Dear Brothers and Sisters,

I heartily extend my warm welcome to you all on the occasion of XI-XII Annual General

Meeting being hosted by Sanskar School, Jaipur. The XI AGM could not be held due to some compelling circumstances. The meeting of the member schools held on January

18, 2009 also endorsed cancelation of XI AGM. Therefore this is a combined XI-XII

AGM. I am indeed delighted to see you all here even after sever cold waves and fog. I feel privileged in presenting the Annual Report before this august assembly.

X FELICITATION FUNCTION: X Felicitation Function was held on 22nd December,

2007 at Jaipur where TOP RANKERS in Board Examinations-2007, Team achievers in sports and games, students having made other achievements at national/international level, 5 teachers, a principal, Legendary Institution, Eco-friendly Institutions and the

Schools for Best use of IT were felicitated. Sh. Sudhir Bhargava IAS, Principal

Secretary School and Sanskrit Shiksha . was the Chief Guest. He praised the roll played by the unaided schools in providing quality education and appreciated the efforts of the SOCIETY .The host School presented the entertaining sequence.

The team of host school under the able and dynamic leadership of their Director

Principal Mrs. Jayshree Periwal welcomed the guests with open heart and arms. The meticulous and flawless planning and execution made the evening memorable. The recipients of honours , guests and delegates enjoyed every moment of the occasion and appreciated the courtesy and hospitality of the host. The host of X Felicitation

X ANNUAL GENERAL MEETING:

The Annual General Meeting was held after the Felicitation function. It was attended by 53 delegates representing 39 Schools.The minutes of the AGM, circulated separately has been approved by this house THE EXECUTIVE COMMITTEE 2007-09:

7 meetings of the Executive Committee were held during the years where the important matters were discussed and a few vital decisions were taken. I am thankful to the hosts of these meetings, Maharaja Sawai Man Singh Vidyalalaya, Jaipur, St.

Edmund's School, Malviya Nagar, Jaipur , Neerja Modi School, Jaipur Mahaveer Public

School, Jaipur and Step by Step High School, Japur. St. Edmund's School and Neerja

Modi Schools also hosted the meetings of members.

I am thankful to Smt. Jayshree Periwal for functioning as President during the pendency of resignation of the President.

MEMBERSHIP:

It gives me pleasure to inform this house that in last two years 18 new members joined the SOCIETY and the annual subscription in current year has been received from 67 members(including new members). There are about 300 schools affiliated with CBSE and CISCE in the state . But only about 1/3rd are part of the family of the SOCIETY.

We need to grow and strengthen the organization. We should evolve some method to bring all the schools to the fold.

THE SECRETARIAT: The secretariat of the SOCIETY is presently functioning from its registered address B-126, Janta Colony, Jaipur. Earlier it was functioning from

Maharaja Sawai Man Singh Vidyalaya, Jaipur.

Smt. Jayshree Periwal took over the responsibility of the office of the Secretary on

18th January 2009 and performed her assignment very effectively. The circulars with urgent and important information were sent either on same or next day of the meetings. She was always available for the work of the Society. I would like to place my heartiest appreciation on record for Smt. Jayshree Periwal, who proved herself an asset to the SOCIETY. Her way of thinking, understanding and communicating is worth mentioning. I request the house to greet Smt. Jayshree Periwal with a warm round of applauses. Shri Anoop Singh, Joint Secretary deserve full appreciation for discharging the duties of Secretary during pendency of resignation of the Secretary. He handled the affairs when there was a crisis and ensured that the SOCIETY functions smoothly.

Smt. Neera Mathur worked as Secretary of the SOCIETY for a period of about 9 years and we worked as a team. It was her choice to choose a different track and part

4 away from the SOCIETY. Neeraji, we had nice time while working together and hope you too have the same feeling. My regards to you Mrs. Neera Mathur. Our sincere thanks to the management of Maharaja Sawai Man Singh Vidyalaya for their support.

FINANCE AND ACCOUNTS: The audited accounts for the year ending on 31st March

2008 and 2009 are placed before you under the separate item of the agenda. At the closing of year 2009, the corpus fund of the Society is 7,38250 . Our income tax returns have been filed for the financial year 2007-08 and 2008-09. Shri Saurabh

Modi handled this portfolio with full dedication and dignity. His involvement with keen interest in the affairs of the SOCIETY infused a new zeal in me . He was always available at a call. Thank you very much Saurabh for always being with me. Please applause for him.

