KIMBALL TOWNSHIP BOARD OF TRUSTEES MUNICIPAL BUILDING, 2160 WADHAMS ROAD, KIMBALL, MI REGULAR MEETING July 21, 2015 6:30 P.M. Jackson opened the meeting at 6:30 p.m. with the Pledge of Allegiance.

ROLL CALL OF OFFICERS PRESENT: Jackson, Hand, Kilroy, Ritter, Wrubel and Sturdevant.

ABSENT: Usakowski.

ALSO PRESENT : Deputy Clerk Blaszczuk and Jeri D. from Tetra Tech.

INVOCATION BY: Pastor Tim Parker, Smiths Creek Bible Church.

I. APPROVAL OF AGENDA Under New Business add B. Engineering Proposal. Under Unfinished Business add C. Legal Matter and D. Workman’s Compensation Issue.

Jackson motioned to approve the agenda as amended supported by Hand. Motion Carried.

II. PRESENTATION OF MINUTES FOR July 7, 2015 Kilroy motioned to approve the minutes as is supported by Jackson. Motion Carried.

III. CONSENT AGENDA AND COMMUNICATIONS A. Check Register from 06/29/2015 – 07/10/2015 B. Revenue & Expenditure Report for 07/31/2015 Kilroy motioned to approve, file and pay the bills supported by Jackson.

ROLL CALL VOTE: YES: Kilroy, Jackson, Hand, Wrubel and Sturdevant. NO: Ritter. ABSENT: Usakowski. (5-1-1) Motion Carried.

IV. BOARDS AND COMMISSIONS A. St. Clair County Department of Public Works June 16, 2015 B. Road Commission June 16, 2015 C. Township Roads and Bridges Advisory Committee Minutes, July 14, 2015

Sturdevant wanted page 24 noted the St. Clair County Landfill problem with the forcemain.

Jackson motioned to approve the minutes for Boards and Commissions supported by Ritter.

V. PUBLIC COMMENT (Brief Comments) Susan Tissue, 401 Pine River Road: Wants to propose that the township build a 60’ x 30’ volleyball court next to the tennis court. She provided some information on how much it would cost.

Jackson: We can revisit the park plan and look at the budget.

David Doss, 1053 Broad Ax Lane: Was wondering what the township found in the sewage backup problem.

Jackson: Nothing has been found yet but Tetra Tech gave us a bid to survey it.

Doss: Have you approved funding for a new pump to stay at that pump station so we don’t have to share a pump with another township?

Hand: I have two estimates on pumps. Funding is another situation.

Doss: When will you have more answers on it?

Hand: As far as getting the pumps, the board was presented with the bids tonight to decide if they want to purchase one and how they are going to pay for it.

Jackson: I have about six or seven pages on what Tetra Tech are is going to do to find the problem.

Kim Neilson, 1053 Broad Ax Lane: She is thankful that the township is looking into the pump station problem and appreciates being a part of the township. She expects that this problem will be resolved soon. She wants the problem found.

Jackson: Somehow extra water is getting into the lines.

VI. UNFINISHED BUSINESS A. MOS: Michigan Office Solutions Representative (Copiers) Representative didn’t show.

Ritter questioned what this was about because she wasn’t at the last meeting.

Hand explained it to her.

B. Uncollectable Fire Billing: Tom Reilly This is just informational for now and will bring it back. Jackson has two other companies with proposals.

2 Jackson motioned to table this for now and bring it back to the next meeting supported by Ritter.

C. Legal Matter Hand motioned to go into closed session at 7 p.m. for the legal matter and workman’s compensation supported by Ritter.

ROLL CALL VOTE: YES: Hand, Ritter, Kilroy, Sturdevant, Wrubel and Jackson. NO: None. ABSENT: Usakowski. (6-0-1) Motion Carried.

D. Workman’s Compensation Closed session at 7 p.m. for legal matter and workman’s compensation.

Jackson motioned to returned return to open session at 7:05 p.m. supported by Sturdevant. Motion Carried.

Jackson motioned to follow the attorneys advice on FOIA’s supported by Sturdevant.

ROLL CALL VOTE: YES: Jackson, Kilroy, Hand, Sturdevant, Wrubel and Ritter. NO: None. ABSENT: Usakowski. (6-0-1) Motion Carried.

Jackson motioned to approve employee banked vacation time pay supported by Kilroy.

