HVAC Repairs and Service Bid Specifications

The Hazlet Township Board of Education is seeking bids for the provision of HVAC Repairs and Services for the period of July 1, 2013 to June 30, 2014.

It is anticipated that the services to be provided will not include new construction. The contract may be renewed with the mutual consent in accordance with State law.

by 11:00 A.M. on Tuesday, June 4, 2013 at which time all bids will be opened and read in public.

The bid MUST be in a sealed envelope, clearly marked on the outside, “HVAC BID ENCLOSED”. The District will not be responsible for bids that are inadvertently opened due to the bidder’s failure to clearly mark the envelope as indicated.

It is the bidder’s responsibility that bids are presented to the School Business Administrator at the time and at the place designated. Bids may be hand-delivered or mailed; however, the Board of Education disclaims any responsibility for bids forwarded by regular or overnight mail. If the bid is sent by express mail service, the designation of “HVAC Bid Enclosed” must also appear on the outside of the express mail envelope. Bids received after the designated time and date will be returned unopened.

Sealed bids forwarded to the School Business Administrator before the time of opening of bids may be withdrawn upon written application of the bidder who shall be required to produce evidence showing that the individual is or represents the principal or principals

1. ESTIMATED WORK

The Hazlet Township Board of Education estimates approximately 500 hours of work will be required during the term of the contract; this is an estimate only and does not obligate the district to purchase, use or pay for any services that are not actually required or performed. The school district reserves the right to increase or decrease this amount based upon need and funding during the term of the contract. The district will only pay for services actually performed. Prospective bidders may arrange for the inspection of district facilities by contacting the Supervisor of Building and Grounds at 732-264-8402, ext. 1203. An inspection is not required.

2. BOND REQUIREMENTS

A. BID GUARANTEE

A BID guarantee MUST accompany the bid. Bidder shall submit with the bid a certified check, cashier’s check or Bid Bond in the amount of ten percent (10%) of the total price bid, but not in excess of $20,000, payable unconditionally to the Hazlet Township Board of Education. When submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bond from a surety company authorized to do business in the State of New Jersey and acceptable to the Owner. The check or bond of the unsuccessful bidder(s) shall be returned in accordance with the laws of the State of New Jersey. A check or bond of the bidder to whom the contract is awarded shall be retained until a contract is executed and the required performance bond or other security is submitted. A check or Bond of the successful bidder shall be forfeited if the Bidder fails to enter into a contract.

The Hazlet Township Board of Education will require the successful low bidder to provide a PERFORMANCE bond as part of the contract process. The performance bond is to ensure the faithful performance of all work under the contract in accordance with the terms of these bid specifications and resulting contract. The performance bond must be in the amount of $5,000 and may be in the form of a certified check, irrevocable letter of credit or surety company bond (no cash). Upon satisfactory completion of the contract, the performance bond will be returned.

B. PERFORMANCE BOND

The Hazlet Township Board of Education will require the successful low bidder to provide a PERFORMANCE bond as part of the contract process. The performance bond is to ensure the faithful performance of all work under the contract in accordance with the terms of these bid specifications and resulting contract. The performance bond must be in the amount of one hundred percent (100%) of the acceptable bid, calculated as bidder’s hourly rate times 500 hours to secure the faithful performance under the contract. Performance Bond must be in the requisite amount and may be in the form of a certified check, irrevocable letter of credit or surety company bond (no cash). Upon satisfactory completion of the contract, the performance bond will be returned.

3. AWARD OF CONTRACT

The Hazlet Township Board of Education will award a single contract on the basis of hourly rate to the lowest responsive and responsible bidder. Following the award of a contract, all contract documents must be completed and returned within 21 days (Sundays and holiday excepted) by the contractor unless the Hazlet Township Board of Education agrees to an extension.

4. WORK ORDERS

The contractor shall accept orders placed with an approved purchase order during the hours of 7:00am through 3:30pm, Monday through Friday. Only emergency work will be required on weekends and holidays, unless previously agreed to by the district and contractor. Only emergency work may be authorized verbally and only by the School Business Administrator or Facilities Manager.

