ENF/DAL/2007/381 Haselden Oast Farm, Battle Road, Dallington – Mr and Mrs Nicholls Breach of condition 2 of planning permission RR/2000/415/P. Road repair use exceeds one third of barn (enforcement notice appeal).

RR/2009/462/O Wylands International Angling Centre - Wylands International Angling Centre Lawful use for the land for the siting of 2 caravans for the purpose of providing holiday accommodation.

ENF/RYE/2007/535 15 Udimore Road, Rye – Iftikhar Javed Khan Change of use to house in multiple occupation (enforcement notice appeal).

RR/2010/357/O Boundary Farm – land opposite, London Road, Hurst Green – N F K Watts and N C E Watts The applicants’ proposed use is that of keeping livestock in the stables and when housed as such, monitoring their welfare full time by way of time shifts and in such time expended pursuing a minor ancillary non-commercial use in arts and crafts. For the sake of clarity this would involve the full time occupation of the barn and stables 24 hours per day.

Whatlington Garage, Whatlington An appeal against an Abatement Notice served under the Environmental Protection Act 1990 for odour was also dismissed.

HIGH COURT CHALLENGES

RR/2006/3470/P Wylands International Angling Centre, Powdermill Lane, Catsfield/Battle – Mr Bull Renewal of outline consent RR/98/2292/P for the erection of 15 fisherman's cabins, facilities building, workshop/store, new dwelling and conversion of 2 existing dwellings into one, also re-siting of access.

Mr M Parker (Rule 6.6 party) has been partially successful in his application for leave to appeal to the Court of Appeal against the High Court judgement against him. The decision of the Inspector dated 11 December 2008 was quashed. Directions from the Planning Inspectorate regarding a further Public Inquiry are awaited.

RR/2006/2226/P Bowling Green, Knowle Road, Bexhill – Churchill Retirement Living Re-development to form 41 sheltered apartments for the elderly, car parking, landscape and access and new outdoor bowls green, indoor rink, club facilities and car parking including alteration to existing and formation of new vehicular accesses. pl110120 - Appeals 2 Anne Marie Loader has applied for Judicial Review following the Secretary of State for Communities and Local Government’s direction that the proposal is not development under the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999. She has now been given leave to pursue an additional challenge to the determination of the Secretary of State, under the Environmental Impact Regulations. Notification of the hearing date in the High Court is awaited.

RR/2008/1657/O Pear Tree Cottage, Battenhurst Road, Ticehurst – Mr Matthew Bramall

Challenge lodged by Mr Matthew Bramall against the decision made on 27 July 2010 by the Inspector appointed by the Secretary of State for Communities and Local Government to dismiss the appeal (reference CO/9297/2010). A Hearing date is awaited.
