TENDER FOR HIRING OFFICE ACCOMMODATION AT ROHTAK

Central Excise & Service Commissionerate, Rohtak, Haryana invites bids from the legal owners/power of attorney holders of premises for hiring of accommodation having a desirable carpet area shown in the below given table for an initial period of 3 (Three) years. The premises should be in the Rohtak City, located on a four lane road preferably nearer to a public transport facility and should be befitting to house a public office-accessible to people with physical disabilities.

Interested parties having clear title may download the Technical Bid and Financial Bid formats from CBEC website “http://www.centralexcisedelhi.nic.in” under link “http://www.centralexcisedelhi.nic.in/rohtak/tender_index_rohtak.htm”. The detailed terms and conditions of the tender are given in the said website. The offer in sealed cover comprising Technical Bid and Financial Bid (each in separately sealed cover superscribed as “Technical Bid” and “Financial Bid” for hiring office space for Central Excise & Service Commissionerate, Rohtak, complete in all respects may be submitted in person/registered post/speed post/courier so as to reach the undersigned to the above mentioned address on or before 15.00 Hrs on 27.04.2015. Offers received beyond the specified date/time shall not be entertained and Central Excise & Service Commissionerate takes no responsibility for delay/loss of document sent by post/courier.

Priority would be given to the premises belonging to Public Sector Units/Govt. Departments/ Public Financial Institutions. The lease agreement format of Govt. of India will be strictly adhered to. Being a Central Government Office, no security deposit/advance payment will be paid for the purpose of hiring the premises. No brokerage will be paid. The technical bids will be opened on 27.04.2015 at 15.30 Hrs. Financial Bids of only those bidders whose technical offers are found valid, eligible and acceptable shall be opened. Central Excise & Service Commissionerate, reserves right to reject any or all bids without assigning any reasons thereof.

The tender document consists of three parts:

Part A – Terms and conditions

Part B - Technical bid

Part C – Financial bid

Both Part B and C should be sealed in separate envelopes and superscribed in bold letters:

a. Technical bid for hiring office accommodation for Central Excise & Service Commissionerate, b. Financial bid for hiring office accommodation for Central Excise & Service Commissionerate,

Both these envelopes should be then placed in a single sealed cover superscribed “Tender for hiring office space for Central Excise & Service Commissionerate”.

Tenders (Technical Bid only) will be opened on 27.04.2015 at 15.30 Hrs in the presence of Bidders / representatives of bidders who choose to be present at Commissioner, Central Excise & Service Tax Commissionerate, SCO 6, Sector-1 Market, Rohtak, Haryana. All Bidders/ representatives of bidder are advised in their own interest to be present on the said date, time and venue for opening of the Technical Bid. Financial bids of only those bidders whose technical bids are found valid, eligible and acceptable shall only be opened.

Part A: TERMS AND CONDITIONS

1. The Terms and conditions shall form part of tender to be submitted by the bidder to the Commissioner, Central Excise & Service Tax Commissionerate hereinafter as “Commissioner”

2. All bidders are requested to submit the tender document (Technical & Financial bids) duly filled in with relevant information supported by relevant documents at the following address:

3. All columns in the tender document should be duly filled in and no column should be left blank. “NIL” or “Not applicable” should be marked, where there is nothing to report. Each page of the tender document (i.e. Part B and C) should be signed by the owner or his authorized power of attorney. Any other cutting or use of white ink should be duly initialed by the bidder. The Commissioner reserves its right to reject the incomplete tender or in case information submitted is found to be incorrect. 4. In case space in tender document is found to be insufficient, the bidder may use separate sheet to provide full information.

5. Tender documents received by Commissioner after due date and time i.e. 15.00 Hrs on 27.04.2015 shall be rejected outright and no correspondence in this regard shall be entertained.

6. The offer should remain valid for six months. During the validity period of the offer, the bidder should not withdraw / modify the offer in terms of area and price and other terms and condition quoted in the Technical or Financial bids. The bidder has to submit an undertaking on non-judicial stamp paper of requisite value duly signed by legal owner or his power of attorney holder that the bidder shall not back out / cancel the offer / offers made to Commissioner during the validity period.

7. There should not be any deviation in terms and condition as have been stipulated in the tender document.

8. The tender will be acceptable only from original owner of the building or having valid power of attorney. The space offered should be free from all encumbrances/claims and disputes /any liability and litigation with respect to its ownership, lease / renting and pending payments against the offered space.

9. Offers received from Government Bodies / Public Sector Undertakings / State Housing Boards etc. would be given preference.

10. The building offered should be as per the requirement as mentioned below:

Carpet Area means area of premises less toilets, passages, walls / columns, stair cases, verandah, lobby, balcony, kitchen, portico, sanitary, shafts, lift arches, air conditioner ducts, lofts etc.

11. The building offered should be ready for immediate occupation. The areas offered should preferably on independent building floor(s).

12. The building should have separate electricity and having sufficient installed electricity load and water connection. If separate connection is not available sub- meter etc. to be got installed by the owner along with wiring.

13. The building should have adequate parking space in front and rear of the building without any additional rental overheads, for the Commissioner’s visitors, employees etc.

14. Independent buildings with guaranteed possession will be preferred.

15. The payment terms mentioned in the financial bid shall be strictly followed and no deviations will be allowed. 16. The rent will be subject to issue of Fair Rent Certificate by CPWD as per procedure laid down by the Govt.

17. Canvassing in any form will automatically disqualify the offer. No brokerage will be paid.

18. The particulars of amenities provided/proposed to be provided inside the property / building complex should be clearly furnished in the Technical Bid.