5. SHIPPING AND DELIVERY

All charges for goods and services shall include shipping, delivery, handling, storage, overhead and profit. The Hazlet Township Board of Education will not pay labor rates for travel time or for pick-up or delivery of materials.

All transportation charges shall be fully pre-paid by the Contractor, F.O.B., destination and placement location specified by the Board. As specified, placement may require inside deliveries. No additional charges would be allowed for any transportation costs resulting from partial shipments made for the Contractor’s convenience.

6. DELIVERY TIME

All deliveries to the Hazlet Township Board of Education shall be between the hours of 7:30am and 3:00pm Monday through Friday.

7. MATERIAL APPROVAL

No substitutions will be accepted without prior written approval of the Hazlet Township Board of Education staff member that placed the order. Items delivered without prior approval will be returned at the vendor’s expense. No payment will be made until the Hazlet Township Board of Education staff member that placed the order approves the goods or services delivered to the district.

8. SANCTIONS FOR FAILURE TO PERFORM

In case of a failure to respond within twenty four hours of notification, the Hazlet Township Board of Education reserves the right to solicit service from any other vendor and to charge the contractor for any increased cost over what would have been due under the contract rates. Should the successful bidder fail to respond to a service call within twenty four hours, the service and/or repairs will be penalized five percent of the hourly contract rate for each hour or part thereof that the contractor is late in responding. Response time for emergency work is twelve hours.

9. ADDENDA AND INTERPRETATIONS

No interpretation of the meaning of the specifications or other contract documents will be made to any bidder orally. All requests for such interpretation shall be in writing and faxed or mailed to Mr. Christopher J. Mullins, School Business Administrator/Board Secretary, Hazlet Township Board of Education, 421 Middle Road, Hazlet, NJ 07730, 732-264-8402, Ext. 1109, fax 732-264-1599. To be given consideration, requests must be received at least seven days prior to the date fixed for the opening of bids. Any written addenda to the bid specifications will be faxed, e-mailed or hand delivered to all prospective bidders known to the district at the respective addresses furnished by the prospective bidders not later than five days prior to the date fixed for the opening of bids. Failure of any bidder to receive such addenda or interpretation shall not relieve any bidder from any obligation under his/her bid as submitted. All addenda so issued shall become part of the contract.

10. INSURANCE REQUIREMENTS

As part of the contract process, the successful bidder will be required to provide a Certificate of Insurance evidencing the following coverages as a minimum and naming the Hazlet Township Board of Education as an additional insured: General Liability $1,000,000 per occurrence, $2,000,000 aggregate – including products and completed operations. Must be maintained with Certificate of Insurance for a minimum of 2 years. Personal Injury $1,000,000 per occurrence, $2,000,000 aggregate Workers Compensation – Employers Liability – Coverage B $500,000 limit Automotive Liability Insurance – for claims arising from owned, loaned, hired, and non- owned motor vehicles with limits of not less than $1,000,000, combined single limit for bodily injury and property damage shall be maintained in full force during the life of the contract. Umbrella Policy - $2,000,000 (Coverage to be excess over General Liability, Personal Injury, Automotive Liability and Workers Compensation) In addition to the requirements of this Paragraph, each Contractor shall be responsible for all damage or destruction caused directly or indirectly by its operations to all parts of the Work, both temporary and permanent and to all adjoining property. Each Contractor shall at its own expense, protect all finished work liable to damage and keep the same protected until the project is completed and accepted.

Each Contractor shall defend, protect, indemnify and save harmless the Board of Education from all claims, suits, actions, damages and costs of every name and description arising out of or resulting from the performance of the Contractor’s work under the Contract.

Contractor shall maintain the appropriate contractor licensure for performance of all work in accordance with the laws of New Jersey. Contractor shall be responsible for obtaining any applicable licenses from any government entity that has jurisdiction to require the same. All bids submitted shall have included this cost.

11. NJ BUSINESS REGISTRATION CERTIFICATE

All bidders must submit WITH THEIR BID a copy of their New Jersey Business Registration Certificate issued by the NJ Department of Treasury, Division of Revenue. Bidders requesting information concerning business registration certificate may call 609- 292-7842 for information if you need to obtain this required document.