VII. NEW BUSINESS A. Fire Department Time Clock Policy and Procedures Sturdevant motioned to wait and see what the Fire Administrative Board recommends support by Ritter. Motion Carried.

B. Engineering Proposal Allen Road and Broad Ax Lane: Jeri Decater from Tetra Tech. Onsite meetings and sewer maps show five pump stations involved. Their proposal is to clarify capacity and flows at each station and verify pump operations. They will come back with recommendations to the township board. This is a methodical approach.

Jackson: What would be the case if you came in under the budget?

Decater: We don’t like to use the whole budget if we don’t have to and will not go over without contacting you.

3 Ritter: I would like to see more of a breakdown on how many hours and what you are doing during those hours.

Decater: Explained what they will be checking and not checking.

Kilroy motioned to approve Tetra Tech to do a study on the pumping stations supported by Hand.

VIII. AUDIENCE PARTICIPATION Scott Sienkiewicz, 1098 Broad Ax Lane: Following up on the pumps. He thinks that we should have two pumps for backup and thinks this is a big issue and not just a small one. He wants something done. Do we have any ordinance on people using sump pumps to drain into the system?

Wrubel: Usakowski said at the last meeting that the ordinance is in the plumbing code.

Discussion.

X. OFFICERS REPORT A. Supervisor Usakowski Absent.

B. Clerk Hand Bid from Contractors Connection for a pump on a trailer is $25, 401.80.

Discussion.

Jackson motioned to purchase the 6 inch pump for $25,401.80 from Contractors Connection supported by Wrubel.

Hand: How do we pay for the pump?

Jackson: The water department is in pretty good shape.

New Truck: Do we want to go with a different color or wait for a white one to be available?

Discussion.

4 Wait to see if one becomes available.

GPS: Wrong information is being monitored. Idling time is actually when the vehicle is just sitting parked with the engine not running.

Ordinance Enforcer: We have an ordinance enforcer that does a lot of work out in the field and gets a lot of negative attitude from residents and plus has been bit by a dog. Nothing against our park workers, but we just gave a park worker a $50 a week raise. The man is our Ordinance Enforcer and doesn’t make about 2/3 maybe of what our park person makes. I don’t understand this and he doesn’t get mileage either, plus he uses his own vehicle. He hasn’t had a raise in a while. We should really look into it.

Sturdevant suggest to see what the wages are for someone in that position.

Hand would like the paperwork on the Extravaganza signed and turned in.

Becky Jackson said she will take care of that.

C. Treasurer Jackson Regarding adjustment to water/sewer bills. Explained his actions on the adjustments. If residents have a leak and can prove it, he will do an adjustment for the sewer only.

Do I need to bring them all to the township board?

KOA’s bill was adjusted down to $2.14 because he does a lot for the community and he has roughly 400 or so campsites there. I consider this a residential area. He is paying $5,368.00 for two quarters for water for just sewer usage. And that would be 72 122 OUF’s before, times four. We were even charging him for that when he wasn’t open in the winter. That would have been 288. If you put that equivalent figure back in there, he’s paying 244 OUF’s in that $5,368.00. That’s why I adjusted him down. I figured he was being treated a little unfair. He is the number four tax payer in the county.

Ritter: Are you going to make any more adjustments?

Jackson: No, we can’t make any more adjustments.

Blaszczuk: Why should businesses get a break because they have money?

Jackson: Everybody thinks that because he has a lot of money that he should pay more.

Trustees: No, not pay more but pay his fair share.

5 Jackson: Most everything in the park is 5/8 hook ups. Everyone who Every commercial business that has a 5/8 hook up pays $2.14 for sewer and $3.54 for water.

Kilroy: To us or to him?

Jackson: To us.

Hand: That’s why my belief goes along with the DPW. There should be a main water meter out by the road in a vault.

Jackson: He pays a large ready to serve fee of $700 a quarter on that 6” meter that the fire department made him put in for fire suppression.

Wrubel: How did the KOA become industrial instead of residential?

Jackson: They are putting more things in the sewer than the normal water usage.

Discussion.

Hand motioned that large changes in water fees of $500 and over be brought to the board for approval supported by Kilroy.

D. Trustee Kilroy No report.

E. Trustee Ritter No report.

F. Trustee Sturdevant Thank you to all the residents who made it out to the Masonic for breakfast.

G. Trustee Wrubel Glad we took care of the pump.

XI. ADJOURNMENT Kilroy motioned to adjourn the meeting at 8:13 p.m. supported by Ritter.
