INFORMATION ABOUT THE STATISTICAL SURVEY ON NON-AGRICULTURAL USE OF PLANT PROTECTION PRODUCTS IN 2012 (STATISTICAL QUESTIONNAIRE NAU-01 (ONE-OFF))

Law on Statistics of the Republic of Lithuania (Official Gazette, 1993, No 54-1048; LEGAL BASIS FOR THE 1999, No 114-3299); STATISTICAL SURVEY Regulation (EC) No 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics and repealing Regulation (EC, Euratom) No 1101/2008 of the European Parliament and of the Council on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities, Council Regulation (EC) No 322/97 on Community Statistics, and Council Decision 89/382/EEC, Euratom establishing a Committee on the Statistical Programmes of the European Communities (OJ L 87, 2009, p. 164). Agreement No 40701.2011.003.2011.556/STAT-129 (2011) of 27 December 2011 on the pilot project on estimating non-agricultural use of pesticides between the European Commission, represented by the Statistical Office of the European Union (Eurostat), and Statistics Lithuania.

TYPE, COVERAGE AND A statistical exhaustive survey on enterprises and a statistical sample survey on OBJECTIVE OF THE farmers’ and family farms. STATISTICAL SURVEY The questionnaire is filled in by enterprises and farmers’ and family farms using plant protection products (hereinafter referred to as “Products”) for non-agricultural purposes. Survey period – calendar year. Objective of the statistical survey – to find out what and how many Products were used for non-agricultural purposes and what was the scope (areas) of their use. TIME AND PLACE OF Statistical information and a project report are submitted to Eurostat. THE PUBLICATION OF STATISTICAL INFORMATION OBLIGATION TO SUBMIT Article 14(2) of the Law on Statistics of the Republic of Lithuania establishes that legal STATISTICAL DATA persons and enterprises, agencies and organisations having no legal personality must provide statistical data free of charge for the implementation of the Official Statistics Work Programme.

Article 14(3) of the Law on Statistics of the Republic of Lithuania establishes that natural persons must provide data where this is provided for by laws or the Official Statistics Work Programme. STATISTICAL DATA Article 15(2) of the Law on Statistics of the Republic of Lithuania establishes that CONFIDENTIALITY where the respondent about whom or whose activity results primary statistical data have been collected may be directly or indirectly identified on the basis of official statistical data, such official statistical data shall be confidential and protected in the manner prescribed by laws. BREACH OF THE Article 17 of the Law on Statistics of the Republic of Lithuania establishes that natural STATISTICAL DATA persons, heads of enterprises, agencies or organisations and other persons PROVISION PROCEDURE responsible for the preparation and provision of official statistical data who have violated the requirements of this Law and other legal acts relating to statistics shall be held liable in accordance with the procedure set forth by laws of the Republic of Lithuania.

Article 1732 of the Code of Administrative Violations of the Republic of Lithuania (Official Gazette, 1992, No 21-610; 2000, No 54-1557) establishes the following:

The non-submission of statistical data according to an established procedure to 5 institutions and agencies managing official statistics, or the submission of false statistical data to such institutions and agencies, shall incur penalty in the amount from LTL 500 to 1000.

The same activity undertaken by a person who has already been imposed an administrative punishment for the violations established in par. 1 of this article incurs penalty in the amount from LTL 3000 to 6000. The non-submission of documents verifying the statistical data submitted to the civil servants of institutions and agencies managing official statistics or the concealment of such documents, as well as the non-fulfilment of the legal requirements of such civil servants, incurs penalty for officials in the amount from LTL 500 to 1000. 6

INSTRUCTIONS ON HOW TO FILL IN THE STATISTICAL QUESTIONNAIRE ON NON-AGRICULTURAL USE OF PLANT PROTECTION PRODUCTS IN 2012 NAU-01 (ONE-OFF)

1. The statistical questionnaire on non-agricultural use of plant protection products in 2012 NAU-01 (one-off) (hereinafter referred to as “Questionnaire”) shall be filled in by enterprises, institutions, organisations, agricultural companies and sampled farmers’ and family farms up to 1 ha using plant protection products (hereinafter referred to as “Products”) for non-agricultural purposes. 2. Main activity refers to the activity from which the respondent receives the largest income or which takes the major part of respondent’s working time. 3. Non-agricultural use of Products refers to cases when Products are used in growing forest and ornamental plants (trees, bushes, flowers, etc.), in residential and commercial, sports, recreational, research (education), health care and improvement and other private and public areas, railway, road, air- and seaport, electricity, gas and other infrastructure areas, and on sampled farmers’ and family farms up to 1 ha. 4. Areas of non-agricultural use of Products: 4.1 – forestry (growing of firewood or construction timber); 4.2 – growing of ornamental plants (trees, bushes, flowers, etc.); 4.3 – maintenance of areas built up with residential buildings (environmental management and landscaping); 4.4 – maintenance of areas built up with commercial buildings (offices, factories, shops, etc.) (environmental management and landscaping); 4.5 – maintenance of sampled farmers’ and family farms up to 1 ha (gardens, kitchen gardens, greenhouses, areas under ornamental plants, etc.); 4.6 – maintenance of sports areas (stadiums, golf courses, etc.); 4.7 – maintenance of recreational areas (parks, botanical gardens, etc.); 4.8 – maintenance of areas built up with research (education) institutions; 4.9 – maintenance of areas built up with health care and improvement establishments; 4.10 – maintenance of areas built up with railway, road, air- and seaport, electricity, gas and other infrastructure; 4.11 – other (if this answer is marked, the area that has not been mentioned must be indicated). 5. Product use for commercial purposes refers to the use of Products by legal persons (enterprises, institutions, organisations, agricultural companies) aiming to benefit from it financially or in another way (i.e. by growing forest and ornamental plants (trees, bushes, flowers, etc.)). Product use for non-commercial purposes refers to the use of Products by natural persons (farmers’ and family farms up to 1 ha) the purpose of which is other than the production of commodities for sale. 6. Amount of the Product consumed refers to the amount of the product or the sum of the amounts of several products. 6.1. Norm refers to the recommended amount of the Product per 1 ha of the area to be treated. 6.2. Amount refers to the amount of the Product actually consumed in the area treated. 7. Area treated with the Product refers to the area where Products were used one or more times in the same calendar year. 8. Spraying equipment (sprayer) refers to a machine or device with a working width of more than 3 m for professional use used to spray Product solutions onto fields and/or plants. Sprayers may be self- propelled, attached to vehicles (tractors etc.), including those used with sowing machines, installed in trains and aircraft.
