FINANCIAL INSTITUTION SECURED PARTY INTEREST AGREEMENT

THIS AGREEMENT made and entered into this day of , 20 , by and between (hereinafter Community) and (hereinafter Owner).

WHEREAS, Community can obtain a Final Judgment for EVICTION on the home located at registered to , and can obtain a Writ of Possession for those same premises.

WHEREAS, has a monetary interest in the above-referred-to home and is desirous of having the Community allow the home to remain on the above- referenced premises and is further desirous of having the Community refrain at this time from execution upon a Writ of Possession;

NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein and other good and valuable consideration, the parties agree as follows:

will make the following repairs to the home and also in order to comply with the Community Covenants applicable to all residents living in the Community as follows:

Contemporaneous with the execution of this Agreement, Owner agrees to tender to Community a check in the amount of $ ( Dollars and Cents) which funds evidence the out-of-pocket and loss incurred by the Community. This Agreement will only be binding upon the Community upon collection of the funds evidenced by the tendered check.

Owner agrees that should it fail and/or refuse to comply with the above-listed items, and/or refuse to tender said funds, and/or said funds should be returned to Community uncollected or insufficient funds, this Agreement will be null and void and Community may immediately have home removed and file a lien for any and all monies owed to the Community.

Community agrees that it will forego final eviction of the home from the Community for a period of thirty (30) days to allow Owner to comply with the conditions herein before stated. Community, however, reserves the right that should this Agreement not be completed within thirty (30) days from the date hereon, Community will remove the home pursuant to the Writ of Possession forthwith.

The Parties further agree that the home, subject to mutual agreement and satisfactory completion of the aforementioned repairs and payment of the aforementioned funds, may remain in the home Community of the same space for the customary rental fee, to be kept in a current status by Owner, until sold to an approved party hereafter. The new party (Buyer) may also continue to keep the home in the Community subject to the Community Covenants and the applicable state law.

Community agrees that should Owner comply with all the terms and conditions of this Agreement, Community will voluntarily dismiss the eviction presently pending in the (Court).

This is the entire Agreement of the Parties. No modification will be effective to change this Agreement unless said modification is in writing and executed by both Parties.

The Parties further agree that should litigation develop over the terms of this Agreement that the prevailing Party is entitled to all reasonable costs, including attorney’s fees.
