MINUTES OF THE SPECIAL COUNCIL MEETING OF THE MOGALAKWENA MUNICIPALITY HELD IN THE LLEKA LEKALAKALA COUNCIL CHAMBER, CIVIC CENTRE, MOKOPANE ON TUESDAY, 5 JUNE 2007 AT 14:05

1. OPENING

The speaker welcomed all present and requested that a moment of silence be observed.

2. APPLICATION OF MEMBERS FOR LEAVE OF ABSENCE

Applications for leave of absence were received from councillors N V Mashamaite, M M Lamola, L P Maloba, S K Makgae, G Mokale, M E Shika, N R Thema, J F Barnard, T S Kgosana, L D Langa, M B Teffo and C M Mashalane. 155. 05.06.07

RESOLVED:

THAT leave of absence from a special council meeting of Mogalakwena Municipality held on 5 June 2007 be granted to councillors N V Mashamaite, M M Lamola, L P Maloba, S K Makgae, G Mokale, M E Shika, N R Thema, J F Barnard, T S Kgosana, L D Langa, M B Teffo and C M Mashalane.

3. TOWN PLANNING: PROPOSED AMENDMENT SCHEME 198 (17/2/6/6/90)MN (Developmental services)

Inspection in loco from 14:45 to 15:10.

RESOLVED:

THAT the application for the rezoning of erf 359 Piet Potgietersrust be approved in principle as indicated hereunder subject thereto that the building plans shall only be approved once the municipality has upgraded the electrical, sewerage and other services and the municipality not be held liable for any financial burdens that the owner or proposed owner could suffer with regard to their bond obligations due to the shortage of infrastructure which is envisaged not to be available for the next 14 months:

THAT

a) in terms of section 56 (9) of the Town Planning and Townships Ordinance, 1986 (Ordinance 15 of 1986) the application for the amendment of the Greater Potgietersrust Town Planning Scheme, 1997 for the rezoning of erf 359 Piet Potgietersrust from “Residential 1” to “Business 1” for the purpose of mixed uses e.g. offices, shops and residential use be approved subject to the following conditions:

i) that access be paved to street level and that sufficient parking be provided on the erf.;

ii) that loading and off loading shall be accommodated within the erf;

iii) no parking whatsoever shall be allowed on the pavements or in the streets;

iv) that two (2) parking bays per 100sqm G.L.F.A (Gross Leasable Floor Area) be provided;

v) that a written submission regarding the handling of storm water from and/or onto adjacent erven be submitted; and

vi) that the necessary documentation, map 3’s and clauses be submitted within 30 days of the approval. 156. 05.06.07

b) the owner or prospective owner of erf 359, Piet Potgietersrust, be responsible for the payment of any municipal services required with regard to development on the erf.

c) in terms of section 63 of the Town Planning and Townships Ordinance, 1986 (Ordinance 15 of 1986), the owner referred to in a) supra be requested, not later than 30 days after the commencement of the amendment scheme, by means of the registered letter to pay the contribution in respect of engineering services, open spaces and parks as approved by council.
