INSTRUCTIONS PRODUCT TESTING and FACILITY USE AGREEMENT

Before USER is authorized to enter the University of Arizona’s premises to begin work pursuant to the Product Testing and Facility Use Agreement, the following requirements must be met:

1. All sections of the Product Testing and Facility Use Agreement requesting specific information from USER and UNIVERSITY must be completed.

THE FOLLOWING IS MANDATORY ONLY ORIGINALS WILL BE ACCEPTED—NO COPIES OR FAXES! 2. The USER must submit and attach to the Agreement an ORIGINAL insurance certificate to include commercial liability in amounts of one million dollars ($1,000,000), with the following wording in the Description of Operations, et al section: Arizona Board of Regents and The University of Arizona are included as additional insured under General Liability and Automotive Liability with respect to the Product Testing and Facility Use Agreement. The Products Testing and Facility Use Agreement WILL NOT BE VALID and NO WORK IS TO BEGIN without an insurance certificate acceptable to the University and such certificate MUST BE ATTACHED to the contract. If the insurance certificate is for job-specific rather than annual coverage, a separate certificate MUST be submitted for each Product Testing Agreement.

3. If USER will be applying any chemicals to the property (such as fertilizer, insecticides, herbicides or fungicides, USER must attach to the contract Material Safety Data Sheets (MDS) specifying the type(s) of chemicals being applied. NO CONTRACT will be VALID and NO WORK is to BEGIN until the appropriate MSDS information is on file with the University. MSDS information MUST be submitted for each and every application of chemical to University property by the USER.

4. The Product Testing and Facility Use Agreement SHALL NOT BE LEGALLY BINDING until it has been signed by the University Contracting Officer.

5. Three (3) original copies of the Product Testing and Facility Use Agreement will be provided to the USER for signatures and returned for submission to the University for signatures. One original with all signatures will be returned to USER for their files.

6. Please return all signed copies to the attention of the Resident Director for processing through the University System.
