believe that law schools do have a very im- portant place on university campuses, and that we should not conceive of law schools as merely vocational and technical in- stitutions that are not concerned with the pursuit of knowledge and truth. And because I have that view of law schools, I do not sharply distinguish legal education, at least in its truth- seeking dimension, from legal scholarship. I do not sharply dis- tinguish legal scholarship from scholarship in the arts and sci- ences, and I think that reflects law schools’ ambitions these days. Law schools want to be places where real scholars do real scholarship. They are interested in the disinterested pursuit of truth, the creation of knowledge, the preservation of knowledge, and the transmission of knowledge. So to a very considerable extent, law schools are not, and should not be in my view, mere vocational technical institutions, but truth-seeking institutions—a part of universities that have as their mission the seeking of knowledge and truth. -

The centrality of practical reason: Dworkin and Kant In one of his latest books Justice for Hedgehogs (2011) Ronald Dworkin presents a thorough critique of contemporary ethical discourse. Explicitly his arguments mostly seek to undermine the main premises of metaethics, especially, the assumption that it is possible to think and talk about ethics from a neutral Archimedian position and to find its grounding in scientific or metaphysical facts. Moreover, he aims to present his own position as a specific revolution – a position which questions all the ways of approaching ethics that dominate or influence the field of moral philosophy since modern times, namely Descartes. There have been many attempts to criticize, question and evaluate this critique, its accuracy and extent.1 However, much less effort have been made to properly and comprehensively evaluate the constructive and potential side of Dworkin’s position. The main question that his critique of contemporary ethical discourse raises is ‘How should we approach ethical questions and problems?’ or ‘How should we do moral philosophy?’ Such questions are essential for the discourse itself. They should determine not only the shape and methods, but also the future and raison d’etre of ethical theory as such. Dworkin himself takes Hume to be the inspiration for his revolution. According to Dworkin, Hume’s distinction between fact and value gives us a clear guidance as to how we should proceed in ethical discourse. Dworkin develops this distinction as his main argument that ethics is an independent domain of thought. However, my paper argues, that despite Dworkin’s appeal of Hume, his position cannot be seen as Humean and is much more akin to Kant as there are several substantial conformities between their theories and premises. -

The “Hedgehog and the Fox” Reconsidered 149 Chapter 9 The “Hedgehog and the Fox” Reconsidered: Unreconciled Religious Diversity in the Dialogue of Civilizations1 Philip L. Wickeri The theme for religions and the dialogue of civilizations, is a most important one for creating peace and harmony in our world and in our own communities. In this paper, I re-introduce the metaphor of “the hedgehog and the fox” as a way of speaking about inter-civilizational dialogue in a world of unreconciled religious diversity. By unreconciled diversity, I mean the inter-religious differ- ences that cannot be overcome or “harmonized” and therefore must be accepted and dealt with. 1 Part In 1953, Sir Isaiah Berlin (1909–1997) wrote an essay on Leo Tolstoy’s view of history entitled “The Hedgehog and the Fox.”2 This became one of the most influential essays ever written on Western intellectual history, and it is still in print today. Berlin takes his point of departure from an obscure philosophical fragment that has been attributed to the ancient Greek poet Archilochus: The fox knows many things, but the hedgehog knows one big thing. There is no certain interpretation of this sentence. The fragment may mean no more than that the fox, in his cunning, is defeated by the hedgehog’s one sure defense. 1. Introduction

Introduction Isaiah Berlin’s little book, The Hedgehog and the Fox (1953), takes its title from a line by the Greek poet Archilochus: πόλλ᾽ οἶδ᾽ ἀλωπηξ ἀλλ᾽ ἐχῖνος ἓν μέγα ‘many [things] knows [a] fox but [a] hedgehog one big [thing]’. Since it is impossible to do justice in a paraphrase to Berlin’s prose, I will quote the relevant passage in full: [T]aken figuratively, the words can be made to yield a sense in which they mark one of the deepest differences which divide writers and thinkers, and, it may be, human beings in general. For there exists a great chasm between those, on one side, who relate everything to a single central vision, one system less or more coherent or articulate, in terms of which they understand, think, and feel—a single, universal, organizing principle in terms of which alone all that they are and say has significance—and, on the other side, those who pursue many ends, often unrelated and even contradictory, connected, if at all, only in some de facto way, for some psychological or physiological cause, related by no moral or aesthetic principle; these last lead lives, perform acts, and entertain ideas that are centrifugal rather than centripetal, their thought is scattered or diffused, moving on many levels, seizing upon the essence of a vast variety of experiences and objects for what they are in themselves, without, consciously or unconsciously, seeking to fit them into, or exclude them from, any one unchanging, all-embracing, sometimes self-contradictory and incomplete, at times fanatical, unitary vision. -

