CONOY TOWNSHIP BOARD OF SUPERVISORS MEETING MINUTES May 11, 2017 – 7:00 p.m.

A meeting of the Conoy Township Board of Supervisors was held at 7:00 p.m. on Thursday, May 11, 2017, at 211 Falmouth Road. In attendance were Supervisors Stephen Mohr, Gina Mariani, John Shearer, Clyde Pickel, and Kevin McKain and Assistant Secretary-Treasurer Kathy Hipple. Also in attendance was Solicitor Ed Browne of Nikolaus and Hohenadel.

ORDER OF BUSINESS: 1. Meeting called to order at 7 p.m. by Chairman Mohr followed by the Pledge of Allegiance and a moment of silence.

2. Motion by Pickel to approve Minutes of April 13, 2017 BOS Meeting; Second by Shearer; Motion carried.

3. Chairman – Announcements and additional agenda items: None.

4. Public Participation: Brian Putt, 3326 Turnpike Road addressed BOS to bring to their attention to speeding on Turnpike Road. Putt said placing the speed machine on Turnpike Road seemed to slow down drivers for about a week but he had concerns that with the increase of traffic from the detour on 241 speeding has increased; and he was also concerned for drivers leaving Governor Stable Park after ball games and for those living along Turnpike Road attempting to leave their driveways. Mariani said the Township will talk to the police.

5. Secretary- Treasurer – (i) NWLCRT Stone Bids. Two bids were received for 8,000 Tons PennDOT No. 2A; 400 Tons AASHTO No. 1; 400 Tons AASHTO No. 57 and 200 Tons AASHTO No. 8. County Line Quarry bid totaled $92,650.00 and R E Person Materials bid totaled $112,900.00. Motion by Mariani to award bid to County Line Quarry as low bidder contingent upon review of bid and receipt of all necessary documents; Second by McKain; Motion carried. (ii) Motion by Mariani to accept 2016 Year End Audit Report as prepared by Sager, Swisher and Company, LLP; Second by McKain; Motion carried. Correspondence received – (i) 1st Quarter 2017 Lancaster County Drug Task Force Report. (iii) Shearer reported Bainbridge Fire Company is buying a new Rescue; they have ordered it and it will come in next year. Township has a Bainbridge Fire Company Equipment CD maturing in June. The Fire Company would like to use that CD to pay off their loan for the last piece of equipment purchased and that balance owed is believed to be about $40,000.00. Mariani asked if the Fire Company realizes that if the money goes toward the loan the money will not go towards the purchase of the Rescue. Mohr was of the opinion that the BOS should say Township is relinquishing that money to the Fire Company so they can plan. Shearer said any left over money from the CD will be reinvested by the Township.

6. Report of Committees / Officers: a. Emergency Management – Wayne Southard reported nothing has been received regarding the TMI drill but expressed he felt it was successful from our point of view. Southard attended a training class today on emergency weather preparedness. b. Bainbridge Fire Company – Reports received for January 16 calls as follows: 4 calls in Conoy Township; 3 in Elizabethtown Borough; 4 in West Donegal Township; 1 in East Donegal Township; 2 in Marietta Borough; 1 in West Hempfield Township; 1 in Columbia Borough; February 11 calls as follows: 5 in Conoy Township; 1 in Elizabethtown Borough; 2 in West Donegal Township; 1 in Marietta Borough; 1 in Londonderry Township and 1 in Mount Joy Township; March 9 calls as follows: 4 in Conoy Township; 3 in Elizabethtown Borough; 1 in West Donegal Township; 1 in Columbia Borough; April 13 calls as follows: 8 in Conoy Township; 2 in Elizabethtown Borough; 1 in East Donegal Township; 1 in Marietta Borough; 1 in Columbia Borough. c. NW Emergency Medical Services - (i) 17 calls in March; 53 calls year-to-date. d. Police – (i) Report is available. e. TMI – No report. f. Waste to Energy Plant (Incinerator) – (i) Host fee for March 2017 $62,133.28; 33,404.99 Tons processed; (ii) 2016 – 2017 Comparison is available. g. Roads – (i) Verbal report by Chairman Mohr; signs replaced; trees on lines removed; ready to start first road mowing of the season. Railroad crossings to be closed for one to two weeks at Collins Road (individuals who live there had to park and walk about one-half mile to their house), Race Street hopefully these will not be closed for the Memorial Day weekend. (ii) Shearer asked if there are any road projects for this year; Mohr commented we’ll get them. (iii) Mariani asked if Mohr knew when street sweeping was scheduled. Mohr didn’t see the need for street sweeping because we didn’t put stones down but he did want to check out two locations that might need cleaned up. h. Sewage Enforcement Officer – (i) Report received. Permits issued to: D L Burkett Construction for Joan Bryan, Permit Z169275; Inspection of Permit Z169275 for 484 S Second St. which was a transfer of ownership and a repair job needed

