Rockville Planning Commission SPECIAL MEETING November 21, 2013 Rockville Community Center
1. CALL TO ORDER AND ROLL CALL – Chair Rob Snyder called the meeting to order at 6:00 p.m. The following members of the Rockville Planning Commission were present: Bob Ford, Vivian Cropper, Linda Brinkley, Sharon Hatfield and Rob Snyder. Town Clerk Elaine Harris recorded the meeting.
2. DECLARATION OF CONFLICT OF INTEREST WITH AN AGENDA ITEM – There were no conflicts of interest declared.
3. REVIEW, DISCUSSION AND ACTION ON AN APPLICATION FOR A GRADING/EXCAVATION PERMIT FOR THE GRADING OF A ROAD AT APPROXIMATELY 995 W 250 SOUTH (GRAFTON ROAD) – SHERI DIAS/DANIEL SANGER – Chair Snyder began by asking about the south end of the proposed road, coming off Grafton Road, whether it intersects the Sanchez and the Attiyeh properties. Daniel Sanger clarified that the road does intersect both properties and that they have obtained written permission from both parties for an easement which will be recorded with the Washington County Recorder’s Office.
Bob asked whether the Fire Marshal has signed off on the road being only 20 feet wide. Clerk Harris clarified that the Fire Marshal’s approval does not happen until after the Planning Commission approves the permit. Mr. Sanger indicated that he has talked with the Fire Marshal about the proposed width of the road.
Bob’s next question pertained to the size of the culvert proposed for Horse Valley Wash. Mr. Sanger reported that there would be three (3) 24-inch reinforced concrete pipes that would handle the normal flow. The proposed bridge is a low water crossing or Arizona Bridge designed to allow water to flow over the top when there are big storms. An Arizona Bridge will not disrupt the natural flow of the wash. Mr. Sanger assured the Planning Commission that the bridge will be reinforced to prevent washout or undermining.
Sharon expressed concern about who will be monitoring the excavation and building of this bridge to ensure that the State Engineer’s required precautions are followed. Mr. Sanger stated that Rosenberg Engineering was hired to design the bridge and they would ensure that all specifications are being met. Mr. Sanger will find out from Rosenberg Engineering who will be monitoring and inspecting the excavation and building of the bridge. Sharon asked if both the Sanchez’ and the Atteya’s have approved of this excavation. Mr. Sanger indicated that the excavation will only effect the Sanchez property and that was agreed to by the Sanchez’ as a condition to the sale of the property.
Chair Snyder questioned if there were regulations related to building a low water crossing over the wash. Mr. Sanger indicated that the State of Utah determined that this would not require regulation by the Corp of Army Engineers and issued a permit under the jurisdiction of the State of Utah. A copy of the permit was included with the application.
Sharon in referring to the map asked how close the proposed road will be to the 30-percent slope and if there would be any retention required. Bob indicated that the slope is a consolidated mixture of sand and gravel, which if it is undermined will begin to crumble and come down. Mr. Sanger committed to the Planning Commission that the slope would be day lighted correctly to avoid the need for retention but if retention is necessary, it will be done correctly. important that the vegetation on the slope not be disturbed. He also has concerns about the ephemeral watercourses running off the slope. Mr. Sanger pointed out that this is a fairly small hill and there will not be a lot of accumulation of water for small streams. In an effort to prevent a large storm from washing dirt and gravel across the road, it was suggested by both Jason Bates, of Rosenberg Engineering, and Bob that the road be raised enough that the water will run down a small ditch at the side of the road. Mr. Sanger stated that the road will consist of road base and gravel and will eventually have asphalt laid. Sharon asked the distance from the toll of the slope to the road. Mr. Sanger indicated the distance to be about 35 feet.
Bob asked if there would be additional gravel and/or road base put on the road in the areas where there are plans to do grading. Mr. Sanger indicated that they are planning to grade the road so that it is a nice gentle slope by taking off the high points and will be resurfacing it to make it a manageable road.
Bob MOVED that the grading permit be approved with the following specific conditions: The applicant will stay 30 – 35 feet from the bottom of the 30-percent slope and that the vegetation at the bottom of the slope will not be disturbed. The Planning Commission will be informed as to who will be supervising the construction of the bridge, and where the excavated dirt will be placed.
Sufficient gravel will be added to the road base on the right-of-way where it is widened and/or changed, particularly those steeper slopes of 10 percent slope or more.
Sharon interceded on Bob’s motion adding: The distance of the proposed right-of-way will be a minimum of 35 feet from the bottom of the 30-percent slope.
The on-going construction of the culvert will be monitored for compliance with the State Engineers requirements.
Because the applicant has permission from the involved landowners to grade the road and install the culvert.
Because the proposed right-of-way complies with Rockville’s grading requirements.
Sharon MOVED to approve the Dias application for construction of an access road from Grafton Road to the Dias property with the contingency that the Fire Marshal approves it. Linda SECONDED the motion.
Chair Snyder stated that Bob handed the motion over to Sharon so we will say the motion was made by Sharon.

