County of Orange Report on Grant Applications/Awards

The Grants Report is a condensed list of grant requests by County Agencies/Departments that allows the Board of Supervisors to discuss and approve grant submittals in one motion at a Board meeting. County policy dictates that the Board of Supervisors must approve all grant applications prior to submittal to the grantor. This applies to grants of all amounts, as well as to new grants and those that have been received by the County for many years as part of an ongoing grant. Receipt of grants under $50,000 is delegated to the County Executive Officer. Grant awards greater than $50,000 must be presented to the Board of Supervisors for receipt of funds. This report allows for better tracking of county grant requests, the success rate of our grants, and monitoring of County’s grants activities. It also serves to inform Orange County’s Sacramento and Washington, D.C. advocates of County grant activities involving the State or Federal Governments.

On August 20, 2013, the Board of Supervisors will consider the following actions:

The Federal Department of Homeland Security (DHS) is providing funding to the California Office of Emergency Services (CalOES) through the Homeland Security Grant Program (HSGP). This program includes the State Homeland Security Program and the Urban Area Security Initiative and is intended to provide grant funding to assist state and local governments in obtaining the resources required to support the National Preparedness Goal’s (NPG’s) core capabilities. The funding supports the implementation of State Homeland Security Strategies to address the identified planning, organization, equipment, training, and exercise needs in order to prevent, protect against, mitigate, respond to, and recover from acts of terrorism and other catastrophic events. Based on federal and state guidance’s, the Metropolitan Medical Response System (MMRS) program will not be receiving a special allocation this grant cycle. The Operational Area (OA) will consider supporting MMRS proposals if they tie directly to preparedness and response to mass casualty incidents.

The 2013 HSGP award increased by roughly twenty percent (20%) from the previous fiscal year, and the OA will find it necessary to submit a Personnel Cap Waiver to CalOES and the Federal Emergency Management Agency (FEMA) for consideration, as stipulated by the Federal and Supplemental HSGP guidance’s. This waiver will allow the OA to spend more than fifty percent (50%) of the HSGP award in salaries in support of pre identified capabilities.

The Orange County Sheriff’s Department received the federal-level grant guidance from DHS, in May 2013. CalOES issued the state-level guidance, in July 2013, as well as the sub-allocations and application materials. The OA application is due to CalOES on August 16, 2013. performance period begins on October 15, 2013, and ends on June 30, 2015. The Orange County Sheriff’s Department is responsible for administering and distributing the grant funds on behalf of the Orange County Operational Area.

DHS and FEMA have identified five priorities for FY 2013 Homeland Security Grant Program funds. These priorities are: Implementation of the National Preparedness System and the Whole Community Approach to Homeland Security and Emergency Management; Building and Sustaining Law Enforcement Terrorism Prevention Capabilities; Maturation and Enhancement of State Major Urban Area Fusion Centers; Innovation and Sustained Support for the National Campaign for Preparedness; and Improve Immediate Emergency Victim Care at Mass Casualty Events.

The State Homeland Security Grant Program (SHSP) ($2,911,455) provides funding to support the implementation of the State Homeland Security Strategies to address the identified planning, organization, equipment, training, and exercise needs at the state and local levels to prevent, protect against, mitigate, respond to, and recover from acts of terrorism and other catastrophic events. Consistent with Implementing Recommendations of the 9/11 Act of 2007 (Public Law 110-53), the states are required to ensure that at least 25 percent (25%) of SHSP appropriated funds are dedicated towards law enforcement terrorism prevention-oriented planning, organization, training, exercise, and equipment activities, including those activities which support the development of fusion center capabilities.

