Please give details of the stage of preparation of the legislation (e.g. not yet sent to Parliament): In relation to the National Program and the Accession Partnership Priority, The Minimum Requirements for Safety and Health of Workers in Surface and Underground Mineral-Extracting Industries Implementing Regulation and The Implementing Regulation for the Minimum Requirements for the Safety and Health Conditions in the Mineral Extracting Industries through Drilling were published in the Official Gazette dated 21 February 2004 under number 25380 and in Official Gazette 22 February 2004 under number 25381 corresponding to the EU Framework Directives 91/104/EEC,92/91/EEC.

Please outline the timetable for the adoption of the legislation: DGOHS (DIRECTORATE GENERAL OF OCCUPATIONAL HEALTH AND SAFETY) NEEDS SUPPORT IN THE PROCESS OF IMPLEMENTING EU ACQUIS IN TURKEY, A QUICK ADOPTION WILL HELP TO IMPROVE THE OCCUPATIONAL HEALTH AND SAFETY-MINING INDUSTRIES IN THE COUNTRY AT A LEVEL OF EU MEMBER STATES.

LEGISLATIVE CHANGES HAVE BEEN STARTED BY THE END OF 2004 IN LINE WITH THE RESPONSIBILITIES OF OUR GENERAL DIRECTORATE FOR THE HARMONISATION OF RELATED EU ACQUIS e.g. DIRECTIVE 89/391/EC AND INDIVIDUAL DIRECTIVES. 21 REGULATIONS CORRESPONDING TO EU DIRECTIVES HAVE BEEN PUBLISHED IN THE OFFICIAL GAZETTE.

A copy of the draft legislation in your own language and in English or French should be made available to TAIEX before the Study visit can take place.

5. Other background information relating to the current situation:

Please give an outline of your current situation concerning the sector of the acquis communautaire indicated and indicate any recent developments that may be relevant in this regard: Legislative changes have been started by the end of 2003 in line with the responsibilities of our General Directorate for the harmonisation of related EU Acquis e.g. Directive 89/391 and individual directives. 21 Regulations corresponding to EU Directives, including 89/391/EEC, 89/686/EEC, 2000/39/EEC,98/24/EC,91/322/EC,83/477/EC, 99/92/EC, 92/104/EEC, 92/91/EEC have been published in the official gazette.

The adoption of these directives will improve the occupational health and safety in the country especially by means of introducing risk analysis, employee participation, training of employees. DGOHS (Directorate General of Occupational Health and Safety) needs support in the process of adopting EU-Directives into national regulations e.g., study visits on the exchange of information and experiences in harmonising and adopting OHS EU-Directives in the Member States as well as in some of the Candidate Countries and on giving examples of best EU practises.

The MOLSS is in charge besides others in relation to the national program in social policy and employment. The participation concern Labour Law, social dialogue, equal treatment of men and women, fight against racism, employment, European social fund, environment and health and safety at work.

Several significant efforts were made in the Ministry of Labour and Social Security (MOLSS) and the Directorate General of Occupational Safety and Health (DGOHS) over the past years. Those were dealing with: OHS signs, manual tools; personal protectors; noise and vibration; chemical materials; workplace fires; thermal comfort; electrical works, explosive atmospheres, mining etc. Furthermore, very comprehensive and detailed studies were carried out on the harmonization of Turkish legislation with European Directives on OHS.

Concerning the occupational health and safety issue which is considered under the heading “Social Policy and Employment” of Association Partnership Document of 2005, is placed as harmonisation of social policy and employment legislation and ensurance of implementation of it. And this will contribute largely to the development and enhancement of OHS level in Turkey.

Concerning the occupational health and safety issue which is considered as a short-term priority in the Occupational Health and Safety Section of the Main Principle 13.1.2 in part “Reflection of EU acquis on the Turkish Labour Law” of Priority 13.1 under the heading “Social Policy and Employment” of the Turkish National Programme which was accepted by the decision no 2003/5930 dated 23.06.2003 of the Council of Ministers, it is expected that a program for the transposition of the EU legislation into the national law will be accepted and in the mid-term the legislation will be transposed and implemented.

“Generalization of the regional and mobile occupational health and safety laboratories” in Objective 4 of the Section Social Policy and Employment of Multi Annual Programme.

Mining sector is one of the most important sectors in respect of occupational accidents in Turkey. It is of great

It is thought that it would be a good chance to realize such a study visit in respect of to lead social partners and workers- employers working at this sector.
