1. Objective The objective of these Regulations is to prescribe — (a) the offences against a relevant law for which an infringement notice may be served; (b) penalties for prescribed offences; (c) particulars relating to the payment of those penalties. 2. Authorising provision These Regulations are made under section 99 of the Conservation, Forests and Lands Act 1987. 3. Commencement These Regulations come into operation on 29 June 2002. 4. Revocations The Regulations listed in Schedule 1 are revoked. 5. Definition In these Regulations— "the Act" means the Conservation, Forests and Lands Act 1987.

6. Offences (1) For the purposes of section 91(1) of the Act, the prescribed offences are the offences set out in Column 3 of Schedule 2. (2) For the purposes of section 91(3) of the Act, the penalty prescribed for a prescribed offence is the amount set out in Column 4 of Schedule 2 opposite that prescribed offence. (3) A summary of an offence in Column 5 of Schedule 2 is not to be taken to affect— (a) the nature or elements of the offence to which the summary refers; or (b) the operation of these Regulations. 7. Service of an infringement notice An infringement notice under a relevant law or notice of the withdrawal of an infringement notice under section 92 of the Act may be served— (a) by personally serving the notice upon the alleged offender; or (b) by sending the notice by post addressed to the alleged offender at his or her last known place of residence or business. 8. Prescribed particulars of an infringement notice For the purposes of section 91(2) of the Act, the prescribed particulars that an infringement notice must contain are— (a) a reference to the fact that it is an infringement notice and a reference to the particular offence and relevant law to which it relates; (b) the date on which the notice is issued; (c) the identifying number of the notice;

(d) the name and address of the person alleged to have committed the offence; (e) the date and approximate time and place of the alleged commission of the offence; (f) a brief description of the kind of offence alleged to have been committed; (g) the amount of penalty prescribed in respect of the offence; (h) the date and address for payment of the penalty; (i) a statement to the effect that if the amount of the penalty is paid by the date specified, the matter will not be brought before a Court unless, before the expiration of the period specified in the notice as the time for payment of the penalty, the alleged offender is served with a notice that the infringement notice has been withdrawn; (j) the name and signature of the authorised officer who issued the notice. 9. Payment of penalty For the purposes of section 93 of the Act, payment of a prescribed penalty may be made by sending the amount of the penalty by post or delivering it to the address specified in the infringement notice as the address for payment of the penalty. ______
