PUBLIC MEETING MINUTES: COUNCIL ON REAL ESTATE APPRAISERS

Call to Order

Mr. West called the meeting to order at 9:39 a.m. and welcomed the new Public Member, Mr. Stephen Simmons.

Review and Approval of Minutes

The Council reviewed the minutes of the January 15, 2008 meeting. Mr. Fantini made a motion seconded by Mr. Witt to approve the minutes as submitted. The motion was unanimously carried.

Unfinished Business

Previously Tabled Applications for Appraiser Trainees

The Council reviewed the previous tabled applications for appraiser trainees for Sharon Shaw and Silas Kinuthia. Mr. Fantini made a motion, seconded by Mr. Scott to approve both requests. The motion carried by majority vote with one vote abstained.

Approved Requests to sit for the exam The Council reviewed the approved requests to sit for the exam as per Mr. West for Debra Sacrenty and Marissa Sacrenty. Mr. Cahall made a motion, seconded by Mr. Witt to approve the two requests to sit for the exam. The motion was unanimously carried.

Status of Complaints

Mr. Huston advised that complaints 19-04-07 and 19-05-07 entered into consent agreements. The Council will review the two consent agreements at the February meeting.

Mr. Witt advised that complaint 19-11-07 has been forwarded to the Deputy Attorney General’s office.

Mr. West advised that complaint 19-12-07 has been forwarded to the Deputy Attorney General’s office.

Election of Officers

Mr. West announced the Council to make nominations for the upcoming Chairperson and Vice Chairperson as his term and Mr. Witts term will be ending this year. The Council nominated Mr. Huston for Chairperson and Mr. Fantini for Vice Chairperson. Mr. Witt made a motion seconded by Mr. Cahall for the approved nominations of Mr. Huston and Mr. Fantini. The motion was unanimously carried.

Proposed Changed to Rules and Regulations Draft

Mr. Witt advised the Council of the discrepancy between continuing education and qualifying education in the submitted rules and regulations draft submitted by Ms. Kelly. Ms. Kelly advised the Council that if there are no other changes, the hearing should be scheduled for the March meeting. Mr. Witt made a motion seconded by Ms. Huston to approve the rules and regulations DE Council of Real Estate Appraisers Meeting Minutes – January 15, 2008 Page 3 draft as submitted with the change. The motion was unanimously carried. The rules and regulations hearing will be scheduled for March 18, 2008 at 9:30 a.m.

Strategic Planning

Mr. Witt advised the Council that in regards to submission of work samples by licensees, the Appraisal Subcommittee, ASC, mandates that the Council must review and approve work samples. Mr. Scott inquired if the samples could be submitted with the application. Mr. West advised that the samples must be randomly selected from the licensee’s experience log; therefore they can not be submitted with the application.

Mr. Collins advised the Council that they should designate a time frame to have the work samples submitted to the Council. The Council decided to include the language of requiring the selected work samples submitted 15 days after receipt of notification on the applications for licensure as a Licensed or Certified Real Property Appraiser. Mr. Witt requested that Ms. Williams update the application and have it ready for the Council to review at the February meeting.

New Business

Complaints

Complaint 19-14-07 was assigned to Mr. Fantini.

Review of Licensed Real Property Appraiser Applications

The Council reviewed the applications for the Licensed Appraiser by exam for Barbara E. Piper, sit for exam, review of completed education and experience log prior to 12/31/07 and Brian Graham, review of passing exam scores and log of 2000 hours of appraisal experience. Mr. Witt made a motion, seconded by Mr. Scott to approve Ms. Piper to sit for the exam and Mr. Graham’s application as a State Licensed Real Property Appraiser by examination. The motion was unanimously carried.

Review of Reciprocity Licensed Real Property Appraiser Applications

The Council reviewed the reciprocity applications for Jay B. Magner, MD, Abdullahi O. Ogiefo, MD and VA, Walter K. Brockington, III, MI, Tracy L. Honeycutt, MD and VA, and Ann M. Coscia, MD. Mr. West made a motion seconded by Mr. Huston to approve the above applicants as State Licensed Real Property Appraisers by reciprocity. The motion was unanimously carried.

