Minutes of the meeting of the BMW Committee - 3 under BMW Rules held on .(18.12.2008, in the chamber of SEE (BMW

The Committee reviewed the ATR of the decisions of last meeting. The following are the .records of discussions

Agenda -1 ATR of Decisions taken in meeting held on 27.11.08

i) It was informed by EE (BMW) that six copies of the Bare Act have been received from the Administrative Officer DPCC and have been distributed to the members of the .committee ii) As regards the case of Dr., Dangs Pvt.Ltd , D-1 Hauz Khas, it was informed by EE, BMW that the file has been put up to MS, DPCC for deciding the next course of .action iii) Regarding the decisions of the meeting held on 11.11.08, it was informed by EE that Authorization letters have been issued to various HCUs as per the decisions. Also, the necessary letters, as per the decisions of the meeting held on 27.11.08, have been prepared and have been handed over to the dispatcher. He, however, informed that Authorizations in respect of 8 HCUs have been put on hold as these HCUs have not entered into agreement with the operator of CBWTF. However, the Committee decided that letters be issued to these units for submitting a fresh copy of valid .agreement

He further informed that CTE/CTO in respect of 2 cases, have been put on hold because they have not submitted the desired applications. Similarly, the decision taken in respect of Dr. Wellmans Homoepathic Laboratory has not been implemented as case is already being dealt by BMW Committee No.1 along with .other cases of other Drug manufacturing units

iv) As regards the HCUs which have been found to be violating the Noise Standards of D.G Sets, it was informed by EE that all 5 cases have been .submitted administratively for deciding next course of action

v) It was informed that the file of Vaid Mternity and Nursing Home, Loni Road Shahdara has been located. The committee decided to grant the Authorization after .checking the Validity of agreement with the operator of CBWTF

vi) It was informed by the Trainee Engineer that 39 inspections have been carried out. However, 3 cases could not be inspected as the HCUs were found locked. The committee decided that these HCUs must be inspected again. The Committee also decided that Inspections of 10% units which have been granted Authorizations, must be done so as to know the status of compliance with BMW Rules and a report be .submitted to this Committee

Agenda -2 Pending cases of Health Care Establishments cases were discussed in the meeting. The decisions taken are presented in the 95 .Annexure-I

Agenda -3 Cases of the Delhi Govt. Dispensaries

129 cases of DHS Dispensaries were discussed by the committee. It was observed that 24 cases fulfill the desired requirement of DPCC in terms of Balance Fee, etc. The Committee decided to grant Authorizations to these 24 units, as listed in Annexure-II. For remaining 105 cases, it was decided that a reminder may be issued to Director, DHS for submitting the Balance Fee/missing documents. The letter may be sent at the level of MS, DPCC. Also EE, BMW shall personally follow up the matter with Dr. Bhagotia.

Agenda -4 Health Care Establishments which have not applied for the Renewal of Authorization under BMW Rules. It was informed that 392 units have not submitted the application for renewal of Authorization. It was decided by the Committee that a letter be issued to these units advising to submit the desired application under BMW Rules. Also, it was decided that intimation may be sent to the Enquiry Counter to intimate the HCUs, one month prior to the date of expiry of Authorization, for submitting the application under BMW Rules.
