Alternative Sentencing Program and Class Guidelines All Fee increases effective as of April 1, 2010

Alternative Sentencing Programs Criteria:  No Felony assault or violent crimes, sex crimes (includes internet sex crimes), registered sex offenders, or Injury to a Child.  May not have an active No Contact Order or Protection Order.  Anyone who shows up with alcohol or drugs in their system while participating in one of the programs will be removed and finish sentence in jail. All money is forfeited that has been collected.  If a defendant has been removed in the previous six months, AS does not have to accept them into an Alternative Sentencing Program.  The ASC Sgt/Program Manager has the authority to override any of the eligibility requirements.

Programs offered  SLD (Sheriff’s Labor Detail)  Work Release  Electronic Monitoring  Sheriff’s Community Service  Jail (split or straight time)

SLD  Sentenced to no more then 20 days  Start within 30 days of sentence  Rates: o $25.00 weekday o $30.00 weekends o $25.00 Administrative fee (one time fee only) o Reschedule fees are $25.00 per day o No shows are $50.00 a day.  All fees must be paid in advance before first day.  Five days and under may do one day a week, every week consecutive for five weeks (may not skip a week).  Five days and over must commit themselves to a minimum of two days a week. May split the days throughout the week. May do more then two days a week. Must do two days a week every week consecutive until sentence is complete.  No physical or mental restrictions by a Doctor. Work Release  Sentenced to seven days or more  Rate: o $25.00 a day. o Administrative fee $25.00. (one time fee only)  First weeks rent plus initial fee is due prior to start date. Thereafter rent is due every seven days. May pay more then one week at a time if on a bi-weekly pay schedule but will always have to be paid up one week in advance.  Job criteria: o Ada County or Canyon County job sites only o Not self employed o No more then two job sites per day. o No more then two jobs. o May work up to six days a week no more then twelve hours. o No jobs working in bars or where the selling of alcohol is the major source of revenue. o Delivery drivers (individual basis) must be able have radio or phone access at all times. Must be able to provide whereabouts and locations. Must be able to be reached at any time and subject to job checks on road. Any changes must be made at least twenty-four hours in advance. o Must be able to verify employment through employer and be allowed job checks on site.  No students unless specified by court order.  Court ordered classes are allowed as long as documentation can be provided.

Electronic Monitoring Criteria: Used for those sentenced individuals meeting the eligibility requirements. Additionally, EM may be used as a conditional option for pre-trial release or as a result of a probation violation.  Minimum of 18 years of age  Has not been removed from any alternative sentencing program for non-compliance within the last six months.  Sentence of 30 days or less must pay all fees up front before starting. More then 30 day sentence must pay @ least for first thirty days in advance and then every 30 day.  Co-habitant waiver form must be signed by any adult 18 years of older living with the participant  Subject to job checks and home check  Provide documentation for any appointments to leave house.  Rate: o Administrative Fee $25.00 (one time fee only) o $25.00/day serving sentence o Pretrial (low risk) - $15.00 o Pretrial (high risk) - $20.00

Sheriff’s Community Service (SCS) Community service can be ordered in one of three options or in a combination of options  Straight Community Service  Discretionary Community Service  Part of “All Options” on the commitment order Eligibility - SCS  Administration fee $50.00  Minimum of 18 years of age  No current or previous Petit Theft charges  May not be supervised by a relative while performing community service  Must serve at a non-profit or governmental placement.  Pay Ada County Risk Management fee ($0.60 per hour)  If part of “all option”: o Must have less then 80 hours of community service o First or second historical offense

Interim Jail Eligibility  Be a minimum of 18 years of age or older.  Sentenced to at least five (5) days but not more that 30 days.  Must begin the program within 30 days.  May not be serving time on any sexual crimes, felony Domestic Battery, felony Injury to Child, Child Endangerment, or any other assaultive felony charge.  May not be a Registered Sex Offender.  Has not been removed from any alternative sentencing program for non-compliance within the last six (6) months.  Fees - Must pay all fees in full prior to the assigned start date o $35.00/ day o Administrative fee $25.00 (one time fee only)

Jail If a defendant does not meet the above criteria or the Judge does not allow for option we will schedule straight jail time at are first bed spaces available. Court ordered classes would be arranged for the next class available. Class must be paid prior to first day of class. We do not reschedule jail dates unless medically necessary.

Out of County This program allows those who serving time on an Ada County charge to serve that time in another county if:  The courts have authorized on the judgment.  Ada County discretion.  The receiving country has a program and the room to take the defendant.  Rate - Administrative fee $50.00 (one time fee only) Jail Programs (Classes) ABC: Active Behavior Change - Using MRT curriculum. Four calendar weeks starting every Monday (four days per week/40 classroom hours total). Inmates requesting ABC may be diverted to the Anger Management track if deemed appropriate during assessment. Eligibility Requirements:  Fee: $200 starting April 1, 2010 ($100 currently)  Classification level 4-9  Fees paid or IDF ordered by Judge  Good behavior for the 30 days prior to admission  Enough time left to serve to complete the class

SAP: Substance Abuse Program- Using New Direction Curriculum. Four calendar weeks starting every Monday (four or five days per week/40 classroom hours total) Inmates requesting SAP are diverted to the COD (Co-Occurring Disorders) track if deemed appropriate during assessment. Eligibility Requirements:  Fee: $200  Classification level 4-9  Fees paid or IDF ordered by Judge  Good behavior for the 30 days prior to admission  Enough time left to serve to complete the class

Parenting: Currently offered to Dorm Females only. Using Love and Logic Curriculum. Class is four calendar weeks, two days per week. IDF funds will not cover this class (not substance abuse related). Eligibility Requirements:  Fee: $25  Classification level 4-9 (Females)  Fees paid  Good behavior for the 30 days prior to admission  Enough time left to serve to complete the class

Process Group: Offered to inmates who have completed ABC or SAP and remain in custody after completion. This is an optional group with no educational curriculum. Intended to help inmates maintain motivation for positive behavioral change through reinforcement of appropriate interpersonal skills and problem solving. Eligibility Requirements:  Fee - None  Classification level 4-9  Completion of SAP and/or ABC during current jail stay  Ongoing good behavior for the 30 days prior to admission  Participants may stay in process group for the remainder of their jail stay, as long as his/her behavior remains appropriate and they continue to participate.

GED: (Provided by College of Western Idaho) Available to inmates housed in Dorms. Grade Level Assessments are completed the first week of every month, Self-study classes once per week (no charge). GED testing (upon inmate’s eligibility to test) offered monthly.  Fee is $15 per test.  There are 5 tests total. Most of our inmates who test complete one or two at a time.

TAP: Transitional Accountability Program. Offered to any former inmate graduates of ABC and/or SAP once released to the community. Program focuses on transitional issues from jail to community. Topics include substance abuse, behavior change, managing finances, and basic life skills. Lessons from ABC and SAP are reinforced and applied during this program. Program completion is based on attendance and progress, typically 6-9 months.  Fee is currently $116. Will go to $7.50 per group beginning April 1, 2010.
