(6.1.4) MUNICIPAL ACCOUNTING SOFTWARE

WHEREAS the ASM software system is currently used by the Municipality;

WHEREAS this system no longer meets the needs of the Municipality;

WHEREAS the Municipality directly called for tenders from ASM and PG Solutions for a new software system;

WHEREAS only PG Solutions submitted such a proposal;

#108-07-2012 THEREFORE, BE IT RESOLVED that the Municipality accept the software system proposal made by PG Solutions, in the amount of $52,865.50, in addition to annual service fees totalling $12,101.12; AND that payments for the aforementioned are to be paid out as of January 2013.

(6.1.5) CLIMAT MUNICIPALITÉS PROGRAM

WHEREAS the Quebec Ministry of Sustainable Development, Environment and Parks, within the framework of the Climat Municipalités program, will pay a $50,000 subsidy in exchange for the Municipality’s participation in creating a greenhouse gas emissions inventory.

AND that the Municipality commit to reducing its environmental impact by enacting selected greenhouse gas reduction strategies.

2 (6.1.6) LINE OF CREDIT

WHEREAS the Municipality of Low currently has a line of credit of $300,000;

WHEREAS the Municipality wishes to increase the maximum amount available under this line of credit;

(6.1.7) PURCHASE OF FIRE TRUCK

WHEREAS the Municipality of Low as received approval by the Quebec Ministry of Finance of its proposed lease-to-own agreement for the purchase of a new fire vehicle, in the amount of $373,000;

WHEREAS the Municipality wishes to avoid paying extra leasing fees related to aforementioned vehicle and so therefore wishes to reach full ownership in the briefest possible time;

#111-07-2012 THEREFORE, BE IT RESOLVED that the Municipality utilise its line of credit to clear itself of financial obligations towards the Ministry of Finance by August 7th 2012, as related to the Municipality’s acquisition of its new fire vehicle.

WHEREAS notice of motion proposing new by-law 001-2012 was given at the regular meeting of the Council of the Municipality of Low on February 6th, by councillor;

WHEREAS Councillors have had time to review aforementioned by-law;

BY-LAW #003-2012

BY-LAW GOVERNING THE COLLECTION, TRANSPORTATION AND DISPOSAL OF WASTE ON THE ENTIRE TERRITORY OF THE MUNICIPALITY OF LOW

WHEREAS, the territory of the Municipality of Low is currently without a By-law concerning the temporary storage and disposal of household waste and bulky waste;

WHEREAS, the Council of the Municipality of Low wishes to implement the By-law number 003-2012 and this, in order to better reflect current realities and obligations of the Waste Management Program (WMP);

WHEREAS, in order to reduce the growing costs of waste collection and to encourage recycling, the Council of the Municipality of Low wishes to improve its management of waste, recyclables and other materials within its territory;

WHEREAS, this Council deems it appropriate and necessary to adopt the By-law;

CONSIDERING THAT a notice of motion was given at the regular Council meeting of Monday, February 6 th 2012, by Councillor Amanda St. Jean;

THEREFORE, it is proposed by Councillor Amanda St. Jean that the following rules be adopted:

ADOPTED UNANIMOUSLY BY COUNCILLORS AT REGULAR MEETING OF THE COUNCIL OF THE MUNICIPALITY OF LOW ON MARCH 6th 2012.

The Council orders and decrees as follows: l CHAPTER I: ADMINISTRATIVE AND DECLARATORY PROVISIONS

1.1 PREAMBLE

The preamble hereto forms an integral part for all legal purpose.

4 1.2 REPEAL OF PRIOR BY-LAWS

This By-law repeals and replaces for all legal purpose, any By-law or part of a By-law concerning the matters contained in this By-law.

1.3 PURPOSE OF BY-LAW

This By-law aims to establish the conditions for municipal collection, transportation and disposal of domestic waste, recyclables and dry materials on the entire territory of the Municipality of Low.

