Questions and Answers regarding the Tender Dossier of PHARE tender:

Contract title: Development of a Monitoring System for Emissions of VOCs, PAHs and Heavy Metals from Stationary sources in the Boundary Bulgarian Region along the Lower Danube

I. ADMINISTRATIVE QUESTIONS:

 Questions regarding documents to be submitted with reference to the Participation Criteria – listed in point 3.2 and point 3.4 of the Instructions to Tenderers as well as documents to be submitted with reference to the Economic and Financial Standing - listed in point 11.10 of the Instructions to Tenderers and documents to be submitted as an evidence of equipment compliance with the EC reference methods and EU regualations (points 4.1 and 5.2 of the Technical Specifications).

Administrative Question 1:

Please confirm that there is no other requirement to the supporting documents to be submitted under the above stated points, except for the faithful translation into the English language, provided these are not in the language of the procedure?

Notice to the above: By any such documents we mean documents as those required with reference to point 2.3.3. of the Practical Guide and those required with reference the Economic and Financial Standing - listed in point 11.10 of the Instructions to Tenderers (for instance: document for legal/commercial registration or a certificate of the actual leagal status of the tenderer, documents negating the situations listed in point 2.3.3. of the Practical Guide, Balance Sheet, Profit & Loss accounts and others as well as documents evidencing the equipment compliance with the EC reference methods and EU regualations).

Answer to Administrative Question 1:

The documents/statements that are required as per point 11.10 from the Instruction to Tenders must be presented in original documents and in case there are documents that are not in English language, any such documents must be accompanied with legalized translation into the English language.

1 The documents required as per point 2.3.3, point 3.2 and point 3.4 must be presented as per the requirements of the Tender Dossier (including the Tenderer’s Declaration) and in case of documents that are not in English language, any such documents must be accompanied with legalized translation into the English language

Documents to be submitted as an evidence of equipment compliance with the EC reference methods and EU regualations (points 4.1 and 5.2 of the Technical Specifications) must be in English language. In case there are documents that are not in English language, any such documents must be accompanied with legalized translation into the English language.

Question 2:

Question regarding point 18 "Joint Venture or Consortium" of the Instructions to Tenderers

In case of Consortium, please confirm that the Consortium is to be registered after notification of award?

Answer to Administrative Question 2:

Yes, if the Consortium is not court registered, the legal court registration of the Consortium could be done after notification of award.

II. TECHNICAL QUESTIONS:

Question 1: (general)

Please confirm that the parameters set out in the technical specification are the minimum required and that all parameters exceeding them will also be considered technically compliant. For example:

Question 1a: regarding package 9, item 1: GC, letter "c": temperature programmable injector:

The required injector should comply with the following parameters: temperature setting range - up to 400╟C in 1╟C increments and total flow setting range – from 0 to 500 ml/min for Helium. Please confirm that a temperature programmable injector with temperature setting range - up to 450╟C and total flow setting range - from 0 to 1000 ml/min for Helium will also be comsidered technically compliant.

Answer 1a: Yes, the requirement for 0-500 ml He and up to 400 C should be considered as minimum requirement. Up to 450 C and up to 1000 ml will be considered as technically compliant

2 Question 1b: regarding packages 9 and 9a, item 1: GC, letter "b": split- splitless (SSL) injector:

The required injectors should comply with the following parameter: total flow setting range from 0 to 500 ml/min for Helium. Please confirm that an SSL injector with total flow setting range from 0 to 1000 ml/min for Helium will also be comsidered technically compliant.

Answer 1b: Yes, the requirement for 0-500 ml He should be considered as minimum requirement. Up to 1000 ml will be considered as technically compliant

Question 2: related to package 9a – GC/MS analytical system

The required GC/MS system is with electron impact (EI) ionization mode only and turbomolecular pump with 250 l/min capacity. Please confirm that GC/MS systems with diffusion pumps with suitable capacity and having the same functions and showing better performance as well as easy and cheap maintenace will also be considered technically compliant.

Answer 2: The requirement is for turbomolecular pump

Question 3: related to package 10 – AAS, item 1: Spectrometer – double beam optical system requirement

Please specify if the requirement for "double beam optical system" is to be read as double beam spectrometer or double beam spectrometer with a selectable single beam mode, namley "double beam optical system or double beam optical system with a selectable single beam mode", which is of modern design, allowing a greater flexibility and an increase in energy of the signal beam without loss in accuarcy of the correction of the basis line when applications allow the use of a single beam mode.

Answer 3: It is more then clear that double beam optical system means real double beam spectrometer and the requirement is for that

Question 4: related to package 10 – AAS, item 1: Spectrometer – lamp turret with more than 4-lamp positions, fast lamp selection

Please specify if the word "fast" used formally to define the fucnction "lamp selection " (with no specific term or parameter for assessment and comparison associated to it) is to be read as "automatic" which is the common term adopted by all manufacturers, namely "lamp turret with more than 4-lamp positions, automatic lamp selection".

Please have in mind that the definition "fast lamp selection" is used formally in the advertising materials of one manufacturer only and in its genuine meaning is "automatic lamp selection" as there is no a definition or parameter defining the 3 term "fast" in the detailed technical materials and catalogues of this particular manufacturer.

Answer 4: Automatic lamp selection will be considered as technically compliant

Question 5: related to package 10 – AAS, item 1: Spectrometer – graphite furnace with dynamic optical temperature control, preheated cuvette injection

Please specify if a modern technical solution with approved superior reliability will be considered acceptable, namely: "graphite furnace with dynamic optical or sensorless temperature control, preheated cuvette injection".

Answer 5:

Any solution, which cover the requirements in the Technical Specifications, will be considered as acceptable

Question 6:

With reference to questions 3, 4 and 5 above, we would like to make the following comment. According to us some technical terms used in the AAS description are more or less outdated and can be found only in the description of spectrometers of older generation. We are of the opinion that the use of such terms is somehow restrictive to the majority of tenderers, except for one of them, disabeling them from offering spectrometers of the most recent models and offering wider technical capacity for the analyses to be performed under this particular project. As already mentioned, some of the specifications seem to have been dowloaded from the Internet site of one particular manufacturer. These specifications denote one specific technical solution, which is not determinative for the analytical capacity of the spectrometer, but could be restrictive to all the other tenderers.

Answer 6: The specifications are not restrictive. In this case the technical parameters are not written for some determined model

Question 7:

In the technical specifications, there is an item n╟3a (consisting notably of FTIR) which is not mentioned neither in the Finacial Offer template, nor in the Draft Contract template. Could you please let us whether this important item is part of the supply or not.

Answer 7: No, item 3a (consisting notably of FTIR) is not part from the supply

Question 8:

4 We have the technological possibility to put the required SO2 and NOx measurement ((Item 3b) in the same portable analyzer than the one required in Item 1 for O2 and CO measurement. Can you accept this, knowing that it will lead to a more competitive price and much more convenient solution on a technical point of view since the measurement of SO2 and NOx can be then corrected from the interferences of CO in the sampled gas.

Answer 8: Any solution, which cover the requirements in the Technical Specifications will be considered as acceptable
