SECTION C (V): TRUSTEE INVESTMENT POWERS Complete this section if you would like to specify the investment powers of the trustee/s of your estate.

Where a beneficiary is a minor or there is otherwise a delay in a distribution to a beneficiary whether due to delay in grant of probate or a contingency attaching to the gift, a testamentary trust is established in the Will. You may wish to provide certain instructions to the trustees regarding the management and administration of the trust. There are implied common law duties as well as legislation from each of the state and territory governing how a trustee must act. Where the trust is intended to last for a period of time or there are significant assets you may like to consider the terms of the trust further. We also provide the option for you to use the terms of our discretionary trust deed.

There is also an implied duty at law for a trustee to exercise prudent care. SECTION E: RESIDUAL ESTATE Your Residual Estate is your estate after expenses and specific gifts (Section F) have been paid out.

This section provides for you to select that all your remaining assets go to your spouse. If your spouse/partner predeceases you or if your spouse/partner is not to receive the residual of your estate, your beneficiaries in Section E(I) will receive your residual estate. Section E(II) also allows you to nominate “back up” beneficiaries in case the gifts to your initial beneficiaries do not take effect (e.g. because they die before or at the same time as you). SECTION M (II): ADVANCED FAMILY SITUATIONS – DIVORCE AND SEPARATION

Separation from your spouse, of itself, has no effect on your Will. If you have left property to your spouse in your Will and you die, they will still get that property even though you have separated. Similarly, if you have appointed your spouse as your executor, they will still be entitled to take up that role (although they may not want to). If these are not outcomes you want, you will need to make a new Will when you separate and complete Section M(III) regarding exclusions. Divorcing your spouse, on the other hand, does affect your Will, although the effect varies between the different States and Territories. In some, divorce automatically revokes (cancels) the entire Will. In others, divorce simply revokes any appointment of your former spouse as your executor and any gift you have left to your former spouse unless a court is satisfied that was not your intention; or you re-publish the Will or do a Codicil to the Will after the divorce without changing the appointment/gift. SECTION M (III): ADVANCED FAMILY SITUATIONS – EXCLUSIONS AND NON-STANDARD INCLUSIONS FROM WILL

There are State and Territory laws that enable certain categories of persons who are dissatisfied with their entitlement under a Will to apply to the court for further provision out of an estate. The court can make such an order if it decides that the Will does not make adequate provision for that person’s needs. These are known as family provision laws.
