The House met at 10h02

1. 10h03 The House was given an opportunity for silent prayer or meditation.

2. 10h04 The Speaker made announcements including the passing away of Councillor Vusi Ntombela, Speaker of Nquthu Local Municipality.

The House observed a minute of silence.

3. 10h07 The following reports were tabled.

- KwaZulu-Natal Legislature Monthly Report tabled in terms of Section 54 (1) & (2) of the Financial Management of Parliament and Legislatures Act, 2014. The report is referred to STACOV for oversight purposes.

- Report of the Premier and Royal Household Portfolio Committee on the KwaZulu-Natal Commissions Amendment Bill, 2015.

1 4. 10h08 The following members gave notice of their intention to move the following motions on the next sitting day of the House:

4.1 Ms DD Dlamini, ANC, to move:

Noting:

Safety of learners and teachers at schools sibuhlungu nokulahlekelwa uSomlomo wase Nkosi Bhambatha ngendlela eyisihluku u-Vusi Ntombela, nomntwana othintekile kulesi sigameko osesibhedlela.

leNdlu inquma kanje:

ukuqikelela ukuthi ezokuphepha zikhona kuzozonke izikole ziqikelele abangenayo as schools are gun free zones be checked ama weapons.

To send condolences to the families, the school and the community of their loss; and

For the law to take its cause on the perpetrators.

4.2 Bishop EV Dube, ANC:

This motion was ruled out of order as it had exceeded the maximum length of 100 words, as laid down by Rule 94(1) of the Standing Rules of the KwaZulu-Natal Legislature.

4.3 Dr I Keeka, DA, to move:

Noting:

The report by the Public Services Commission that the Western Cape[WC] DoH is the best in health care delivery, specifically with regards to the management of medicines.

The report further noting that the WC has an excellent and efficient distribution system.

This House resolves:

To congratulate the DA run WC for topping other 2 provinces; To ensure that the Health Portfolio Committee and DDG responsible for pharmaceutical services, visits the WC to bring back the excellent model of healthcare delivery to the people of KZN; and

That our health MEC takes full responsibility for being unable to do what the WC has done.

4.4 Ms WG Thusi, ANC, to move:

Ukuthi wonke amaLunga aleNdlu ehloniphekile afake isandla ukuvikela izingane izinsuku eziyi 365 zonyaka. Kuyadabukisa ukuthi ngalelisonto kubekhona abenze ubulwane bayodubula uthisha phambi kwezingane ezincane.

4.5 Mr MB Gwala, IFP, to move:

This House noted:

The IFP’s dinner attended by ex-ANC Secretary-General honourable Motlante and ANC National Chairperson 3 honourable Mbete. This was one of events through which IFP celebrates its 40th Anniversary. We marvel that despite many written obituaries, the IFP is still alive and kicking.

We are humbled by history’s vindication of commitment to non-violent overthrow of apartheid and negotiated multi- party democracy; positions which cost us dearly.

This House resolves to:

Salute the IFP President for unwaveringly adhering to hallowed Bloemfontein values; advocating pragmatic politics and peaceful co-existence in a multi-party democracy; and

Salute IFP men and women who sacrificed for a free South Africa.

4.6 Mr S Moodley, IFP, to move:

That the protection of our children be prioritized especially since the alarming statistics of child kidnapping and murders highlight how vulnerable our children are to these atrocities.

Having just commemorated International Children’s day on the 1st June, we must as a matter of urgency re- commit to the safety of our children by creating conducive environments that safeguard their well-being.

This House needs to articulate its condemnation for those who rob our children of their childhood and ensure stricter punishment is meted out to child offenders.