A Backdoor to Policy Making: The Use of Philosophers by the Supreme Court Neomi Raot The Supreme Court's decisions in Vacco v Quill' and Wash- ington v Glucksberg2 held that a state can ban assisted suicide without violating the Due Process or Equal Protection Clauses of the Fourteenth Amendment. In these high profile cases, six phi- losophers filed an amicus brief ("Philosophers'Brief') that argued for the recognition of a constitutional right to die.3 Although the brief was written by six of the most prominent American philoso- phers-Ronald Dworkin, Thomas Nagel, Robert Nozick, John Rawls, Thomas Scanlon, and Judith Jarvis Thomson-the Court made no mention of the brief in unanimously reaching the oppo- site conclusion.4 In light of the Court's recent failure to engage philosophical arguments, this Comment examines the conditions under which philosophy does and should affect judicial decision making. These questions are relevant in considering the proper role of the Court in controversial political questions and are central to a recent de- bate focusing on whether the law can still be considered an autonomous discipline that relies only on traditional legal sources. Scholars concerned with law and economics and critical legal studies have argued that the law is no longer autonomous, but rather that it does and should draw on many external sources in order to resolve legal disputes. Critics of this view have main- tained that legal reasoning is distinct from other disciplines, and that the law has and should maintain its own methods, conven- tions, and conclusions. This Comment follows the latter group of scholars, and ar- gues that the Court should, as it did in the right-to-die cases, stay clear of philosophy and base its decisions on history, precedent, and a recognition of the limits of judicial authority. -

Some Reflections on Judge Learned Hand*
SOME REFLECTIONS ON JUDGE LEARNED HAND* JEom N. FRANK I WAS ASKED, originally, to speak of Great Judges. I objected. What, I queried, does one mean by "great"? I remembered my dispute with Professor Thorne and Justice Frankfurter about Lord Coke, once Chief Justice of England. I said Coke was a nasty, narrow-minded, greedy, cruel, arrogant, insensitive man, a time-serving politician and a liar who, by his adulation of some crabbed medieval legal doctrines, had retarded English and American legal development for centuries.1 Thorne and Frankfurter replied that I proved their case, that the duration of his influence, no matter whether good or bad, made him a great judge. I think I lost that argument. But if that be the test, then we must put on our list of "greats" such men as Attila, Robespierre, and Hitler, although most of us consider them evil. And so too as to the great among legal thinkers, lawyers, and judges. Consider Tribonian who contributed importantly to the Justinian codification of Roman law which mightily affected the legal systems of the western world. Who was Tribonian? A brilliant scholar but a corrupt judge. I concede, indeed I insist, that great men, good or evil, have often helped to shape history. Carlyle's theory of history-that all history results from the deeds or thoughts of great men-is nonsense, of course. But I think equally nonsensical what I call the No-Man Theory of history, according to which men are but puppets of "social forces," or economics, or geography, or the "spirit of the times"-in short, non-human or un-individual factors which wholly account, deterministically, for all human events. -

He excelled as an essayist, lecturer and conversationalist; and as a brilliant speaker who delivered, rapidly and spontaneously, richly allusive and coherently structured material, whether for a lecture series at Oxford University or as a broadcaster on the BBC Thir Sir Isaiah Berlin was a philosopher and historian of ideas, regarded as one of the leading liberal thinkers of the twentieth century. It really does. He believed that free will was an illusion and that the idea that great events happen because of "great men", that we can say that one thing happens because one commander made this decision, is ludicrous. In his Founding Brothers about key figures of the American Revolution, the historian Joseph Ellis , uses Berlin's "Hedgehog and Fox" concept in evaluating George Washington , noting that "Washington was an archetypal hedgehog. Eventually, though, Berlin reveals that Tolstoy had an even stronger belief: that no actor inside of history can ever understand why things happen the way they do, no matter the depth of his study.