The California State Homeland Security Grant Strategy prioritizes the following capabilities:

• Interoperable Communications • Catastrophic Planning • Citizen Preparedness and Participation • Medical Surge • Critical Infrastructure Protection • Mass Prophylaxis • Training for First Responders • Food and Agriculture Safety

CalOES anticipates awarding the Orange County Operational Area (OCOA) $2,911,455 in State Homeland Security Grant Program funds. Grant funds will be used to support planning, training, exercises, and equipment purchases within the following projects/investments:

• Interoperable Communications • Catastrophic Planning • Citizen Preparedness and Participation • Medical Surge • Critical Infrastructure Protection • Mass Prophylaxis • Training for First Responders

No new positions are currently anticipated under this grant. This grant will provide continued funding for existing, grant-funded positions within the Sheriff’s Department Emergency Management Division, Homeland Security Division, and the Orange County Intelligence Assessment Center. There is no fiscal impact associated with this request. If the application is approved, the Sheriff’s Department will return to the Board of Supervisors for approval to receive the award and appropriate the funds through a Quarterly Budget Adjustment. There will be no change in net General Fund cost and no additional staff. There is no match required for this grant.

This grant application is developed in collaboration with impacted County Agencies/Departments, Urban Area Security Initiative (UASI) grant partners and local agencies to determine funding prioritization.

The Orange County Sheriff’s Department reports that this application is coming before your Honorable Board retroactively due to the short turn-around time, and ASR process and schedule, which did not allow for time to seek approval prior to the deadline for the application. As stated above, the federal-level grant guidance from DHS was received in May 2013, and the CalOES issued the state-level guidance, as well as the sub-allocations and application materials, in July 2013.

A Board of Supervisors Resolution is required to appoint an agent authorized to execute any actions necessary for the submission of the application and supporting documentation. County Counsel has reviewed and approved the attached draft Board Resolution.

Approve Grant Award – District Attorney – Workers’ Compensation Insurance Fraud Program ($3,620,608)

Requester: District Attorney Grant/Program: Workers’ Compensation Insurance Fraud Program Amount Awarded: $3,620,608 Match/Cost: $0 Date on Grant Report: May 21, 2013 Grantor: California Department of Insurance (CDI) Notification Date of Funding Award: July 16, 2013 Recommended Action: Approve Grant Award – District Attorney - Workers’ Compensation Insurance Fraud Program, and authorize the District Attorney to accept the grant award of $3,620,608 to focus on the prosecution of workers’ compensation insurance fraud cases in fiscal year 2013-14.

The Workers’ Compensation Insurance Fraud Programs provides funds for the investigation and prosecution of workers’ compensation insurance fraud cases. On May 21, 2013, the Board authorized the District Attorney to apply for a grant from the California Department of Insurance (CDI) of up to $3,823,908 to augment prosecution efforts. On July 16, 2013, the District Attorney’s Office received notification of a grant award of $3,620,608. The District Attorney requests authorization to accept the grant award of $3,620,608 to focus on the prosecution of workers’ compensation insurance fraud cases in fiscal year 2013-14.

The District Attorney’s Office has received funding to participate in the State Workers’ Compensation Insurance Fraud Program for the past twenty-three years. Fiscal Year 2013-14 will be the twenty- Grants Report August 20, 2013 Vol. XII, No. 18 Page 5

fourth (24th) year that the District Attorney’s Office applies for funding to investigate and prosecute worker’s compensation insurance fraud cases.

This grant will provide continued funding for the vertical prosecution unit consisting of prosecutorial, investigative, and support staff to investigate and prosecute workers’ compensation insurance fraud cases. The District Attorney’s Office will assign existing personnel to the grant-funded positions in the Workers’ Compensation Insurance Fraud Program. A County match is not required.

Grant funded services do not involve significant collaboration with other County Agencies. The District Attorney’s Office will work collaboratively with various law enforcement agencies as well as the public to direct its prosecution efforts towards the investigation and prosecution of workers’ compensation insurance fraud cases. County Counsel has reviewed and approved the attached Grant Agreement related to the award.

Approve Grant Award – Health Care Agency/Public Health – Kaiser Foundation Hospitals, Southern California Region/FIT Cities ($250,000)

Requester: Health Care Agency/Public Health Grant/Program: Kaiser Foundation Hospitals, Southern California Region/FIT Cities Amount Awarded: $250,000 Match/Cost: $0 Date on Grant Report: January 29, 2013 Grantor: Kaiser Permanente Notification Date of Funding Award: June 28, 2013 Recommended Action: Approve Grant Award – Health Care Agency/Public Health – Kaiser Foundation Hospitals, Southern California Region/FIT Cities, and authorize the Health Care Agency Director, or his designee, to sign and execute, on behalf of the County of Orange, a grant Letter of Agreement with the California Community Foundation obo Kaiser Foundation Hospitals, Southern California Region – Community Benefit Charitable Contributions Program, effective from July 1, 2013, through June 30, 2015, in the amount not to exceed $250,000.