4.7 Mr HF Motala, IFP, to move:

That the House notes: 2010, the year we held as a proud moment in South African history. We flew a flag high. We should have known better because Bafana Bafana is known as Butwena Butwena? Thank you government for another corruption scandal. Chuck Blazer has named you and you have shamed our beautiful country after testimonies by FIFA members that we had bribed our way into the 2010 World Cup. 4 This House therefore resolves:

Those involved in this fraudulent behaviour be given harsh penalties; and

Our country deserves answers. 4.8 Mr AV Khoza, EFF, to move:

This House notes:

The recent dropping of all charges, the sequestration in particular, that was meant to double and event triple punish honourable Julius Malema. We also noting that SARS was actually being used for political reasons.

This House therefore resolves:

State institutions should be protected from being used for political reasons and for settling of political scores.

4.9 Mr EM Nkosi, ANC:

This motion was ruled out of order as it had exceeded the maximum length of 100 words, as laid down by Rule 94(1) of the Standing Rules of the KwaZulu-Natal Legislature.

4.10 Mr PN Msimango, IFP, to move:

4.11 Ms PH Khuzwayo, NFP, to move:

This House notes:

The Quadpara Association of SA is an organization whose vision is to protect the interests of people with mobility impairments. The driving ambitions driver training programme has been launched in KZN to enable people with disabilities to acquire driving licenses and to make public transport accessible to them. This project is spearheaded by the private sector;

This is unacceptable as it means the ANC government does not recognize the need to support disabled persons in this regard.

This House therefore resolves:

The Departments of Social Development and Transport will work together to allocate resources and prepare traffic departments to support these candidates.

4.12 Mr MR Sayedali-Shah, DA, to move:

Noting:

That the appointment of Ms N Thafeni to the position of Chief Provincial Traffic Inspector Midway was deemed irrational and irregular.

Further noting:

That the MEC for Transport in his response to the Transport Budget Debate of the 30th April 2015 indicated that she has since been temporarily transferred to the Ladysmith Regional Office, pending her permanent transfer to the Public Transport Enforcement Services.

That the House resolves: 6 To call upon the Sepaker to schedule an urgent debate on this important matter and in the interest of accountability.

4.13 Dr R Viranna, DA, to move:

Noting:

The gruesome murders of Mr Peter and Ian Johnson on their Nyoni Farm in an apparent robbery;

Between 2012 to 2014 there have been 178 farm attacks and almost 20 farm murders in KwaZulu-Natal; and

The current rural safety strategy by DCSL is severely deficient and ineffective.

Hereby resolves:

To extend our deepest condolences to the Johnson family.

To ensure proper food security and a growing agrarian economy filled with opportunities, KwaZulu-Natal DCSL needs to urgently implement a policy to keep our rural communities safe.

4.14 Ms NM Khoza, ANC, to move:

4.16 Mr BM Zuma, ANC, to move:

Noting that:

- Millions of children are still abused on a daily basis;

- Most violence cases take place in private settings, domestically; and

- there are some teacher who are practicing corporal punishment in schools.

This House therefore resolves:

To commend the Minister for Social Development and the MEC together with the Harry Gwala District Municipality for launching a very successful child protection week in greater Kokstad last Friday.

That this House:

8 Debate ways and means that will bring about awareness, campaigns to families, children and make a strong call for harsh sentences to people who abuse and exploit children as abusing children is a crime.

5. 10h30 Mr SC Nkosi tabled the Report of the Finance Portfolio Committee on the Final Mandate on the Financial and Fiscal Commission Amendment Bill [BIB – 2015]

6. 10h31 Question Session commenced and questions number 18, 34, 35, 36, 37, 38, 39 and 40 were answered from Question Paper No. 1/2015. Questions 80, 88 and 89 were deferred to the next Question Session. Question Session concluded at 11h02.

7. 11h03 The debate on the 2015/2016 ANC Party Motion commenced and was concluded at 12h17.

8. 12h18 The debate and voting on the KwaZulu-Natal Commissions Amendment Bill commenced and was concluded at 13h00.

Question put and agreed to on the Bill.

9. 13h01 The debate and final mandate on the Financial and Fiscal Commission Amendment Bill commenced and was concluded at 13h28.

Question put and agreed to for the KwaZulu-Natal Delegation to the NCOP to Vote in favour of the Bill.