Robert Ketterline Permit Z169927 for 174 Governor Stable Road where a double-wide was removed and a new house is being constructed. i. Sanitary Sewer – (i) Motion by Shearer for Secretary-Treasurer to sign NPDES Renewals for Bainbridge and Falmouth WWTP with Hanover Engineering Associates, Inc. submitting permit renewals to DEP on behalf of the Township; Second by Mariani; Motion carried. j. Stormwater Management – (i) Motion by Shearer to approve Small Project Stormwater Management Agreement and Declaration of Easement for Matthew Plasterer for PIN 130-46874-0-0000, 174 Governor Stable Road; Second by Mariani; Motion carried. (ii) For change to Township record only - Small Project Stormwater Management Agreement and Declaration of Easement for Koser Bros. Rentals for Parcel Identification Number 130-89912-0-0000, 103 Becker Road (formerly 3415 Turnpike Road). According to Recorder of Deeds office the notary page was incorrect. The new and recorded agreement is dated 4/19/17. k. Solicitor – (i) Per Solicitor Ed Browne an amendment to the Redevelopment Authority and Conoy Township Agreement for Perdue Project is necessary to change the name for Perdue Agribusiness. Motion by Mariani to approve to alter agreement to include Perdue’s Agribusiness name which relates to the project going on in Conoy and the grant provided by the State; Second by McKain; Motion carried. (ii) Solicitor Browne advised the BOS that a lawsuit was filed in Philadelphia naming the Township as a party in the Clark Arnold estate lawsuit which commenced March 24, 2017. Mohr advised the accident occurred several years ago at Race Street crossing and that our insurance carrier has assigned somebody to look out for our interest. l. Zoning Officer – (i) Report is available; (ii) Conoy Township Zoning Hearing Board shall conduct a public meeting on Thursday, May 25, 2017 at 7:00 p.m., prevailing time, at the Conoy Township Municipal Building, 211 Falmouth Road, Bainbridge, Pennsylvania, to consider, deliberate, discuss and/or take official action on any matter which may lawfully come before the Zoning Hearing Board and to consider the following application: Case No. HB03-17: Marc T. Donahue- owner; Bainbridge DG, LLC-applicant and equitable owner for property located at 284 River Road, (property directly across from the old Uni-Mart) Conoy Township, Lancaster County, Bainbridge, PA, Tax PIN 130-322644-0 -0000 in the Agricultural (A) District requesting a use variance from Section 201.2 in order to construct a 130’ x 70’ one story retail store; and variances from Sections 201.5.B. concerning the number of lots which may be subdivided from a parent tract; 201.8.E. maximum 20% lot coverage; 311.19 to reduce required and 463 relating to building size and construction for a retail store. Janet Hardman, Zoning Officer. Mohr advised the Planning Commission had hesitation due to pedestrian traffic crossing 441 since the store would be directly across from the motorcycle shop and BWA property. There are no sidewalks and there are no plans for sidewalks. Motion by Mariani to approve Township Solicitor and Township Engineer to attend ZHB hearing to oppose the project due to road hazards and pedestrian traffic; Second by McKain; Motion carried. (iii) Motion by Pickel to accept Fertrell Land Development Plan Extension of Review Process to September 2017; Second by Shearer; Motion carried. m. Buildings – (i) Pickel had no report on buildings. (ii) Pickel advised BOS he did attend the 95th PSATS conference on April 25. There were 57 resolutions with 52 passed and 5 rejected. Pickel reported 10,000 were in attendance. n. Personnel – No report. o. Parks and Recreation – (i) Motion by Mariani to hire as Summer Playground Helper at $9.59 hour Rachel Wood and Nicolle Esposito upon completion of all necessary paperwork and receipt of all necessary clearances; Second by Shearer; Motion carried. (ii) National Trails Day, Saturday, June 3, 2017 10 a.m. to 3 p.m. participants can start at Columbia Crossing in Columbia, Musselman-Vesta Iron Furnace in Marietta or East Donegal Riverfront Park with activities at each location. Hipple is scheduled to attend to represent Conoy Township. Posters were distributed. p. Planning, Subdivision and Development – Mohr advised he reported that the PC discussed the Dollar General project and sent a letter to the Zoning Hearing Board in opposition to the plan.

7. Financial Reports – FYI – See General Fund Deposit Detail, General Check Detail and Payroll Summary reports and Sewer Fund Deposit and General Check Detail reports for April 2017.

8. Motion McKain to pay bills (See Unpaid Bills Detail Reports for General Fund for 4/27/17; and 5/11/17; and for Sewer Fund 4/18/17; 4/27/17 and 5/11/17 and Capital Reserve for 5/11/17; Second by Mariani; Motion carried.

9. Old Business: None.

10. New Business: (i) Mohr reported Conoy Bainbridge CJs fishing derby will be held May 27 from 8:30 a.m. – 12 Noon at Conoy Park East and is open for all from 15 years of age and under; everything is free. (ii) Mariani advised the Memorial Day parade starts at the Bainbridge Elementary School at 9 a.m. Bring flowers, bikes, skateboards, scooters decorated.
