What is a Variation? A Variation is a deviation from the approved standards stipulated in the Noise Pollution Control Rules 2001 for given areas. A Variation Application is only deemed necessary when there is an upcoming event that will exceed these standards.

When one should apply for a variation? An application for a variation should be made when amplifying equipment is being used.

How long before an event should an application for a variation be made? An application for a variation with respect to an event or activity must be submitted at least 28 days (4 weeks) before the date of the event or activity. A Notice of the event must be placed in one daily newspaper in a form prescribed by the EMA for at least two (2) consecutive days and a minimum of 35 days (7 weeks) before the date of the event.

What cost is associated with an application for a variation? The prescribed fee for a variation is $250 per event/day.

Where payment can be made and in what form? Payment can be made at the EMA at #8 Elizabeth Street, St. Clair by cash or certified cheque or at any branch of First Citizens Bank (Account # 1183848). The original receipt must be submitted as proof of payment from the bank.

Where can one obtain the application forms? Applications for a variation can be collected at any one of our two offices located at:  8 Elizabeth Street, St. Clair and  2 Dumfries Road, La Romain.

How should the variation application be completed? A Variation application should be completed in block (capital) letters and signed by applicant or applicant’s agent or applicant’s attorney. If one is applying on behalf of a company, the company’s stamp should be furnished in the appropriate area on the application. Two (2) copies of the Variation application and its attachments with the fee must be submitted to the EMA. What must be attached along with the application? (2 copies)  Photo – identification of applicant or applicant’s agent or applicant’s attorney  A clearly labeled map or plan depicting the land use of the areas that are North, South, East and West of the venue; as well as any motorways, buildings and residents which are in close proximity of the vicinity.  Newspaper notices – full page to be submitted  Registrar’s Certificate furnished by the Registrar of Companies where the applicant is a company.