Review of Reciprocity Certified Residential Real Property Appraiser Applications:

The Council reviewed the applications for Bryan Swartwood, III of MD and D.C., Robert Adler of NY, NJ, CT, PA, Brett J. Haas of PA and NJ, George Hebb of MD, Glenn A. Miller of D.C., MD, andVA, Kelly Lynn Leaberry of MD, Catherine H. Moore of MD, DC, and VA, Lawrence F. Chester of MD, and Janet A. Parks of MD. Mr. Fantini made a motion, seconded by Mr. West to approve the above applicants as Certified Residential Real Property Appraisers by Reciprocity. The motion was unanimously carried. Review of Certified Residential Real Property Appraiser Applications:

The Council reviewed the applications and education requirements to sit for the Certified Residential exam for Deborah A. McMahan Jeremiah D. Smith, and Neal J. Scott under the 2007 guidelines and review of experience log and education completed by 12/31/07. The Council reviewed the experience log and passing exam scores for Victor England. Mr. Huston made a motion, seconded by Mr. Scott to approve the requests above to sit for the exam and Mr. England’s request for licensure as a Certified Residential Real Property Appraiser. The motion was unanimously carried.

Review of Reciprocity Certified General Real Property Appraiser Applications:

The Council reviewed the reciprocity applications for Robert G. Myers of PA, Joseph G. Vizza of PA, Curtis B. Silva of NJ and PA, Gary Leak of MD, Ronald W. Benfield of MD, and Denver Hudson of MD. Mr. West made a motion, seconded by Mr. Witt to approve Mr. Myers, Mr. Silva, Mr. Leak, Mr. Benfield and Mr. Hudson as a Certified General Real Property Appraiser and Mr. Vizza for licensure contingent upon receipt of his payment of the federal registry. The motion was unanimously carried.

Review of Certified General Real Property Appraiser Application

The Council reviewed the applications to sit for the Certified General Real Property exam for J. Daniel Nolan under the 2007 guidelines as he completed the required additional 90 education hours and the experience hours before 12/31/07. Mr. West made a motion seconded by Mr. Bauermeister to approve Mr. Nolan to sit for the exam under the 2007 guidelines. The motion was unanimously carried.

Review of Appraiser Trainee Application

The Council reviewed the appraiser trainee application for Deborah K. Hilligoss under the supervision of Catherine W. Olenderski. Mr. Witt made a motion seconded by Mr. Huston to approve Ms. Hilligoss as a State Licensed Appraiser Trainee. The motion was unanimously carried.

Review of Temporary Permit Applications (for discussion only)

The Council reviewed the temporary practice permits that were issued to Gary Leak – LaGrange Communities – 2467 Pulaski Hwy, Newark DE 19702 and Ronald W. Benfield – LaGrange Communities – 2467 Pulaski Hwy, Newark DE 19702. The Council approved the issuance of the above two temporary practice permits for their respective assignments.

Review of Continuing Education Activities

Mr. Huston made a motion, seconded by Mr. Witt to approve the following continuing education courses:

New Castle County Board of REALTORS Basic Appraisal Principles – 30 QE hrs (AQB approved) DE Council of Real Estate Appraisers Meeting Minutes – January 15, 2008 Page 5

Basic Appraisal Procedures – 30 QE hrs (AQB approved) Uniform Standards of Professional Appraisal Practices (USPAP) – 15 QE hrs (AQB Approved)

American Society of Farm Managers and Rural Appraisers (ASFMRA) Dairy Facility Appraising: A Mooving Target – 16 CE hrs Practical GPS/GIS Navigation – 16 CE hrs ASFMRA 78th Annual Convention – approved for 8 CE hours only.

The motion was unanimously carried.

AQB Upcoming Public Meeting Dates for 2008

Ms. Williams informed the Council of the upcoming AQB meeting dates. Ms. Williams advised the Council that she will send via email the meeting information to the Council members.

Discussion on Educational Audit – Mr. Witt

Mr. Witt advised the Council that he would like to see a plan in motion for the Continuing Education Audit. Ms. Williams advised that the Audit went out the end of January. Ms. Kelly advised that the problematic auditee’s should be seen before the Council and if a violation of Continuing Education has occurred then the auditee will need to have a hearing before the Council.

Other Business before the Council (for discussion only)

Mr. Collins advised the Council about a legislative meeting that will be taking place on January 16, 2008 at 1:30 p.m. He inquired if a Council member would be able to attend that meeting. Both Mr. Witt and Mr. West stated that they have prior engagements and would not be able to attend that meeting. Mr. Huston advised, along with Mr. Scott, that they can not attend the meeting as well. Mr. Fantini stated that he may be able to attend the legislative meeting.

Ms. Parker inquired about the urgency of work samples. Mr. Witt advised that it is not request of real immediacy but should be received before the next meeting. [The 15 day notice was established earlier in the meeting, see section Strategic Planning.]

Public Comment

There was no public comment before the Council.

Next Meeting

The next meeting is scheduled for February 19, 2008 at 9:30 a.m. Conference Room A, second floor, Cannon Building, 861 Silver Lake Boulevard, Dover, Delaware.

Adjournment
