Section 63171020(5) of the 1976 Code is amended 23 to read: 24 25 “(5)(a) ‘License’ means: 26 (a) a certificate, license, credential, permit, registration, or any 27 other authorization issued by a licensing entity that allows an 28 individual or is required of an individual to engage in a business, 29 occupation, or profession and includes, but is not limited to, a 30 medical license, teaching certificate, commission and certificate of 31 training from the South Carolina Criminal Justice Academy for a 32 sworn law enforcement officer, and a hunting, fishing, or trapping 33 license for commercial use and the privilege to hunt, fish, or trap 34 or hold a hunting, fishing, or trapping license for commercial use; 35 (b) a driver’s license and includes, but is not limited to, a 36 beginner’s or instruction permit, a restricted driver’s license, a 37 motorcycle driver’s license, or a commercial driver’s license; 38 (c) a hunting, fishing, or trapping license for recreational 39 purposes , a watercraft registration for recreational purposes, and 40 the privilege to hunt, fish, or trap or hold a hunting, fishing, or 41 trapping license for recreational purposes; 42 (d) a watercraft registration.

[3606] 2 1 ‘License’ does not include the authority to practice law; 2 however, the Supreme Court may consider as an additional ground 3 for the discipline of members of the bar the wilful violation of a 4 court order including an order for child support. The department 5 has grounds to file a grievance with the Supreme Court if a 6 licensed attorney is in wilful violation of a court order for child 7 support. 8 (b) ‘License’ does not mean: 9 (i) a driver’s license including, but not limited to, a 10 beginner’s or instruction permit, a restricted driver’s license, a 11 motorcycle driver’s license, or a commercial driver’s license; 12 (ii) a hunting, fishing, or trapping license for 13 commercial purposes , a watercraft registration for commercial 14 purposes, and the privilege to hunt, fish, or trap or hold a hunting, 15 fishing, or trapping license for commercial purposes; or 16 (iii) a certificate, license, credential, permit, registration, or 17 any other authorization issued by a licensing entity that allows an 18 individual or is required of an individual to engage in a business, 19 occupation, or profession including, but not limited to, a medical, 20 nursing or other health care license, a teaching certificate, a 21 commission or certificate of training from the South Carolina 22 Criminal Justice Academy for a sworn law enforcement officer, or 23 a South Carolina Bar license and any other authority required to 24 practice law as determined by the South Carolina Supreme Court.” 25 26 SECTION 2. This act takes effect upon approval by the 27 Governor. 28 XX 29
