On motion of Mr. Lagasse, seconded by Ms. Lee-Sheng, the following resolution was offered: RESOLUTION NO. 118452 A resolution authorizing the purchase of 1000 North Lester Avenue, Metairie, Lot X-2-A, Eastbank Subdivision from Gloris and Ray Hooter for the Southeast Louisiana Urban Flood Control Project (SELA), Soniat Canal, Lester to West Metairie (SELA-08a), DPW No. 97-046-DR and to provide for related matters. (Council District 4) WHEREAS, Gloris and Ray Hooter are the owners of 1000 North Lester Avenue, Metairie, Lot X-2-A, Eastbank Subdivision; and WHEREAS, said property is needed for the Southeast Louisiana Urban Flood Control Project (SELA), Soniat Canal, Lester to West Metairie (SELA-08a), DPW No. 97-046-DR; and WHEREAS, the acquisition for this project must be in accordance with Public Law 91-646, The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended (“Uniform Act”); and WHEREAS, under the Uniform Act the property owners of residential propety are entitled to fair market value for their property, together with reasonable and necessary relocation assistance, due to the fact that they are being displaced from their home; and WHEREAS, 1000 North Lester Avenue, a residential property, was appraised by Argote, Derbes, Graham, Shuffield & Tatje, Inc. and said appraisal was reviewed by Gayle Boudousquie & Associates as required under the Uniform Act; and WHEREAS, said property appraised for $310,000.00 which was offered to the owners, who responded with a documented counter-offer of $350,000.00; and WHEREAS, after review of the documented counter-offer it was agreed that $325,000 would be fair and just compensation for acquisition of the property, which amount the owners have accepted. NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the governing authority of said Parish: SECTION 1. That Jefferson Parish is hereby authorized to purchase 1000 North Lester Avenue, Metairie, Lot X-2-A, Eastbank Subdivision from Gloris and Ray Hooter for the Southeast Louisiana Urban Flood Control Project (SELA), Soniat Canal, Lester to West Metairie (SELA-08a), DPW No. 97-046-DR. SECTION 2. That Jefferson Parish is hereby authorized to pay $325,000.00 as full and final just compensation for said property. SECTION 3. That Jefferson Parish is further authorized to pay relocation benefits to Gloris and Ray Hooter at an amount not to exceed the amount to which they are found to be entitled under the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended. SECTION 4. That all costs associated with this purchase shall come from Budget Account No. 45250-4040-7710 (52515.002), as authorized. SECTION 5. That the Council Chairman, or in his absence the Vice-Chairman, is authorized to sign any and all documents required to carry out the provisions of this resolution. The foregoing resolution having been submitted to a vote, the vote thereon was as follows: YEAS: 7 NAYS: None ABSENT: None The resolution was declared to be adopted on this the 15th day of February, 2012.
