What is GoGreenET?

It’s a community of Knoxville-area businesses and organizations that strives to be more energy efficient and environmentally friendly because it saves money, creates goodwill among employees and customers, and serves to promote Knoxville as a green place to do business.

It’s an awards program that recognizes outstanding achievements in recycling/waste reduction; energy efficiency; renewable energy; and community outreach, as well as the efforts of organizations who commit to continuously green their operations.

It’s multimedia, with promotions beginning in March in the Knoxville News Sentinel, Greater Knoxville Business Journal, knoxnews.com, knoxvillebiz and gogreenet.com – culminating in a special Green issue of the Business Journal.

The commitment on the reverse side hereof applies only to Advertising by The Knoxville News Sentinel Company as display advertising. This commitment is not transferable and is to be used for advertiser's regular business only. This commitment covers advertising only and in no way covers or pertains to political advertising. Political advertising shall be the subject of a separate agreement and must comply with all applicable state and federal laws and advertising regulations of this newspaper. The Knoxville News Sentinel Company reserves the right to make the judgment that any copy should be edited, canceled or rejected.

Thirty days notice will be given on any rate adjustments and new rates will apply automatically on all advertising run after that date. The advertiser has the privilege to cancel this agreement when rates are changed by writing a certified, registered letter to the Advertising Director or Publisher prior to the effective date of the rate change. On cancellation, current rates for space used will be charged if conditions of the advertising commitment have been fulfilled. If conditions have not been fulfilled, the rate earned will be charged on all space run. Deposit of a notice in the U.S. Mail to the advertiser at the address on his commitment will constitute legal notice.

This commitment is made subject to the conditions hereof and which are a part hereof, and with the understanding that it cancels and supersedes all previous commitments or agreements. This document embodies the entire agreement between the parties. It may not be modified or terminated except as provided herein. If any provision of this agreement is invalid, such provision shall be considered deleted from the agreement and shall not invalidate the remaining provisions.

In no event shall the Knoxville News Sentinel Company be liable to advertiser for any incidental, consequential, indirect or special damages of any nature whatsoever, including, without limitation, lost business profits arising out of the publication of the advertising hereunder, delays or failures in publication, or damages to any documents or other property of advertiser, whether in commitment or in tort, under any warranty theory, in negligence or otherwise, even if the Knoxville News Sentinel Company has been previously advised of the possibility of such damages. In no event shall the Knoxville News Sentinel Company be liable to advertiser for any damages, direct or otherwise, in excess of the total amount paid by advertiser to the Knoxville News Sentinel Company during the term for publication of advertisements hereunder. The Knoxville News Sentinel Company will not be bound by any agreement or promise not herein stated.

This agreement shall be governed by and construed under the laws of the State of Tennessee. The parties agree that any litigation concerning the terms of this agreement or the performance of any party pursuant to this agreement must be filed in and decided by a court of competent jurisdiction in Knox County, Tennessee.

Accuracy in publishing every advertisement is a constant goal of The Knoxville News Sentinel Company. When errors occur, The Knoxville News Sentinel Company will not he liable in damages for any error in any advertisement for more that the extent of the first time the error occurs, and then only for that portion of the advertisement rendered valueless by the error. When proofs are furnished to advertisers, approval of the proof will be considered designation that the advertisement is error free. Requests for adjustment claims should be made in writing within 10 days after receipt of the invoice covering the advertisement for which adjustment is claimed. The Knoxville News Sentinel Company makes every effort to publish acceptable advertising as scheduled, but will not be liable for advertising omitted through error or because of mechanical impossibility to run the advertising.

The Knoxville News Sentinel Company will gladly accept requests for specific locations in our newspaper for advertising, and do our best to honor these requests. However, location of an advertisement in the newspaper cannot be guaranteed, and The Knoxville News Sentinel Company will not be held liable for the location of any advertisement. No orders can be accepted on a position or omit basis.

To insure publication, advertiser must comply with the Advertising deadlines for furnishing copy.

Prepayment is required of customers until they have been approved for a line of credit. Once approved, charges for display advertising are due the 10 th of the month following the month of insertion. Payments not received by the 25th of the month following the month of insertion accrue a 1.5% charge. The advertiser agrees to pay all cost of collection including reasonable attorney's fees.
