City of Raleigh Board of Adjustment Filing Instructions
An application to appear before the Board of Adjustment must be filed to the Department of City Planning, 4th floor of One Exchange Plaza. The application must be complete and filed in accordance with the filing schedule. Questions regarding filing of application should be directed to Eric Hodge at 919-996-2639.
A notice to appeal an administrative decision shall be submitted to the City Clerk’s office in room 207 of the Avery C. Upchurch Municipal Building, located at 222 West Hargett Street. Questions regarding filing a notice to appeal should be directed to the City Clerk’s office at 919- 996-3040.
A pre-application meeting with staff is required prior to submittal of an application. The application must be completed upon submittal. The application must be signed by the property owner and notarized. The submittal checklist and intake requirements must be completed and submitted at time of the application. The filing fee must be received at time of submittal. One stamped, unsealed set of envelopes addressed to property owners within 100 feet of the request must be submitted. A list of adjacent property owners must be submitted. A to-scale plot plan is required for all site-specific variances and special use permits. Correspondence to the Board must be signed and notarized.
The Board of Adjustment operates in a quasi-judicial fashion. Any contact with a Board member regarding a pending case is improper.
All correspondence to the Board must be notarized. Only the applicant (property owner and/or lessee), or the applicant’s attorney may present a case before the Board of Adjustment and testify as to practical hardship or City Code compliance.
