I, Sandra Bohinski, Municipal Clerk of the Borough of Helmetta, County of Middlesex, State of New Jersey, do hereby certify that this is a true and exact copy of a Resolution duly adopted by the Borough Council of the Borough of Helmetta on January 1, 2011.

______Sandra Bohinski, RMC Municipal Clerk I deleted the wrong resolution. I deleted this below instead of the Hazardous Waste materials resolution (that was voted on last year and is good until 2013). Please replace what was previously sent to you with the one below. It is correctly listed on the Consent Agenda.

RESOLUTION #2011 – 43

RESOLUTION AUTHORIZING THE BOROUGH OF HELMETTA TO ENTER INTO AN INTERLOCAL SERVICE AGREEMENT WITH THE COUNTY OF MIDDLESEX FOR PROVISION OF HEALTH SERVICES

WHEREAS, the County of Middlesex (“County”) has created the Middlesex County Department of Public Health pursuant to N.J.S.A. 26:3A2-1 et seq. to provide public health services; and

WHEREAS, the Borough of Helmetta (“Borough”) desires to contract with the County for the provision of public health services of a technical and professional nature; and

WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to enter into an interlocal services agreement for the County to provide public health services to the Borough; and

WHEREAS, the County and the Borough are permitted to enter into this agreement pursuant to N.J.S.A. 40:8A-1 et. seq.; and

WHEREAS, a certification to the availability of funds executed by the Chief Financial Officer is attached to this Resolution pursuant to the provisions of N.J.A.C. 5:30-5.4.

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Helmetta that the Public Health Services Interlocal Services Agreement, in a form substantially similar to that attached hereto, with the County of Middlesex for the provision of public health services is hereby approved; and

BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to sign the Public Health Services Interlocal Services Agreement between the Borough of Helmetta and the County of Middlesex in a form substantially similar to that attached hereto; and BE IT FURTHER RESOLVED that the Chief Financial Officer has executed a Certification of Funds for this contract, which is attached hereto, and that sufficient funds are available for said contract from Account Number 1-01-43-785-020; and

BE IT FURTHER RESOLVED that conditioned upon the adoption of authorizing resolutions by both the County and the Borough and execution of the attached Public Health Services Interlocal Services Agreement by both parties, the Interlocal Services Agreement shall be effective pursuant to the terms of the agreement.

AUTHORIZATION FOR MAYOR TO SIGN THE AGREEMENT BETWEEN THE BOROUGH OF HELMETTA AND THE POLICE DIRECTOR

WHEREAS, the Borough is desirous of securing the services of the Police Director, subject to this Agreement; and

WHEREAS, the Director is willing to perform the duties of the Office of Police Director according to the terms and conditions of this Agreement;

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of Helmetta that they do hereby authorize Mayor Nancy Martin to sign the Employment between the Borough of Helmetta and the Police Director.

______SANDRA BOHINSKI, RMC Municipal Clerk EMPLOYMENT AGREEMENT BETWEEN THE BOROUGH OF HELMETTA, NEW JERSEY AND THE POLICE DIRECTOR

Agreement made this ____ day, of ______2011, by and between the Borough of Helmetta (hereinafter the "Borough"), by and through the Mayor and Council, and Andrew W. Ely (hereinafter the "Director").

WITNESS THAT:

WHEREAS, the Borough is desirous of securing the services of the Police Director, subject to this Agreement;

WHEREAS, the Director is willing to perform the duties of the Office of Police Director according to the terms and conditions of this Agreement.

NOW, THEREFORE, the Borough and the Director hereby agree on the following terms and conditions:

1. Duties

The Director shall be responsible to the Appropriate Authority as definded in Chapter 13 of the Code of the Borough of Helmetta and N.J.S.A. 40A:14-118. The Borough hereby agrees to employ the Director, and the Director agrees to serve, as Police Director. The parties acknowledge that the Borough has revised chapter 13 of the Code of the Borough of Helmetta entitled "Police Department" which fully describes the duties of the Director EMPLOYMENT AGREEMENT BETWEEN THE BOROUGH OF HELMETTA, NEW JERSEY AND THE POLICE DIRECTOR

AUTHORIZATION FOR MAYOR TO SIGN THE MIDDLESEX COUNTY PAINT RECYCLING AGREEMENT

WHEREAS, the County has undertaken a paint drop off program for the residents of the County ; and

WHEREAS, the Program will be implemented by the County Division of Solid Waste Management at certain muncipal sites in the County; and

WHEREAS, the Borough of Helmetta has been a part of this program since its institution and wishes to continue to be a part of this program;

NOW THEREFORE BE IT RESOLVED that the Governing Body of the Borough of Helmetta hereby authorizes Mayor Martin to sign this agreement on behalf of the Borough of Helmeltta.
