Council Meeting – September 5, 2013

Mayor Thomas L. Hardesty called the regular meeting to order with the following council members present: Bobby Andriot, Mike Zoeller, Donna Eaton, Jon Swindler, Frank Page and Shane Suttor.

City Employees Present: Jennifer Herrell, Danny Goodwin, Willard Tucker, Tom Doyle, Mary Smith, Brent Hatter, and Carla Wainscott.

City Attorney: Steven Gregory

Brent Hatter, Fire Department Chaplain, gave the invocation.

All present pledged allegiance to the flag.

Minutes/Special Called Meeting August 22, 2013 Councilmember Page moved to approve the minutes of August 22, 2013 as read by council members prior to the meeting. Seconded by Councilmember Swindler.

All voted “aye” and motion carried.

Ordinance – An Ordinance of the City of Shelbyville, Kentucky Amending the Salary Ranges as set out in Ordinance No. 2011-09-08(A) – 1st Reading – Steven Gregory Mary Smith adjusted salary ranges that get updated every 2 years, and ordinance needs to be amended.

It was introduced for first reading by Councilmember Suttor. Seconded by Councilmember Swindler.

Public Comments Teresa Hardin, owner of Masterpieces, stated she is concerned about parking on Main Street effecting businesses. Mayor will talk with Chief Goodwin regarding this issue. Only 2 handicap parking spots on Main, which is another issue. Catie Shatune also commented on the handicap parking spots.

Department Reports Jennifer Herrell, City Engineer/Public Works Director, reports on October 5, 2013, the Household Hazardous Waste Collection will be held at 120 Midland Blvd. from 9:00 a.m. – 2:00 p.m. Brett Clark is doing erosion control. PAGE 230

Mary Smith, Personnel Director, stated the City of Shelbyville Annual Banquet will be held at Red Orchard Park on September 24, 2013. Eleven employees will get awards.

Danny Goodwin, Police Chief, stated department participated in Back to School Bashes and school lockdowns. Officer Cable completed certified safety seat installer. Police Department participated with Shelby County Library in collection of outdated prescription drugs. Three large bags were collected. Sgt. Patrick Donahoe graduated 8/23/13 from Police Supervision Academy. Carla Wainscott and I went to the ABC Summit. Alcohol laws are changing. 142 calls so far, which is an increase from last year so far.

Eilene Collins, Shelby Development Corporation, attended the State Training of Street Managers. On September 7, 2013 at 5:00 p.m. is the Street Party/Car Cruise.

Mayor’s Report Rodeo at Fairgrounds on September 6-7, 2013. Long Run Massacre being held at Red Orchard Park. Taste & Tunes on Monday, September 18th. Swamp Tromp at Clear Creek Park on September 14, 2013. Diabetes Walk at Clear Creek Park on September 7, 2013.

Council Reports Donna Eaton asked if we can look into changing the speed limit from 55 mph to 35 mph on Hwy. 53 (Mt. Eden Rd.) near Charleston Way.

Next Council Meeting will be on September 19, 2013 at 6:30 p.m. at City Hall.

Councilmember Swindler moved to go into closed session to discuss acquisition of property at 7:10 p.m. Seconded by Councilmember Zoeller.

All voted “aye”.

CLOSED SESSION

Councilmember Suttor moved to end the closed session at 8:10 p.m. Seconded by Councilmember Page.

All voted “aye”.

Discussion was held to acquire real property at the end of Prospect Street further described in Deed Book 385, Page 593 being Tracts 1 – 2 A&B as being recorded in the Shelby County PAGE 231 Clerk’s Office for the benefit of Shelbyville Municipal Water and Sewer Commission up to and including the use of eminent domain in accordance with the provisions of KRS 416.

Councilmember Swindler moved to proceed with acquisition of property. Councilmember Zoeller seconded the motion.

Upon roll call voting “aye” were Councilmembers Page, Swindler, Suttor, Zoeller, and Andriot. Councilmember Eaton voted “nay”.

At 8:15 p.m., Councilmember Page moved to adjourn. Seconded by Councilmember Swindler.

All “ayes” and motion carried.