1.4 DEFINITIONS AND TERMS

Unless the context indicates otherwise or unless a declaration is otherwise expressly stated, words, terms or expressions have the meaning and significance given to them in this section. If a word, term or phrase is not specifically defined, it is used according to the meaning commonly attributed to the word, term or expression.

1.4.1 Wheeled bin: Plastic container on wheels, usually with a capacity of 360 litres, blue in colour and designed for receiving recyclable materials and be emptied using a mechanical device (transfer arm), as prescribed by this By-law.

1.4.2 Bundle: Freestanding or packaged assembly formed of dry materials within the meaning of this By-law, tied securely so that it can be handled easily by a single person. A bundle cannot be longer than 1.2 meters (+4 feet) and cannot weigh more than 25 kg (+55 pounds).

As a reference, but not limited to, clothing and rags can be bundled.

1.4.3 Closed box: Wooden or metal container fitted with a hinged lid for temporary storage of solid waste containers of between pickups. Containers must have a side or front door for easy access to the inside of the container. Doors must be accessible and maintained in good working order at all times by the owner.

The use of appliances (refrigerator, freezer, washing machine, dryer, etc.) as waste containers is prohibited as of July 2013.

The closed box must be located outside the right of way of municipal roads at all times.

1.4.4 Road: There are two types of roads in the territory of the Municipality, namely public roads and private roads, defined as follows:

a) Public roads are all roads found on the territory of the Municipality and which are known as roads that are under the jurisdiction of the Municipality or the province and maintained by these two bodies respectively;

b) Private roads are roads that are in private ownership and maintained by their owner or a group of owners who use them to access their respective properties. Waste collection services are made available to the residents of this type of road if they comply with the following provisions:

 The private road must be maintained in drivable conditions at all times so as not to slow down the pickup crew in the conduct of its business;

 In winter, it is the responsibility of the owner or group of owners to ensure that the road is cleared of snow the day of the collection and before the passage of the pickup crew. The owner or owners must also maintain the private road so that it is not slippery so that the private road can be used safely.

1.4.5 Container: A refuse receptacle commonly referred to as an ordinary garbage can, for directly receiving solid waste. It must be easily handled by a single person.

Containers are normally one of the following types:

a) A closed and leak-proof bin or container, made of metal or plastic, with handles and cover (hinged or not), whose weight when filled with solid waste does not exceed 25 kg (+55 pounds);

5 b) Household waste must be bagged and placed in a container. Recyclables must be put in blue wheeled bins. c) It is strictly forbidden to use a forty-five (45) gallon plastic or metal barrel as waste containers.

1.4.6 Collection: Operation which consists of taking containers of waste, recyclables, bulky waste and bundles placed along a roadway or in an accessible location, and loading them into a compactor truck, van or other vehicle deemed appropriate for such purpose by the Municipality.

1.4.7 Household Waste: Any solid waste, bulky wastes (art. 1.4.8) or bundle (art. 1.4.2).

It is strictly forbidden to include automobile frames or parts with household waste.

1.4.8 Bulky waste:

a) Any household appliances such as refrigerators, freezers, washers, dryers, stoves, or other similar objects containing metal in part or in whole.

b) Any household items such as electronics, televisions, computer systems, sound systems are recyclable and can be deposited at the provided site (art. 2.5.5).

1.4.9 Elimination of waste and recyclables: Way to definitely rid or eliminate domestic waste, recyclables and dry materials.

1.4.10 Enclosure: Metal screen, 2 meters high, designed to conceal containers or wheeled bins on three sides. The fourth side should be formed of two (2) hinged doors that open out, for easy access by pickup crew.

1.4.11 Temporary Storage: To store household waste and dry materials, for a period no longer than the usual time between two (2) pickups, in one of the locations determined by this By-law.

1.4.12 Contractor: Person or persons who hold a contract with the Municipality to collect, transport and dispose of solid waste, recyclables and bulky waste from residents of the Municipality.