12. NOTICE OF CLASSIFICATION

All bidders must submit WITH THEIR BID a valid New Jersey State Prequalification Certificate notarized State of New Jersey Form DBC 701 noting total amount of uncompleted contracts.

13. CONTRACT CONDITIONS

It is the intent of the Hazlet Township Board of Education to award a single contract to the lowest responsive responsible bidder. The bidder must insert the price bid upon the bid sheet that is provided with these specifications and complete all required information on the bid sheet. Prices shall be exclusive of all taxes as the school district is exempt from taxation. The amounts bid will not be permitted to change during the initial term of the contract. Bidders should factor in to their bid any anticipated change in prevailing wages. The Hazlet Township Board of Education may terminate the contract at any time upon a finding of unsatisfactory performance.

14. PREVAILING WAGE

All amounts entered on the bid sheet should comply with the New Jersey Department of Labor and Workforce Development. The New Jersey Prevailing Wage Act, NJSA 34:11- 56.25 et seq, requires that the Department of Labor and Workforce Development establish and enforce a prevailing wage level for workers. The vendor will be required to submit the required weekly prevailing wage documentation to the Hazlet Township Board of Education whenever work is performed under the contract. These records are subject to audit by the Department of Labor and Workforce Development. The vendor is also required to register with the NJ Department of Labor, Division of Wage and Hour

Compliance as required by NJSA 34:11-56.48 et seq and to pay the required fee for registration.

15. DESCRIPTION OF WORK

The Hazlet Township Board of Education is seeking a single qualified HVAC contractor to perform repairs and related HVAC services on HVAC systems and equipment owned by the district. All work shall be on a time and material basis; the district reserves the right to procure materials. Contractor is to commence work within 24 hours of notification for regular work and within 12 hours for emergency work.

The contractor shall be permitted to charge only a flat hourly rate according to the following times when the work is performed:

Weekdays, any 8 hours between 6:00am to 4:30pm (“standard work” or “regular rate”) Weekdays, 4:30pm to 12:30am (8 hours of pay for 7.5 hours of work plus an additional twenty five percent of the regular rate per hour, inclusive of benefits) Weekdays, 12:30am to 8:00am (8 hours of pay for 7.5 hours of work plus an additional thirty percent of the regular rate per hour, inclusive of benefits)

All hours worked in excess of 8 per day, Monday through Friday and the first ten hours worked on Saturday must be paid at time and one-half or otherwise in compliance with Prevailing Wage directives. All hours in excess of ten on Saturday or those worked on Sunday and holidays must be paid at double the regular rate or otherwise in compliance with Prevailing Wage directives. Recognized holidays shall be those listed in the Prevailing Wage schedule. The contractor will be required to comply with any changes in prevailing wage rates, including shift differentials and overtime.

Travel time will not be paid.

The required work shall include troubleshooting, diagnosis, replacement, repair, installation or servicing of all HVAC equipment and components as required. All work shall be completed in every aspect and all items required shall be provided for a fully operational system ready for use. Coordination of work with the work of other trades is required in order to resolve all conflicts without impeding the job progress. All materials provided by the contractor shall be new and of the best quality. Workmanship shall be in all respects of the highest grade and standard and all construction and work shall be performed according to the best practice of the trade.

By submitting a bid, the bidder certifies that he/she owns, leases or controls all of the necessary equipment required to perform under the contract.

The contractor may be excused at the discretion of the Hazlet Township Public Schools from performance if he is subject to a bona fide organized labor dispute.

The contractor shall maintain all licenses required by the State of New Jersey to perform all required work under the contract. Each worker under the contract must be properly licensed and/or certified as applicable. Copies of licenses/certificates must be provided to the District.

The contractor shall obtain, maintain and cause to be properly displayed all required permits prior to beginning work. The District will reimburse the contractor for permit fees upon presentation of a receipt; the District is commonly exempt from fees otherwise imposed by the municipality. The contractor shall cause to have all required inspections performed before certification of payment.

