Mortuary Law (or Funeral Service Law) is the law governing the disposal of dead human remains and regulation of funeral directors/embalmers and funeral establishments. Mortuary Law also includes matters related to crematories, transportation of human remains (interstate, intrastate, and internationally), pre-need funeral insurance policies, consumer trade practices as governed by the Federal Trade Commission (FTC) Funeral Rule, and public and private cemeteries (exhumation/disinterment and reinterment).

If there is no resolution or you would like to file a complaint, the Minnesota Department of Health (MDH) has a Mortuary Science Section where you may file complaints against funeral establishments, crematories, or funeral directors. The Minnesota Attorney General’s Office reviews consumer complaints regarding cemeteries. You do not need to be represented by an attorney to file these complaints. However, an attorney may review the facts of your case and determine how best to proceed to resolve the matter.
