April 5, 2011 Zoning Board of Adjustment

Pursuant to the "Open Public Meeting Act," The Sentinel and the Gloucester County Times were notified of this meeting. A public notice was posted in the Municipal Building. The meeting of the Township of Franklin Zoning Board of Adjustment was called to order by Chairman, John Gravenor, at 7:01 PM with the following members present: William Dalessandro, Dakar Ross, Dana DeCesari, William Lahn, Alt. 1 Kevin Kelton and Fred Schiavone. B. Michael Borelli, Solicitor was also present. [NOTE: Time on FTR is 1 hour ahead.]

Absent: Rich Iglesias, Alt. 2. Russell Leo. Bob Hall, Planner of Pennoni Assoc. is present. Lee Phillips, Engineer of Pennoni Assoc. is absent.

Mr. Gravenor led in the flag salute. Mr. Gravenor states Kevin Kelton, Alt. 1 is seated in the absence of Mr. Iglesias.

APPROVE MINUTES 3/01/2011 Upon a motion by Mr. Dalessandro, seconded by Mr. Ross, all in favor, to approve the 3/1/2011 Minutes. Motion Passed.

ZB11-2 Rodney Hilla B1903 L61 C Variance garage larger/taller than permitted Fries Mill Road B2701 L9 Mr. Borelli states all papers are in order.

Rodney Hilla of 1502 Fries Mill Road, NJ is sworn in and states that he is looking for variance approval as per Section 253-3, whereas, garage is larger and taller than permitted. Mr. Hills states he needs space for restoration of his 1969 GTO, lawn equipment storage and he has been there 4 years and has no existing garage. Mr. Hilla states he will need no large equipment as his neighbor has excavating machines. Mr. Hilla states his garage will mimic his house in style, color and look.

Bob Hall, Planner of Pennoni, Assoc. recaps his report. Mr. Hall states there are 2 variances for size and height. Height proposed is 20’ midpoint of roof and asks if well and septic will be close to garage. Mr. Hilla states septic and well will not be impacted by garage and driveway is currently asphalted and will continue with exception of 20’ of garage. Mr. Hall states if you disturb more than 5000 sq. ft., you may need Gloucester Co. Soil Conservation. Mr. Hall points out there will be no commercial use in the residential zone. Mr. Hall is very comfortable with this, there is a larger detached garage to the North left of property as you face it, and this garage will not be a problem. Mr. Gravenor states that you cannot see house from road. Mr. Hall states it is all residential, but across the street is the B Business district.

Mr. Kelton asks if his property backs up to Scotland Run. Mr. Hilla states Mr. Grochowski’s property goes to the rear of his property. Mr. Kelton asks if stream issue would affect his property. Mr. Hall states property adjacent does rap around Mr. Hilla’s property, then the Township property then there is a stream and would be approximately 1200’-1500’ to his lot and woods are even further back. Mr. Kelton asks if there is an impact with transition. Mr. Hall states no, he would not have an impact.

Mr. Borelli states there is no plumbing or septic in garage. Mr. Hilla states no and cars are just his hobby.

Upon a motion by Mr. Schiavone, seconded by Mr. Dalessandro, all in favor, to open the public portion. Motion passed. Upon a motion by Mr. DeCesari, seconded by Mr. Dalessandro, all in favor, to close the public portion. Motion passed. Upon a motion by Mr. Dalessandro, seconded by Mr. Lahn, to approve ZB11-2 Rodney Hilla for 2 Variances for height and size of Garage, conditioned on residential use only, no commercial use. RCV: Mr. Dalessandro, yes; Mr. Ross, yes; Mr. DeCesari, yes; Mr. Lahn yes; A-1Mr. Kelton, yes; Mr. Schiavone, yes; Mr. Gravenor, yes. Motion passed.

APPROVE RESOLUTION: ZB11-1 Paul Esposito Upon a motion by Mr. DeCesari, seconded by Mr. Dalessandro, all in favor, to approve Resolution ZB11-1Paul Esposito. Motion passed.

APPROVE SECRETARY'S REPORT Upon a motion by Mr. Lahn, seconded by Mr. DeCesari, to approve March 2011 Secretary’s Report for $870.00. RCV: Mr. Dalessandro, yes; Mr. Ross, yes; Mr. DeCesari, yes; Mr. Lahn, yes; Mr. Kelton, yes; Mr. Schiavone, yes; Mr. Gravenor, yes. Motion passed.

CORRESPONDENCE No Action ADJOURN Upon a motion by Mr. Lahn, seconded by Mr. Schiavone, all in favor, to adjourn the meeting at 7:33PM.