The contractor shall begin to provide on-site repair services within 24 hours of notification. The contractor shall have sufficient staff, parts and means of transportation to complete the repairs within the required contractual time period. Services must be available at all times every day. Emergency services must be commenced within 12 hours of notification. School personnel shall be available to provide access to all areas of all facilities so as to permit the contractor to complete all work.

Rates shall be invoiced in accordance with Prevailing Wage standards based upon the day and hours worked. Specific permission must be obtained in advance from the Facilities Manager or the School Business Administrator for any work proposed to be charged as shift differential or overtime.

The contractor shall deliver all warranty documentation and instructional material to the district upon completion of work.

On the direction of district personnel, work shall be scheduled to suit school operations. Work should be completed sequentially unless otherwise directed by district personnel. Once work commences, it is to be completed in a continuous fashion.

The contractor shall furnish all labor, materials, tools, machinery, equipment and services necessary to complete the work to any and all HVAC systems. The contractor shall field investigate and diagnose problems and repair the system or equipment and restore the equipment to satisfactory operating condition. All work shall be done in accordance with the latest requirements of national and local codes. The contractor shall protect at his own expense all of his work, material and equipment from damage or loss while performing work under the contract. All openings into any piping, ductwork, walls or equipment shall be securely closed and sealed to prevent any objects, debris or water from entering. The contractor shall be held responsible for any damage due to failure to properly protect his work.

The contractor shall be responsible for ensuring compliance with lock out-tag out requirements.

The Supervisor of Building and Grounds of the Hazlet Township Public Schools or his designee must certify approval prior to payment.

All work performed under the contract shall be guaranteed for a period of one year from the date of final acceptance of the work by the district. During the period of the guarantee, the contractor shall replace or repair at his own expense every piece of equipment, material or work that is defective. The repair or replacement work shall be done as soon as the contractor is notified. The contractor shall also repair all damage to the surrounding work caused by the failure, repair or replacement of defective equipment, material or work.

16. SUBCONTRACTING

Subcontracting of any of the work to be performed under this contract is prohibited without the express written consent of the Hazlet Township Board of Education.

18. SUPPLIES

The contractor will be permitted to be reimbursed for supplies purchased pursuant to work performed under the resulting contract at 115 per cent of the invoice price. The vendor must submit an original receipt and proof of payment for all supplies. The district reserves the right to provide any materials under the contract. The district will only reimburse for supplies installed in district facilities.

19. AFFIRMATIVE ACTION

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et esq. and N.J.A.C. 17:27-1 et seq.

The low bidder must submit within 7 days of notice of intent to award a contract one of the following: a copy of the Federal Letter of Affirmative Action Plan Approval or a copy of the Certificate of Employee Information Report or a completed Affirmative Action Employee Information Report (Form AA 302, available from the Hazlet Township Board of Education or the New Jersey Department of Treasury).

All bids must be submitted on the bid sheet provided in these specifications. Bidders are required to submit WITH THE BID the Declaration of Ownership, indicating all persons owning 10 per cent or more of the stock or equity of the corporation. Bidders are required to submit the Affidavit of Non-Collusion.

21. AMERICAN MADE GOODS

The contractor is required to supply American made products under the contract whenever they are available.

22. AMERICANS WITH DISABILITIES ACT OF 1990

Discrimination on the basis of disability in contracting for the purchase of goods and services is prohibited. Bidders are required to read and abide by the Americans with Disabilities Act and agree that the provisions of Title II of the Act are made a part of the Contract. The Contractor is obliged to comply with the Contractor and hold the Owner harmless.

23. STOCKHOLDER DISCLOSURE

No corporation or partnership shall be awarded any contract for the performance of any work for the furnishing of any goods and services unless, prior to the receipt of the bid or accompanying the bid of said corporation or partnership, bidder shall submit a statement setting forth the names and addresses of all stockholders and the corporation or partnership who own ten percent (10%) or more of its stock of any class, or of all individual partners in the partnership who own a ten percent (10%) or greater interest therein. The Stockholder Disclosure Form is attached to the bid materials.

24. NON-COLLUSION AFFIDAVIT

The Affidavit is attached to the Specifications and must be executed and submitted with the bidder’s bid proposal.

GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS During the performance of this contract, the contractor agrees as follows:
