5 ORDINANCE 2007-551-E 6 AN ORDINANCE REGARDING THE ARLINGTON ROAD TOWN 7 CENTER PROJECT; APPROPRIATING $140,000 FROM 8 BETTER JACKSONVILLE PLAN DISTRICT 7 9 DISCRETIONARY FUNDS, TO CONTRIBUTE TO FUNDING 10 PHASE III CONSTRUCTION COSTS FOR THE PLANNING 11 DISTRICT 2 TOWN CENTER (ARLINGTON ROAD) 12 PROJECT; PROVIDING FOR A CARRYOVER TO FISCAL 13 YEAR 2007-2008; PROVIDING FOR A REVERTER; 14 AMENDING THE 2006-2011 FIVE-YEAR CAPITAL 15 IMPROVEMENT PROGRAM APPROVED BY ORDINANCE 16 2006-789-E, FOR THE PROJECT ENTITLED “PLANNING 17 DISTRICT 2 TOWN CENTER” TO RECOGNIZE 18 ADDITIONAL FUNDING; PROVIDING FOR OVERSIGHT BY 19 THE DEPARTMENT OF PUBLIC WORKS; PROVIDING AN 20 EFFECTIVE DATE. 21
22 WHEREAS, the Council has, through the Town center Initiative, 23appropriated two million dollars to Planning District 2; and 24 WHEREAS, there are four Town Center projects in Planning 25District 2; and 26 WHEREAS, the Town Center Initiative allows for up to $25,000 27for Phase I Visioning, $146,250 for Phase 2 Design, and $828,750 28for Phase III Construction; and
3 1 Amended 6/12/07 1 WHEREAS, the improvements planned for the Planning District 2 2Town Center (Arlington Road) are integral components to the 3revitalization of the Old Arlington commercial corridor; and 4 WHEREAS, from the time of the initial funding allocations, 5construction costs have increased dramatically causing a projected 6shortfall for the Phase III Construction portion of the Planning 7District 2 Town Center (Arlington Road), and the Council finds that 8a contribution of District 7 Bond Funds serves a valuable public 9purpose; now therefore 10 BE IT ORDAINED by the Council of the City of Jacksonville: 11 Section 1. Appropriation. For the 2006-2007 fiscal year, 12within the City’s budget, there are hereby appropriated the 13indicated sum(s) from the account(s) listed in subsection (a) 14to the account(s) listed in subsection (b): 15 (a) Appropriated from: 16 Better Jacksonville Plan 17 District 7 Discretionary Funds

Carryover. The funds appropriated in this 24ordinance shall not lapse, but shall carryover into fiscal year 252007-2008.
26 Section 3. Reverter. All funds not used on the project 27set forth in this ordinance shall revert to the account of origin. 28 Section 4. Purpose. The purpose of the appropriation 29set forth in Section 1 is to provide a contribution toward the 30Phase III Construction costs of the Arlington Road Town Center

2 Section 5. CIP Amendment. Ordinance 2006-789-E, being the 32006-2011 Five-Year Capital Improvement Program for the City and 4certain of its independent agencies, is hereby amended to recognize 5additional funding for the project entitled “Planning District II 6Town Center.” This project is more fully described in Revised 7Exhibit 1, attached hereto and incorporated herein by this 8reference. This ordinance shall constitute an amendment to 9Ordinance 2006-789-E. In all other respects, the Five-Year Capital 10Improvement Program approved by Ordinance 2006-789-E shall continue 11in full force and effect. 12 Section 6. Appointment of Oversight Department. The Mayor 13is requested to appoint the Public Works Department to oversee the 14expenditure of the additional funds appropriated herein. 15 Section 7. Effective Date. This ordinance shall 16become effective upon signature by the Mayor or upon becoming 17effective without the Mayor's signature. 18Form Approved: 19