Kaiser Permanente Southern California (Kaiser Permanente) provides support to organizations that offer services aimed at improving community health within their health system catchment area. Orange County Health Care Agency (HCA) was invited by Kaiser Permanente to apply for approximately $250,000 to support Public Health’s FIT Cities initiative. Award notification was made on June 28, 2013. The term of the funding is from July 1, 2013-June 30, 2015, and will correspond with the County’s fiscal years. This new, one-time funding opportunity, is by invitation only from Kaiser Permanente.

The overall goal of this program is to work with Orange County jurisdictions to create environments that support healthy behaviors. FIT Cities focuses on preventing chronic diseases and improving health by helping local government jurisdictions create and maintain “built environment” opportunities in the community. Built environment opportunities address such things as safe streets Grants Report August 20, 2013 Vol. XII, No. 18 Page 6

for walking and biking, planning and zoning that proactively consider access to fresh fruits and vegetables, the impact of alcohol outlet density, and placement of parks and trails.

Funding will support the acquisition of a health/planning expert to work on behalf of the Health Care Agency with local jurisdictions to increase their understanding of how health is impacted by built environment policies, practices and plans. Technical expertise will be provided to promote built environment best practices. The position required for this grant will be contracted. The funding will also support two to three mini grants that will be awarded to local jurisdictions working on specific initiatives. No new County positions or County match is required.

The grant funded services collaboration with other County agencies/departments is to be determined at this time.

HCA requests that the Board of Supervisors authorize the HCA Director, or designee, to execute the Letter of Agreement – California Community Foundation obo Kaiser Foundation Hospitals, Southern California Region, Community Benefit Charitable Contribution Program for the period of July 1, 2013 through July 1, 2015. County Counsel has reviewed and approved the attached Letter of Agreement related to the award.

In 1988, California voters passed Proposition 99, which placed a 25-cent tax on each pack of cigarettes sold in California. Twenty percent (5 cents) of that tobacco tax is earmarked for tobacco use prevention and cessation programs. County health departments are specifically designated as “Local Lead Agencies” by enabling legislation for Proposition 99 and are thus responsible for Grants Report August 20, 2013 Vol. XII, No. 18 Page 7

“planning, implementing, and coordination tobacco control initiatives within their local health jurisdiction.” In Orange County, the Local Lead Agency is the Health Care Agency’s (HCA) Tobacco Use Prevention Program (TUPP).

The Board of Supervisors authorized HCA to apply for the Proposition 99 grant in the current funding cycle on October 2, 2012. The amount projected to be received over the next four years is a total of $988,079:

Historically, every three years, HCA receives a new allocation table providing the projected funding amounts for the next grant funding cycle. For this cycle, there is an additional “bridge year,” which will result in a four-year cycle.

The goal of the program is to reduce the prevalence of tobacco use and Orange County residents’ exposure of second hand smoke. During this grant cycle, HCA will be conducting surveys to assess the retail environment and local merchants’ understanding of existing tobacco laws. Ultimately, the goal of this effort is to help keep youth from starting to smoke. HCA will also coordinate a local coalition of community based organizations in order to provide continuing education on emerging issues as well as to encourage collaboration between organizations. The third overall objective of this program is to work with staff at behavioral health facilitates to create opportunities for clients to quit smoking due to the tobacco related disparities experienced by individuals with behavioral health concerns.

No new County positions are required. HCA has been providing related services for over two decades. Existing staff will assume these responsibilities. The grant does not require a County match.

HCA requests that the Board of Supervisors authorize the HCA Director, or designee, to execute the Acceptance of Allocation Agreements for the next four-year grant term of FYs 2013-17. County Counsel has reviewed and approved the attached Allocation Agreement related to the award.