1.4.13 IBI: Refers to Industries, Businesses and Institutions.

1.4.14 Building: A building within the meaning of the Act.

1.4.15 Recyclables: The recyclability of waste items are defined by the sorting centre where the Municipality forwards its waste materials, details of which the Municipality makes available to residents in the form of an explanatory guideline table.

1.4.16 Municipality: The Municipality of Low

1.4.17 Residents: Refers to owners, tenants or other occupants of a dwelling or building.

1.4.18 Hazardous household waste (HHW): Any hazardous material such as batteries, various oils, drugs, pills, syringes, aerosols, antifreeze, smoke or gas alarms, compressed gas cylinders of all kinds, cleaners, stain removers, , gasoline, fungicides, pesticides, herbicides, ammunition, paints, wood preservatives, solvents, varnishes, etc.

1.4.19 Transportation: Operation of transporting any waste and recyclables, collected within the Municipality, to a transfer station or other place designated by the Council of the Municipality.

1.5 PROHIBITION

It is forbidden for any occupant of any building in the territory of the Municipality to accumulate household wastes, recyclables, dry materials and other materials as defined in articles 1.4.7, 1.4.8 and 1.4.16 of this By-law.

Coal and ash cannot be included with household waste. These materials can be composted.

1.6 OBLIGATION

Occupants of any building in the territory of the Municipality must comply with the requirements of this By-law in relation to how to temporarily store and dispose of all household waste, 6 recyclables, dry materials and any other materials as defined in 1.4.7, 1.4.8 and 1.4.16 of this By- law.

1.7 OTHER APPLICABLE LAWS AND BY-LAWS

The fact of complying with the requirements of this By-law shall not have the effect of exempting any person or entity from implementing and enforcing any other applicable Act or By-law issued by a competent authority.

APPLICATION OF THIS BY-LAW

Employees of the Municipality of Low, as mandated by Council, are responsible for monitoring and enforcing this By-law. This mandate may also be delegated to the contractor in writing by the Municipality.

1.8 INSPECTION OF PROPERTIES

The officers responsible for implementing this By-law shall be allowed to visit and examine, between 7:00 am and 7:00 pm, any movable or immovable property, as well as interior and exterior of any dwelling, building or structure whatsoever, to ascertain if this By-law is being enforced, and to compel their residents to answer any questions regarding the application of this By-law, all in accordance with the powers granted to municipalities under section 492 of the Municipal Code (RSQ, c. C-27.1).

CHAPTER II: COLLECTION, TRANSPORTATION AND DISPOSAL OF HOUSEHOLD WASTE AND RECYCLABLES

2.1 ESTABLISHMENT OF A MUNICIPAL SERVICE

The Municipality shall establish a municipal contract for the door to door collection, transportation and disposal of domestic waste, recyclables and bulky waste, as defined in sections 1.4.7, 1.4.8 and 1.4.16, and in the manner prescribed in Chapter III of this By-law.

2.2 COLLECTION AND TRANSPORATION OF HOUSEHOLD WASTE AND RECYCLABLES

The collection, transportation and disposal of domestic waste and recyclables as established by this By-law is provided by the Municipality. However, the Council may, by resolution, authorize any person or contractor to collect all materials designated by it and on terms mutually agreed upon.

2.3 ELIMINATION OF HOUSHOLD WASTE AND RECYCLABLES

Residents remain responsible for their household waste, recyclables and bulky waste until their removal. Once collected, waste items become the property of the Municipality, who may then dispose of hem as it sees fit.

2.4 OPERATION OF THE MUNICIPAL SERVICE

The municipal service of collection, transportation and disposal of domestic waste and recyclables is provided on an ongoing basis. However the forms of taxation or compensation to cover the expenses related to this service is fixed for a period of 12 months by resolution and subject to change each year as voted by the Council of the Municipality.