A corpus for Legal and Public Relations Expenses has been created and the contribution received from the members for the purpose is directly credited to this corpus. The expenses on these heads in accordance to the decision of the last AGMs are made out of this corpus fund. A sum of Rs.14,62,741 is available in this corpus fund.

Our auditors- The executive committee once again decides to continue with our present auditors M/s. G.S.Tatiwala & CO..They are not charging any fees from the

SOCIETY. The house should join with me in thanking them for their service and timely guidance

ACTIONS DURING THE YEARS:

The State Government constituted a committee under the Chairmanship of Mrs. Gauri

Ishwaran to suggest the methodology to regulate the fees and other affairs in the schools. On an invitation from the committee, I along with the Treasurer Sh. Saurabh

6 Modi attended two meetings of the committee. Your representatives strongly pleaded before the committee that the fees cannot be regulated by the Government. A representative of a School gave his suggestion that the schools should be accredited and graded. And, according to the grades, the fees may be decided. This idea was opposed by us. The Chairperson of the committee suggested that the schools may evolve some mechanism of self regulation. A meeting of member schools to discuss the suggestion was convened on 26th August 2008 . The meeting unanimously resolved that

SOCIETY opposes any Regulator appointed by the State Government and as an alternative agrees to follow a code of conduct. The members present in the meeting agreed to the following code of conduct as an initiative in this direction:

a) The fees specified shall not be varied in the mid of the session

b) Every fee/charge collected from the students should be in the name of

the School where the student is studying and a proper receipt shall be

given for every collection made by it.

c) Transfer certificate should be issued by the school whenever demanded

by the Student/Parent.

d) Admission fee shall not be charged again from the student who is once

granted admission and as long he remains on the rolls of the School.

e) The School should not compel the students /parents to buy text

books/dress from the school.

f) There should not be any written test for the admission in classes below

one.

g) No capitation fees should be charged.

To suggest further in the matter, a committee of the following was constituted:

7 The President and Secretary of the SOCIETY will be ex-officio members.

The committee met once and discussed the issues. Before it could have discussed the matter further, a new issue of VI pay commission cropped up and the Gauri Ishwaran

Committee practically ceased to work.

The matter of payment of gratuity imposed on some unaided school by the Hon'ble

High Court as informed by member schools, was discussed and found that the judgment of Hon'ble High Court in complete contradiction to the provisions of

Rajasthan Non–Government Educational Act 1989 & Rule 1993, having held that unaided schools are equally responsible for the payment of gratuity as the aided institutions are. Therefore, it was decided that the SOCIETY should take appropriate legal action to challenge the order. It was also decided to suggest to the schools that they should initiate appropriate arrangements to cover the payment of gratuity in future.

A SLP against the order of the Hon'ble Rajasthan High Court was filed before the

Honble Supreme Court, which is pending

FEES CONTROVERSY:

The State Government announced the implementation of VI pay commission.The

SOCIETY was pressurized to discuss the issue and to announce the fee hike and take a decision immediately. The Executive Committee in its meeting held on 21st December

2008, after discussions in detail, unanimously decided that a hike of 32% in the fee schedule for the session 2009-10 is required to meet the burden of the revision of pay scale in accordance to VI pay commission recommendations and followed by the state government. The decision of the Executive was highlighted by the media. A decision by some schools to increase fee with effect from 1st September 2008 or 1st January

2009 sparked resentment from parents. The State Government convened a meeting of parents and representatives of the SOCIETY to discuss the issue, on 27th December

2008. The SOCIETY was represented by your President along with Sh. N. K. Sethi, Sh.

Saurabh Modi, Fr. A. Carvahlo, Sr. Jannet . The meeting was presided over by the Sh.

Sudhir Bhargava, Principal Secretary Education, Government of Rajasthan. It was

8 decided that a committee under the chairmanship of Director, Secondary Education and consisting a representative of Parents, the SOCIETY and a charted Accounted be constituted to study the impact of the VI pay commission and assess the requirement of increase in fees.

Your President represented the SOCIETY in the committee and he always asserted that the state cannot regulate the fees, the accounts cannot be looked in to and the job of the committee is only to ascertain the impact of the VI pay commission. The committee had three meetings which were attended by me . The last meeting of the committee was convened on a day, when I was not in town and the fact was known to the Chairman of the Committee. The report of the committee was finalized in the said meeting.

