INTRODUCTION 1. SAH Acquisition Corporation II (“SAH”), licensee of television broadcast station KCNS- TV, San Francisco, California (“KCNS” or the “Station”), has filed a must carry complaint with the Commission pursuant to Sections 76.7 and 76.61 of the Commission’s rules, claiming that Wander Cable Television (“Wander”) has failed to commence carriage of KCNS on Wander’s system serving Gualala and Bolinas, California and the surrounding areas (“the cable communities”).1 SAH requests that the Commission order Wander to commence carriage of KCNS on Channel 38 of the cable system serving the cable communities. No opposition to the complaint was received. II. BACKGROUND 2. Pursuant to Section 614 of the Communications Act and implementing rules adopted by the Commission in Implementation of the Cable Television Consumer Protection and Competition Act of 1992, Broadcast Signal Carriage Issues (“Must Carry Order”), commercial television broadcast stations are entitled to assert mandatory carriage rights on cable systems located within the station’s market.2 A station’s market for this purpose is its “designated market area,” or DMA, as defined by Nielsen Media 1 47 C.F.R. § 76.7 and 47 C.F.R. § 76.61.

As such, we have great interest in the Notice of Proposed Rulemaking to permit all AM stations to broadcast an all-digital signal using the HD Radio in-band on-channel (IBOC) mode known as MA3 on a voluntary basis (“Notice”), and we offer the following comments in support of this petition. I. Benefits of All-Digital AM Transmissions It has been well established for more than a decade of operation by many of our stations in the MA1 hybrid digital mode that AM stations stand to gain a great deal from digital operation. Greatly improved audio quality is at the forefront, with audio bandwidth comparable to FM broadcasts, stereo audio and receiver display of title/artist or program title information. When a receiver locks in the digital mode to one of our stations, particularly one playing music, as the receiver blends from analog to digital, the contrast is dramatic. The highs and lows of the audio open up, the stereo image widens out, and the noise that seems to be ever present on almost any AM frequency disappears. Listeners experiencing this effect for the first time are quite often amazed at how good an AM broadcast can sound in this mode.

Emmis’ radio net revenues for the third fiscal quarter were $28.7 million, down from $34.0 million in the prior year. Sales of radio stations (KPWR in LA in August 2017 and four radio stations in St. Louis on April 30, 2018) make Emmis’ reported results not comparable year-over-year. Pro forma for all radio station sales, Emmis’ third quarter radio revenues, as reported to Miller Kaplan, which excludes barter and certain other revenues, were up 5% in markets that were up 2%. “With this quarter’s strong performance, Emmis is now outperforming its markets through the first nine months of this fiscal year– quite an achievement,” said Emmis Chairman and CEO Jeff Smulyan. “Political revenues certainly helped, but we also saw growth in our core advertising categories, all of which contributed to Emmis having its strongest quarter in four years.
