Kentucky Commission on Proprietary Education Meeting Minutes July 24, 2013

A regular meeting of the Kentucky State Commission on Proprietary Education was held on July 24, 2013 at the Capitol Plaza Tower in Frankfort, KY.

Call to Order Steve Wilborn, Interim Executive Director, called the meeting to order at 10:04 am.

Mr. Wilborn introduced Michelle McElmurray, the new Administrative Assistant.

Meeting Minutes A motion was made by Brian Gupton and seconded by Jim Jackson to approve the July 1, 2013 meeting minutes. Motion carried.

Motion made by Walter Lee and seconded by Mary Ann Miller to accept and approve the Executive Director’s report. Motion carried.

Cease and Desist Orders 1. Having failed, in a timely manner, to provide required documentation to support their renewal license application -- the Commission directs that Georgetown Nurse Aide Training, A-Pass Weikel (Edgewood, Lexington, and Louisville) and The Computer School immediately Cease and Desist from all operations. Motion made by Mary Ann Miller and seconded by Glen Wilham. Motion carried.

Mr. Weikel, father of John Weikel, President of A-Pass Weikel was allowed to address the Commission. He requested the Commission grant an additional 10 days to furnish surety bonds for A-Pass Weikel (Edgewood, Lexington, and Louisville) and The Computer School in Lexington before issuing the Cease and Desist Order. After significant discussion by and between the Commission members and Mr. Weikel no action was taken to amend the original Motion. 2. Having failed to pass the annual KSP inspection in that the CDL school does not have on staff at least one licensed instructor -- the Commission directs that BRRC Career Development Training immediately Cease and Desist from all operations. Motion made by Glen Wilham and seconded by Nappi Napolitano. Motion carried.

Closure Letters Having not filed a renewal application for licensure by the Kentucky Commission on Proprietary Education for fiscal year 2014, the Commission directs a closure letter be sent to the following schools: Professional Career Training Institution; Arnett Dental Assisting Academy; Casino Career Academy; East KY CE; Health Care Training School; Key to Knowledge Training Institute; and Real Estate Education and to the individual(s) responsible for establishing those schools explaining their duties under KRS Chapter 165A upon ceasing to operate as a proprietary school in KY. Motion made by Walter Lee and seconded by Travis Powell. Motion carried.

Unauthorized operation

The action taken by Executive Director Wilborn in sending a Cease and Desist letter to Dr. Bodene Truck Driving School, Winchester, KY on July 19, 2013 based on allegations of unauthorized operation is hereby authorized and approved. Motion made by Glen Wilham and seconded by Nappi Napolitano. Motion carried.

Chairman Election

Motion made by Debby Carter and seconded by Walter Lee to elect Nappi Napolitano as Chairman. Motion carried.

New Non-Resident Schools 1. The application of Digital Learning Center, Kailau, HI to be licensed as a non- resident school in Kentucky is approved subject to the following condition – no class may be advertised for or conducted with Kentucky students until the Kentucky Real Estate Commission has given formal approval of the same and that approval has been transmitted to the Kentucky Commission on Proprietary Education. Motion made by Cindy Landry and seconded by Walter Lee. Motion carried. 2. The application of ExamFX, Leawood, KS to be licensed as a non-resident school in Kentucky is approved subject to the following condition – no class may be advertised for or conducted with Kentucky students until the Kentucky Department of Insurance has given formal approval of the same and that approval has been transmitted to the Kentucky Commission on Proprietary Education. Motion made by Walter Lee and seconded by Nappi Napolitano. Motion carried

New Programs 1. The application of WyoTech, Blairsville, PA for a new program: Diesel Advanced Technology Education for Mack Trucks and Volvo Trucks is approved. 2. The applications of Genesis Career College, Bowling Green, KY for two new programs: Pharmacy Technician and Medical Assistant are approved. Motion made by Glen Wilham and seconded by Walter Lee. Motion carried.

Existing Program more than 25% John Casablancas Modeling and Career Center, Lexington, KY:  TV/Print and Female Modeling;  Select TV Print, Select Modeling, Male Modeling, Personal Development & Advanced Female Modeling and;  Pre-Teen Modeling and Acting Spencerian College, Lexington, KY:  Radiologic Technology Associate of Applied Science Spencerian College, Louisville, KY:  Radiologic Technology Associate of Applied Science Motion made by Travis Powell and seconded by Nappi to approve the foregoing program changes over 25%. Motion carried.

New Degree Programs Ross Medical Education Center,  Medical Assistant Specialist  Medical Insurance Billing and Coding Specialist  Dental Assistant Specialist

Motion made by Travis Powell and seconded by Cindy Landry to approve the foregoing new programs, subject to a satisfactory visit. Staff was also directed to request an updated catalog from Ross which gives required information to students on filing a complaint in KY.

Complaint Committee

The Complaint Committee set Tuesday, August 27, 2013 at 1:00 p.m. for its next meeting date.

Future Meeting Dates

It is anticipated the Process Committee will schedule a meeting for September to continue its work on developing new regulations.

Jim Jackson suggested the Commission schedule a work session in the coming months to go over budget, process, and general organizational issues.