2.5 FREQUENCY OF COLLECTION AND TRANSPORT

2.5.1 Collection of waste and recyclables for isolated dwellings and buildings which are classified as multiple housing

a) Household waste is collected between Monday and Friday, from 7:00 am to 6:00 pm, on a determined schedule.

b) Recyclables are collected between Monday and Friday, from 7:00 am to 6:00 pm, on a determined schedule.-

2.5.2 Collection of waste and recyclables for IBI buildings

7 The service of removal of garbage and recyclable materials will be performed Monday through Friday, between 7:00 am and 6:00 pm, on a pre- determined schedule.

2.5.3 Collection of bulky waste

The service for bulky waste collection, excluding manufacturing of metal objects as defined in section 1.4.8 of this By-law, is carried out simultaneously with the regular collection of household waste and is subject to the frequency of collection as determined in articles 2.5.1 and 2.5.2 of this By-law.

2.5.4 Disposal of HHW

A voluntary collection point is at the disposal of the public for disposal of HHW at the Municipal Office, weekdays between 8:00 am – noon and 1:00 pm - 4:00 pm.

Accepted HHW are:

 Paints sold either in retail stores (100 ml containers and more) or available in stores in bulk (containers of less than 180 litres for architectural use only);  Non-exhaustively: primers, paints (latex, alkyd, enamel, rust, aluminum or other), stains, varnishes and lacquers;  Products or preparations for the treatment or preservation of wood or masonry, including acrylic driveway sealants;  Marking paints (those available in retail stores);  Dry cell batteries and mercury (rechargeable or not);  Compact fluorescent bulbs;  Fluorescent tubes;  Computers, monitors and televisions

CHAPTER III: SPECIAL PROVISIONS APPLICABLE TO WASTE AND RECYCLABLES

3.1 DUTY TO PLACE RECYCLABLES IN A CONTAINER

All recyclable materials must be placed in a bin as identified by articles 1.4.1, 1.4.3 and 1.4.5 of this By- law, as they are discarded.

3.1.1 The Municipality will provide one (1) 360 litre blue wheeled bin, per housing unit. Each building will have a sufficient number of blue bins, provided by the Municipality and paid for by the owner of the building. These bins are mandatory for the disposal of recyclables.

3.1.2 Solid waste or recyclable materials will be prepared for collection by the resident.

A collection system by centralized repository may be established or authorized by the Municipality for specific sectors where collection from door to door is not possible. Location, container type and methods of disposal specific to these centralized repositories will then be determined by the Municipality.

3.1.3 The Municipality will provide, as appropriate, an indeterminate number of 360 litre blue wheeled bins for institutional recycling programmes. Each IBI building will have a sufficient number of bins, provided by the Municipality and paid for by the owner of the building. These bins are mandatory for the disposal of recyclables.

3.2 LOCATION OF BINS ALONG PUBLIC ROADS

The bins must not impede traffic or hinder snow removal during the winter. Residents are responsible for ensuring maintenance and snow removal of the area around their bin or bins.

3.3 TEMPORARY STORAGE BETWEEN COLLECTIONS

Residents are permitted to leave their waste containers in storage between collections, as described by article 1.4.3 or article 1.4.5, on the edge of their property or private road.

3.4 CLEANLINESS OF CONTAINERS, BOXES AND WHEELED BINS

8 Waste containers, wheeled bins and garbage boxes shall be washed and disinfected regularly, by the resident, so as to prevent contamination and fermentation.

Residents are responsible for picking up all scattered litter in the event of rodents or other animals overturning all or part of the contents of their container, box or bin.

3.5 DUTY TO SORT WASTE FROM RECYCLABLES

Residents must sort their waste materials so as to separate recyclables from other waste types, as these require distinct collection operations.

CHAPTER IV: SPECIAL PROVISIONS APPLICABLE TO TEMPORARY STORAGE PENDING COLLECTION, TRANSPORATION AND DISPOSAL OF DRY MATERIALS AND HHW

4.1 DISPOSAL OF HAZARDOUS HOUSEHOLD WASTE (HHW)

Residents needing to dispose of HHW not included in article 1.4.18 can do so by voluntary deposit to the Eco-Centre of their MRC (Vallée de la Gatineau, in Maniwaki), the City of Gatineau Eco- Centre (860 de la Carrière Boul.) or other such appropriate location.

