CITY COUNCIL MEETING Minutes of February 21, 2017

Mayor Pro Tem Frank Garison, and the Talty City Council, held their regularly scheduled meeting on Tuesday, February 21, 2017, beginning at 7:12 p.m., immediately following the Planning & Zoning Commission Meeting and Public Hearing.

I. Call to Order: Mayor Pro Tem Frank Garrison called the meeting to order at 7:15 p.m., and announced a quorum. Council members present were Frank Garrison, Brad Davis and Courtney McGrath. Absent were Al Werning and Bobby Crowley and Mayor Larry Farthing. Also present was James Stroman, City Manager and Sherry Bagby, City Secretary.

II. Invocation and Pledge of Allegiance: Everyone rose for the invocation by Brad Davis and everyone recited the Pledge of Allegiance

III. Citizen Participation: No one signed in to address the City Council

IV. Public Hearing: Frank Garrison opened the Public Hearing at 7:14 p.m. on a variance request by Ranch Cottage Homes to reduce the 75 foot front building set back line for a property at 10149 Layden’s Ridge Avenue (a/k/a CR 213) in Shamrock Phase 7, Lot 297 in Talty, due to the odd shape of the lot, the pond behind the lot, and a creek on the west side of the lot. Gavin Hill, on behalf of the Planning & Zoning Commission, recommend that the Council wait and table their decision until the home could be staked out on the property so everyone could review it before an informed decision be made. Frank Garrison closed the Public Hearing at 7:18 p.m.

V. Discussion: James Stroman updated the Council on the 2017 Road Project. BGE was not in attendance. A Pre-Construction Conference is scheduled for 10:00 o’clock a.m. on March 2, 2017 at City Hall. The construction order of the streets will be Layden’s Ridge, Cleaver then Michael Talty.

VI. Action Items:

The Council discussed the Planning & Zoning Commission’s recommendation to wait until the proposed home is staked out on the property before a variance request is granted to reduce the 75 foot front building setback line at 10149 Layden’s Ridge so an informed decision could be made and all matters fully considered.

A Motion was made by Brad Davis to table the decision on the variance request until the home be staked out on the proposed site. Seconded: Courtney McGrath Vote: 3-0; Motion carried.

2. The Council reviewed the Minutes of January 17, 2017. A Motion was made by Brad Davis to approve the Minutes as submitted. Seconded: Courtney McGrath Vote: 3-0; Motion carried.

3. The Council reviewed the January 2017 Financial Report submitted by Murrey & Co. A Motion was made by Brad Davis to table this action since Mayor Farthing was absent. Seconded: Courtney McGrath Vote: 3-0; Motion carried.

4. The Council reviewed the February 6, 2017 Minutes from the Special Meeting. A Motion was made by Brad Davis to approve the Special Meeting Minutes of February 6, 2017 as submitted. Seconded: Frank Garrison Vote: 2-0; Courtney McGrath abstained. Motion carried.

5. The Council considered the BGE Roadway Improvement Construction Management Services Agreement (scope of services and fee schedule) Letter of February 13, 2017, for Phase 1 of the 2017 Road Project (need “attachment A” referenced therein); A Motion was made by Brad Davis to table this decision until Attachment A is provided wherein estimate totals of $150,000 are referenced. Seconded: Courtney McGrath Vote: 3-0; Motion carried.

6. The Council discussed matters relating to the final plat approval of Layden Farms Phases 2 and 3. The developer, Sami Ebrahim, and Todd Wintters, P.E. of Engineering Concepts & Design, L.P., were present to answer any questions. There will be three builders: (1) Nexxus Homes, (2) Stacey Petrea, and (3) Crescent Homes. According to City Attorney, David Berman, building permits

Minutes of February 21, 2017 Page 2 will not be issued until all engineering fees are paid, and the project is otherwise in compliance with City guidelines. A Motion was made by Brad Davis to approve the final plat of Layden Farms Phases 2 and 3, and that building permits not be issued until the engineer’s punch list is satisfied, outstanding engineering fees are paid, and the site otherwise complies with City guidelines. Seconded: Courtney McGrath Vote: 3-0; Motion carried.

VI. Discussion Items for March:

• Variance for 10149 Layden’s Ridge on front setback for residential lot; • January 2017 Financial Report by Murrey & Co.; • Auditor’s Report by Yeldell Wilson for Fiscal Year 2016;

VII. Adjourn Meeting

Mayor Pro Tem Frank Garrison adjourned the meeting at 7:40 pm.