4. REVIEW, DISCUSSION AND ACTION ON AN APPLICATION FOR A GRADING/EXCAVATION PERMIT FOR A POND AT APPROXIMATELY 995 W 250 SOUTH (GRAFTON ROAD) – SHERI DIAS/DANIEL SANGER – Mr. Sanger gave a brief overview of the grading/excavation explaining that the excavated dirt will be used to elevate the proposed house site up from the flood plain and any remaining dirt would be distributed across the pasture to make it level.
Sharon asked what is the purpose of the pond. Mr. Sanger indicated that firstly it is to provide the fill necessary to raise the home site up from the flood plain. The pond will hold water but will be small enough that a permit will not be necessary from the Utah Division of Water Rights. Bob asked if the applicant had any plans to avoid percolation of the water in the pond. Mr. Sanger indicated that they do have plans on sealing it but not sure whether it will be with clay or a liner. Bob asked about the maintenance of the pond. Mr. Sanger indicated that the pond will be a feature of the property and will be maintained accordingly.
Bob voiced concern about how the Planning Commission can discern from the map if the buildings will be above the 100-year flood plain benchmark. Mr. Sanger indicated that the elevation benchmark for the floodplain is 3695.97 feet and the elevation of the dirt for the buildings is at 3699 feet which is three (3) feet higher than the benchmark. The finished floor for the house will actually be four (4) feet higher. The FEMA regulation is that the top of the lowest finished floor must be one foot above the flood plain. The Commissioners took a few minutes to review the maps showing the proposed elevations of the buildings in relation to the 100-year flood plain. Mr. Bates asked if the Commissioners had received the report on the flood plain hydrologic analysis. Clerk Harris indicated that they had not received that report and Mr. Sanger indicated that he would get a copy submitted to the Town Clerk’s office.
Bob clarified that the timeline for requesting a letter of change from FEMA is after all the construction has been completed. The engineering firm is tasked with making sure that the construction is done right. When the request for revision is made FEMA will send out someone to perform an inspection. Mr. Bates stated that in order to satisfy Rockville’s ordinance the engineering firm must submit a report to the Town verifying that what we’ve built meets or is above the 100-year flood plain. The report will have all the information as far as the analysis and the finished elevations and that will satisfy all the requirements of the ordinance. Bob asked who is responsible to monitor that the finished floors are high enough during the building process. Mr. Bates answered that the work approved by the building permit would be monitored by the Town’s Building Inspector. There is a requirement to have a benchmark set on the premises by both the contractor and the building inspector for use in monitoring.
Clerk Harris asked what the approximate cubic yards of dirt that Mr. Bates will be moving and grading for the road and for the pond. Mr. Bates indicated that the pond will be 7.650 cubic yards and the road will be 3.25 cubic yards. Bob stated from looking at the map that there will be disturbance on a large portion of the property. Mr. Sanger pointed out the lines on the map indicating where the disturbance fencing will be placed.
Sharon asked whether the Planning Commission should have information on the size of the pond in order to know if the requirements for a holding pond are being met and asked Mr. Bates if he is certain of the size. Mr. Bates answered that the proposed pond is 271,000 cubic feet which is equilivent to 6 acre feet if the pond were full. He was unable to find the documentation on his smartphone verifying the size of holding ponds that require a storage permit from the Division of Water Rights. Discussion followed about water rights and how the pond will be filled. The pond will be filled from a well and from the Grafton-Hall Irrigation Co. who holds the water rights.
BECAUSE the Dias application for the grading of a pond is complete and complies with Rockville’s grading requirements, and BECAUSE the excavated fill will be located appropriately on the Dias property, Sharon MOVED to approve the excavation of the pond on the property. Vivian SECONDED the motion.

5. REVIEW, DISCUSSION AND ACTION ON AN APPLICATION FOR A BUILDING PERMIT FOR A RESIDENCE AT APPROXIMATELY 995 W 250 S (GRAFTON ROAD) – SHERI DIAS/DANIEL SANGER – The Planning Commission reviewed the building plans for the proposed residence and asked for clarification on the following items: The footprint of the home 3983 sq. ft. and the second level has an additional 2,140 sq. ft. The Commission would like to see the square footage for the footprint, the square footage for each level of the residence, as well as, the total footage of the home. The Commission requested that all the elevations – baseline, footings, first floor, second floor, roofline, etc. – be shown on the same page as requested on page 2 of the application. This will also include the elevation on each side of the buildings – left, right, rear and front. It would helpful if the buildings could be designated – such as Dias theatre, Dias gymnasium, etc. The distances between the buildings were not included on the building plans. The building plans do not indicate the R value of the insulation in the walls, attics and floors above unheated areas as requested on the application. When building occurs past the reach of fire hydrants, the landowner is required to provide their own fire suppression by either a holding tank or sprinkler system. The Rockville ordinances do not allow water in accessory buildings bringing into question how the Fire Marshal will be able to suppress fires. The plan for fire suppression of all buildings needs to be included on the building plans.
Sharon MOVED that this application for a residence and accessory buildings be tabled until the applicants can provide us with the information we have requested: the R values, the elevations for all buildings as required on the elevation section of the application page 2, the distance between the buildings, the total square footage for each floor and the total square footage of the footprint, drawings labeled for each building, elevations shown on each side of the buildings – front, rear and both sides and recommend discussion with the Fire Marshal.