Residents are bound by the present By-law to use the HHW disposal service provided by the Municipality or by any other association created for the same purpose.

HHW should never be left in containers used for regular collection, and must not be included with recycled or compostable materials, or be sent to landfills.

CHAPTER V: SPECIAL PROVISIONS APPLICABLE TO TEMPORARY STORAGE, TEMPORARY DISPOSAL AND DISPOSAL OF USED TIRES

5.1 TIRES

The municipal service established by this By-law shall preclude the collection, transportation and disposal of tires.

Owners or residents shall remove and transport discarded tires to an authorized disposal or storage location. The Municipality can also conclude, at the owner’s expense, an agreement with any contractor or firm specializing in the recovery of used tires, in order to have them moved to an authorized disposal or storage location.

5.1.1 Building or premises intended for trade in tires

For any building or premises used in whole or in part in tire trade, in all its forms (sales, purchase, installation, repair, etc.), discarded tires must be stored temporarily inside either a building or an enclosure provided for this purpose located along the wall behind the main building. Tires stored in this manner are to remain out of sight from a public roadway.

CHAPTER VI: PROVISIONS APPLICABLE TO THE DISPOSAL OF WASTE IN PLACES EXCLUDED FROM THIS BY- LAW

6.1 It is strictly forbidden to discard waste in ditches bordering all types of roads, in forests, or in garbage containers or wheeled bins located on public or private property destined for use by the public. Articles 1.4.7, 1.4.8, 1.4.16, and 1.4.19 provide information on authorised disposal places.

Any person or entity that contravenes this disposition commits an offense and may be issued a violation notice under article 7.1 of this By-law, without any duty to issue prior warning or other notice. In addition, the offender must pay all applicable fees for cleaning, removal and disposal of the materials which are the subject of non-compliance.

CHAPTER VII: FINAL PROVISIONS

7.1 VIOLATIONS AND FINES

Any person or entity who contravenes any provisions of this By-law commits an offense.

After issuing two prior notices for the same offense, a fine may be issued, except in cases of violations of article 6.1, which are not subject to this disposition. 9 Any breach of this By-law is punishable by a minimum fine of $ 20 per day. If the offense persists, each additional day constitutes a separate offense.

Fines, in the case of a first offense, may not exceed $ 500 if the offended is an individual; or $ 1,000 if the offender is a corporation. Subsequent offenses are liable to be fined a maximum of $ 1,000 for individuals; or $ 2,000 for corporations.

7.2 EFFECTIVE

This By-law shall take effect on the day of its publication in accordance with the Act.

(6.6.3) TAX EXEMPTION WHEREAS the Municipality has exempted the L.V.B.R.A. from taxes in past years;

WHEREAS residents of the Municipality greatly benefit from the services and activities offered by the L.V.B.R.A.;

WHEREAS a municipal committee is currently analysing considerations related to this practice, but recognises its duty to be diligent in providing an answer to this individual request;

10 #116-07-2012 BE IT RESOLVED that the Council of the Municipality of Low grant the Low, Venosta and Brennan’s Hill Recreation Association an exemption from 2012-2013 Property Tax payments.

#118-07-2012 BE IT RESOLVED that the Municipality of Low hire Jonathan Murdock through the Emploi-Québec Salary Subsidy Program, at the rate of $11 per hour.

MOVED BY Councillor Maureen Rice ADOPTED UNANIMOUSLY BY COUNCILLORS (6.6.7) TAX EXEMPTION WHEREAS residents of the Municipality greatly benefit from the services and activities offered by the Central Gatineau Arena Association;

WHEREAS the municipal committee which is currently analysing considerations related to this practice requests that the council of the Munipality statute on the merits or the individual tax exemption request made by the Central Gatineau Arena Association ;

#119-07-2012 BE IT RESOLVED that the Council of the Municipality of Low grant the Central Gatineau Arena Association an exemption from 2012-2013 Property Tax payments.