The member schools were requested to provide some data to the SOCIETY and to the surprise, only a few schools obliged us by sending the data. But, inspite of my strong opposition, the State Government through District Education Officers, started collecting data and most of the schools succumbed to the pressure.

A meeting of the member schools was held on 18th January 2009 and attended by a large number of the schools. After discussing the entire issue in detail the members were of the unanimous view that the fee hike may be settled in between 20 to 25%.

The session 2009-10 was to commence from 1st April, 2009 and the schools were genuinely expecting some direction from the SOICETY. A meeting of extended

Executive Committee was convened on 16th March 2009. The meeting after detailed discussion decided to recommend the member schools to restrict the fee hike by maximum 23% and pass on the revenue generated through increase in fees to the staff.

The meeting also decided to constitute a grievance committee in the matter of fees.

I am happy to inform that most of the member schools abided by the decision of the

SOCIETY and controversy was almost watered down. I am also happy to inform that not a single complaint from any parent was received by the SOCIETY.

9 The Chief Secretary, Government of Rajasthan convened a meeting of the school to discuss the issue of fee rise. A delegation under the leadership of your President attends the meeting. The delegation stressed the need of increase in the fees and candidly stated that the State can not regulate the fees.

The State Government issued an order on 1st June 2009 regulating the fees. A meeting of the schools affiliate with CBSE/CISCE, to discuss the Government order was convened on 20th June 2009 at Neerja Modi School, Jaipur. The meeting was attended by a large number of schools. It was unanimously decided that the said order should be challenged before the appropriate court(s). The meeting also unanimously decided to advise the member schools to pursue their own fee schedule (without detracting from the Government order) with a note: "Re structuring of the fee is under consideration.

Mean while the parents may deposit the usual fees."

It was also decided to request the member schools to contribute Rs. 20,000/- (schools having receipt of more than 100 lacs) and Rs 10,000/- (schools having receipt of less than100 lacs) for the cause.

A writ petition challenging the order of the state was filed before the Rajasthan High

Court. The Hon'ble court has issued the notices to the respondents and has given a last opportunity to file the reply in three weeks. The case is listed on 27th January

2010.

Meanwhile, our SLP before the Suprme Court, against the order of the Hon'ble High

Court in the matter of fees in the year 2006-07 came up for hearing on 7th August

2009. The Hon'ble Supreme Court passed an order that " In the facts and circumstances of the case, the High Court is requested to dispose of the writ petition within a period of six months from the date of receipt/production of copy of this order. The special leave petitions are, accordingly, disposed of." It was not like what was reported in news papers but it was on our expected lines.

10 I am happy to inform that the Hon'ble High Court has dismissed the writ petition of

Abhivavk Sangarsh Samiti on 6.10.2009, as being infructuous and also on account of non appearance of plaintiff.

A review petition in the matter of Modern School, Delhi Case was pending before the

Hon'ble Supreme Court and the judgment on the said review petition was delivered on

7th August 2009. The media reported the judgment as if it gave an authority to the

State Governments to regulate the fees and schools are debarred from increasing the fees without approval of the State. Whereas the truth was completely different. The order of the Hon'ble Supreme Court gave a permission to transfer funds from school to the educational society managing the school to develop any new institution also. In no way, it ordered that the State Governments will have a say in fixing the fee structure of unaided schools.

The Parents Coordination Committee, Jaipur has also filed a writ petition seeking strict adherence by the schools to the Government order dated 1st June 2009. A number of paper clippings describing agitation by parents against fee hike are annexed. The same committee has been allowed as intervener in our writ petition against the Government order.

A case in the matter of admission in nursery classes is pending before the Hon'ble

Supreme Court and listed for 26th February 2009.

TAKING OVER OF SCHOOL BUSES

In every election, school buses are taken over on election duty which results in almost closer of the school and loss of studies. The SOCIETY took the matter with the

Transport Commissioner and the Principal Secretary education. They realized the difficulties of the school and on recommendation of the Principal Secretary Education, the Transport Commissioner was please to issue the order on 27th April 2009 to take over the school buses as second priority and that resulted in no take over. We all are thankful to The Transport Commissioner Shri Niranjan Arya and the Principal

11 Secretary Education Shri R.P.Jain. This all happened with the sincere and timely efforts of our treasurer Shri Saurabh Modi.