19. The Technical Bid is required to be submitted along with certified copies of approved drawings from Municipal Corporation authorities or any other competent authority, certified copy of Land Deed, Municipal receipts, and approved plan of building and copy of ownership of building. Technical Bids received without these documents are liable to rejection without any reference to the party whatsoever. Originals of these documents / certificates shall be produced at the time of execution of Lease Agreement.

20. The bidder is required to enter into Lease Agreement in the prescribed format approved by the Central Government.

21. After screening of the technical bids, shortlisted bidders will be informed by Commissioner for arranging the site inspection of the offered premises. After site inspection, the financial bids of the offers considered to be suitable for Commissioner shall only be opened.

22. All existing rates, taxes insurance fee including public liability insurance, including property taxes, assessment charges and other outgoings whatsoever of description in respect of the said premises payable by the owner thereof, shall be continued to be paid by landlord.

23. Maintenance of premises to be made (externally) by the owner.

24. The bidder shall provide partitions, office fixtures and fittings for officers and staff as per requirement of the Commissionerate at his own cost before handing over possession to the Commissionerate

25. Being a Central Government Office, no security Deposit / advance payment will be paid. The quotes of bidders who insist on advance deposit may not be considered for further evaluation.

26. The office space should have all required electrical fixtures such as switches, power points, fans, lights etc.

27. The maintenance (civil, electrical, mechanical, plumbing including consumables etc.) shall be provided by the owner and the owner will also undertake to carry out annual repair and maintenance every year. No additional charges shall be paid for the same.

28. The building should have adequate toilet facilities. 29. The building should be in a ready to use condition with electricity, water, painted, sewerage. The electric power available should also be indicated. The owner / landlord shall provide separate electric meter, separate water meter and sewerage connections at his own cost before handing over possession to the Commissionerate. These connections should be in the name of the owner / landlord and the consumption charges of the water supply, electricity and sewerage shall paid by the Commissionerate.

30. The owner / landlord shall provide adequate electric power load as per requirement of the Commissionerate at his own cost before handing over possession to the Commissionerate. If additional electric power load is required by the Commissionerate later on (i. e. after taking over possession with electric load of required capacity) within the lease period, the same shall be arranged by the owner / landlord at his own cost.

31. The location should be in area convenient for office use and should be easily accessible.

32. No tender will be accepted by fax, email, telex or any other such means.

33. Tender is likely to be rejected because of non-fulfillment of any of the above terms.

34. Lease agreement will be executed after legal verification of all documents related to the property to the entire satisfaction of Commissionerate. The registration charges, stamp duty for registration of lease deed to be borne by the owner /landlord.

35. Commissionerate shall have the right to carry out necessary alterations/modifications or make such structural or other changes to/in the premises as may be required by it for the purpose of its functioning.

36. Commissionerate shall have the right to install satellite dishes / communication towers and other communication equipment etc. as deemed necessary by the Commissionerate for facilitating electronic communication and / or Core Commissionerate as also installation of power generating / amplifying devices including but not restricted to power transformers, Power Generators etc. as well as placing of sign boards, Commissionerate 's boarding / publicity materials. ACs etc. in the terrace for its activities and the owner / landlord will have no objection of any kind whatsoever and shall not claim any compensation or additional rent but however if any damage is resulted upon the demised premises due to such activities, the Commissionerate would be liable to repair the damage so caused, normal wear & tear is however excepted.

37. Since Commissionerate is the lessee / hire and has no insurable interest, the owner / landlord hereby has to insure the premises / assets rented / hired against risks like burglary, fire or natural calamity at his (owner’s) own cost and the Commissionerate will not be responsible for and liable to make good any losses that may be sustained in any future date in respect of such premises/assets.

38. Painting of the premises including front and back verandahs, bath rooms, toilets, boundary wall, the entire exterior facade and painting or polishing of all doors, windows, ventilators, grills etc. as may be desired by the Commissionerate will be carried out by the owner / landlord once in two years within the lease period. In case the owner / landlord fails to do so, the Commissionerate shall have the right to arrange it at the cost of the owner/landlord and deduct the amount from the rent payable or that may become payable, or otherwise recover from the owner/landlord.

39. The premises should be equipped with fans in all the rooms of the building. If fans are not installed at the time of bidding, the bidder shall provide fans before occupation of the premises by Commissioner.

40. During the currency of the lease agreement the owner / landlord shall not transfer, mortgage, sell or otherwise create any interest in the premises leased to the Commissionerate with any party affecting Commissionerate’s right of occupation and any of the terms of the lease without written consent of the Commissionerate.

41. That if the landlord is desirous of making any addition to the building it shall be ensured by him that no access / approach by whatever means from the demised portion or by encroaching upon the open spaces which been available to the exclusive use of the Commissionerate.

42. All disputes lie within the jurisdiction of Rohtak, Haryana only. The Commissioner reserves the right to reject all or any tender without assigning any reason thereof. PART-B

2. Certified copies of approved drawings from Municipal Corporation authorities or any other competent authority of the area offered for rent/hire, certified copy of Land Deed, Corporation tax receipts and copy of ownership of building.

3. Affidavit from owners and if tender is submitted by the power of Attorney Holder, an Affidavit from such power of Attorney Holder regarding premises offered for hiring being free from any litigation / liability / pending dues and taxes.

4. Undertaking for agreeability to fixation of rent as per Govt. Rules / CPWD and for rent on initial hiring to remain in force for the initial lease period of three years.

5. Any other documents which bidder wants to give to substantiate the details given in his bid application.
