APPLICATION FOR THE VARIATION OF A PREMISES LICENCE

Maids Head, 85 Spixworth Road, Old Catton, Norwich, NR6 7NH.

1 SUMMARY

1.1 This report details an application to Vary a Premises Licence.

2 INTRODUCTION

2.1 The Sub-Committee is requested, in accordance with the delegation of licensing functions contained in the Broadland District Council Statement of Licensing Policy to consider an application to Vary a Premises Licence in respect of Maids Head, 85 Spixworth Road, Old Catton, Norwich.

(a) The premises are currently licensed for the sale of alcohol, normal standard hours as conferred by a transitional/conversion premises licence issued pursuant to grandfather rights.

3 THE APPLICATION

3.1 An application has been received from KCC Inns Limited, Rostron and Partners, St Peters House, Cattlemarket Street, Norwich NR1 3DY to Vary the Premises Licence.

3.2 The application to Vary consists of the following proposals contained within the Operating Schedule:-

 B. Exhibition of Films (indoors), Video entertainment on TV screens and amusement machines.

Sunday to Thursday 11.00 to 00.00

Friday to Saturday 11.00 to 00.30

Non standard timings in addition to the above:

 C. Staging of Indoor Sporting Events, to permit pub games that attract an audience, whether by advertisement or spontaneously.

When hours for sale of alcohol are extended on Bank Holidays and Christmas Eve and Boxing Day.

 E. Live Music (indoors and outdoors), Live acoustic/amplified music and amplified voice all performances will be limited to end at 00.00 for indoors and dusk for outdoors to minimise nuisance.

Friday to Saturday 11.00 to 00.30

 F. Provision of recorded music (indoors), Recorded music including jukebox and karaoke, with or without a DJ during normal business or as part of functions, and including audience participation.

 H. Anything of a similar description to that falling within E. (Live Music) F. (Provision of recorded music) and G. (Performances of Dance) Comperes for quiz and similar events comedians and similar performances in any case using voice amplification.

 I. Provision of facilities for making of music (indoors), a stage area and microphone with amplifiers. Used as and when required at any time during opening hours.

11.00 New Years Eve to 00.00 New Years Day

11.00 to 01.00 on Friday, Saturday, Sunday and Monday on bank holiday weekends, Christmas Eve and Boxing Day.

3.3 It is proposed that the premises will be kept open to the public thirty minutes after the finish time for the supply of alcohol (M) detailed above.

The applicant has also proposed that they will be open until 01.30 on the non standard days as listed in section M above.

3.4 The applicant has also identified the following conditions, terms or restrictions currently imposed on the converted licence that could be removed as a consequence of the proposed variation:

1. Remove all embedded restrictions inherent in the Licensing Act 1964, the Cinematograph (safety) regulations 1955 and the Children and Young Persons Act.

3.5 The Designated Premises Supervisor will be Sally Ann Harding.

3.6 The application outlines the additional steps the applicant intends to take to promote the four licensing objectives copy attached at Appendix One.

3.7 Following consultation between the applicant and the Senior Environmental Health Officer (Pollution) the applicant has agreed that the following additional condition be applied to the licence:-

Noise or vibration will not emanate from the premises to cause a nuisance to nearby properties.

3.8 A plan showing the location of Maids Head, and the surrounding area is attached at Appendix Two.

4 RELEVANT REPRESENTATIONS

4.1 All relevant representations have to relate to one or more of the Licensing Objectives.

4.2 The responses from the Responsible Authorities are as follows:-

 Area Child Protection Committee – no representations

The representations are attached at Appendix Three of this report and are relevant to Public Safety.

5 INTERESTED PARTIES

5.1 No representations have been received from Interested Parties.

6 POLICY CONSIDERATIONS

6.1 The Sub-Committee must determine this application with a view to promoting the Licensing Objectives.

6.2 In making its decision, the Sub-Committee must have regard to guidance issued under Section 182 of the Licensing Act 2003 (National Guidance) and the Council’s Licensing Policy. The Sub-Committee when considering the Licensing Policy will in particular wish to have regard to those sections of the Council’s Licensing Policy detailed at Appendix Four. The Sub-Committee must also have regard to all of the representations made and the evidence placed before it.

7 OPTIONS

7.1 The Sub-Committee must take such steps as it considers necessary for the

 Grant the application.

 Modify the conditions of the licence, altering or omitting or adding to them.

 Reject the whole or part of the application.