Again, a few District Collectors issued orders for taking over the buses for Panchayat election duties and I was informed about it by Shri Viyaj Joshi and on the very same day, I along with the Secretary Mrs. Jayshree Periwal approached the Principal

Secretary Education Dr. Shri Lalit K. Panwar who instantly recommended our case to the Transport Commissioner and we are hopeful to get the same kind of order. Thanks to Dr. Sh. Lalit K. Panwar

Launch of the Website:

Long awaited website : www.unaidedschools.com was lauched on 1st September 2009.

The website contains Aims and objectives, President's message, Office bearers,

Members, Join us, Meetings, Circulars, Bulletin Board, Press Room, Forum ,Contact us,

Links, Home

The website has been launched by courtesy of Neerja Modi School, Jaipur.

The Schools are requested to visit the website regularly as all the information will be displayed over there. At present, the leading Judgments viz. TMA PAI Foundation, PA

Inamdar, Action Committee of Delhi, Cochin University and Gratuity to teachers along with Right of Children for Free and Compulsory Education and CBSE Circular about grading system are available at one place on Bulletin Board of the website.

Suggestions are invited for improvements of the website.

Co-operation, Co-ordination at National Level and International Level:

Unaided schools across the country are facing difficult time. Delhi, Haryana, Utter

Pradesh, Madhya Pradesh Maharashtra and other Governments issued orders to regulate the fees in unaided schools. The cases are fought by local school and/or local organization. One state is quoted in another state and there is no one to verify and

12 coordination the affairs. The media is reporting the matter in their own style and for public consumption. The SOCIETY is always for cooperation and coordination at national level. The important issues like "Right of Children to free and Compulsory Act" are being taken very causally whereas the same will have drastic impact on unaided schools.

The SOCIETY has always considered it as a serious issue. Your President was invited as key note speaker on "Right of Children to free and Compulsory Bill "by Independent

Schools' Federation of India in its annual conference on 20th February 2009.

I along with Sh. Saurabh Modi, visited Mumbai 21st July 2009 to exchange view on the matter with the members of International Schools Managements and Principals'

Foundation. The meeting was very much successful. Thanks to Mrs. Vandana Lulla,

Secretary of the Organization for giving the opportunity.

Association of International Schools of India, invited me to deliver a lecture on "Right of Children to free and Compulsory Act" in their annual meeting at Jaipur, held on

26th September 2009.Views of your President were well received by the audience and they felt enlightened on the issue.

I must thank Shri Aditya Modi (S.S.Modi Vidya Vihar, Jhunjhunu) for arranging both the meetings. Shri Aditya Modi strongly feels importance of the matter and appreciates the missionary efforts of the SOCIETY.

I also had a meeting with a group of elite schools of Delhi and around under the

Chairmanship Mrs. Manju Bhartram ( Chairperson of Sri Ram School, Delhi). She and her colleagues were very serious on the issue and they assured to be with the

SOCIETY.

I am happy to inform that Independent Schools' Federation of India is also very much serious on the issue and together we have got a writ petition ready. Both the organization will work together on the subject.

I feel that more cooperation and better understanding amongst various organizations is required. We also need to study and understand the working pattern, procedures and legal format in other countries.

13 Honours by the SOCIETY

The AGM-2007 decided to keep the Felicitation programme in abeyance for next three years.

On the basis of a suggestion from one school and discussion in the Executive

Committee, a committee consisting of Shri N.K. Sethi, Mrs. Rama Datt. Ms. Hemant

Kacchawaha and President/ Secretary as ex-officio members was constituted to rethink in the matter. The committee has unanimously recommended to restart the felicitation programme with following honours:

a. A Principal with a memento , a shawl and a citation

d. 5 teachers with a memento , a shawl and a citation

e. A member institution for Best use of IT in School with a memento and

citation

f. A member institution as Eco-Friendly Institution with a memento and

citation

The House may consider the recommendation and take an appropriate decision..

Today, my sixth consecutive term as President will come to an end. My journey of last twelve years is full of satisfaction. Working for this great organization and especially with such nice persons is indeed a matter of proud and pleasure. My sincere thanks to:
