1. 2. Objectives 2.1 Overall Objective(s):

The overall objective is to strengthen institutional and operational capacity of the Paying Agency for Agriculture, Fisheries and Rural Development (former Directorate for Market and Structural Support in Agriculture1) in order to insure the implementation of EU Common market organisation for selected agricultural commodities when Republic of Croatia becomes an EU member state.

2.2 Project purpose:

Preparation of the Paying Agency for Agriculture, Fisheries and Rural Development (PAAFRD) for administration of the EU internal market measures in following sectors: sugar, milk and milk products, beef and veal, fruit and vegetables, wine as well as export refunds for Non-Annex I products.

2.3 Contribution to National Development Plan/Cooperation agreement/Association Agreement/Action Plan

The Stabilization and Accession Agreement (SAA) was ratified in 2001 after the negotiation during the Stabilization and Accession Process which was launched in 1999. The SAA sets political conditions for Stabilization and Accession between the European Communities and its Member States and Republic of Croatia. The SAA represents the legal basis and content framework of relations between the Republic of Croatia and the European Communities. The agreement is therefore a first step toward institutionalizing the relations with the European Union and allows the gradual preparation of Croatia for the achievement of full membership in the EU. Furthermore, Croatia has developed a National Program for the Accession of the Republic of Croatia into the EU (NPIEU) which is prepared on yearly basis. Detailed description of short- and mid-term priorities within NPIEU 2009 is given in chapter 3.1 The Accession Partnership, within its short-term priority suggests to start developing a strategy for establishment of effective and financially sound paying bodies for the management and control of agricultural funds, in line with EU requirements and international auditing standards, setting up a proper land parcel identification system and animal identification system in line with the acquis communautaire, as well as to draft a strategy for rural development and instruments for drafting, implementation, management, monitoring and evaluation of the rural development programme. It also sets the medium term priorities which are: to strengthen the administrative structures needed to

3. Description 3.1 Background and justification:

On the day of accession to the European Union, Republic of Croatia will need to have established fully operational system for the implementation of the Single Market Organisation, as a part of the First Pillar of the Common Agricultural Policy. To achieve this objective, responsible national institutions have to undergo long and resources-consuming preparations with a view to design, set up and test the system, as well as to train the administration staff and inform future beneficiaries. This meticulous process could be significantly facilitated by EU guidance, particularly when it comes to better understanding of the measures and of critical points in the set-up and implementation of the system. The proposed project should assist PAAFRD (principally Sector for Market Support/SMS, Control Sector and Financial Sector) in preparation of written procedures and implementation of the chosen CMO regimes (sugar, milk and milk products, beef and veal, fruit and vegetables, and wine), respective trade mechanisms and introduction of export refunds. As presented in the “Action plan for the harmonization with the common organisation of agricultural markets in the European Union”, submitted to the Commission by the Ministry of Agriculture, Fisheries and Rural Development (MAFRD1) in June 2009, SMS is responsible for the implementation of CMO measures: trade mechanisms (export/import licences, export refunds, import quota and securities management), public intervention and private storage, special intervention measures and aid schemes; support to production groups and organisations and implementation of production limitation systems (in the milk and sugar sector). At this time only lesser part of the CMO-compatible schemes is implemented in Croatia, while there is still a considerable disparity between drafted procedures and required accreditation package of the Paying Agency. According to the Action plan and the findings of the Peer Review 2009 (Evaluation mission on action plan for CMO implementation in Croatia) gap assessment is as follows: a) sugar sector: Croatian sugar market is not regulated in the CMO-compatible manner (no production quotas, no production charge, no monitoring of the market, no approval/control of operators, no provisions on sugar produced out of quota, no provision on above-quota surpluses, no reference/intervention price for sugar beet or sugar, no stipulations for the purchase, delivery and payment for sugar beet). Drafting of implementation procedures hasn’t started yet in any respect (seeing that the national sugar quota will be allocated among Croatian sugar companies prior to accession to the EU, and that the productions quotas system will be fully operational from the date of accession, PAAFRD has to start without delay with relevant preparations); b) public interventions system: regulated and set-up only for cereals (and for other products on the basis of ad hoc governmental decisions in case of market disturbances). There is no intervention system for sugar, beef, butter and skimmed milk powder. Therefore the a/m Action plan stipulates that the Paying Agency will prepare written procedures in 2010 for the intervention system in the beef and veal sector, sugar and milk sector; c) private storage: no aid scheme for private storage in Croatia; d) milk sector: implementation procedures for the milk quota system have been drafted with the support from the PHARE 2005 Project (see Point 3.2), but there are no other written procedures outside the quota regime (school milk system, public intervention in butter and skimmed milk, private storage, distribution to most deprived persons, use of casein); e) fruit and vegetable sector: no EU-compatible producer groups, organizations or interbranch organizations recognized so far in Croatia, no school fruit scheme defined and prepared, no procedures drafted for recognition and further support to producer organizations and interbranch organizations thus far; 2 f) wine: neither support programmes in the wine sector defined nor respective procedure manual drafted; no system for the provision of information and promotion in the wine sector established; g) export refunds: although Croatia is not entitled to implement export refunds in the pre-accession phase it is crucial to prepare their introduction (export refund nomenclature and national implementing provisions; tendering of export refunds, controls; export refunds for Non-Annex I products). Due to limited scope of the proposed project, there is a range of commodity regimes that will have to be dealt with separately, such as olive oil and table olives, apiculture, flax and hemp, tobacco, dried fodder, hops, pig meet, sheep meet, eggs and poultry meat sectors. Respective procedures will have to be prepared by DMSSA experts alone or with the assistance of existing bilateral programmes (with France – see Point 3.2) and TAIEX.

3.2 Linked activities (other international and national initiatives):

Various projects were conducted and are still being implemented within the Ministry of Agriculture, Fisheries and Rural Development (MAFRD2): 1) The completed CARDS 2002 twinning project “Operational Capacity Building within the Ministry of Agriculture, Forestry and Water Management” enhanced the operational and administrative effectiveness of the MAFWM in fulfilling its obligations under the SAA and in benefiting from pre-accession support for agriculture and rural development. 2) Furthermore, MAFWM employees participated in the CARDS 2002 Project “Development of Public Internal Control and Internal Audit”, whose purpose was to help the Ministry of Finance in developing policy, organisation, procedures and methods in line with internal financial control in the public sector. Other objectives were to enable state internal auditors to access the methodology of internal audit in accordance with the international audit standards and to establish a sustainable education program and certification system for internal auditors. Six employees of MAFWM were involved in the education process for acquiring a certificate of internal auditors. They were also engaged in a pilot project accomplishing the first internal audit in MAFWM. 3) Project CARDS 2003 “Capacity Building of the SAPARD Agency within MAFWM” provided assistance to the DMSSA in the pre-accreditation and accreditation process for the SAPARD Agency. Second objective of this project was to upgrade the knowledge of DMSSA staff on implementing the SAPARD programme as regards selection, contracting, payment, as well as controlling of projects. 4) Within the scope of bilateral aid from France, starting from the year 2004 there is a still on- going project that provides MAFWM with technical assistance (advisor) in preparing the process of accreditation of the Directorate for Market and Structural Support in Agriculture as the Paying Agency. 5) In addition, PHARE 2005 PPF Project “Support to SAPARD/IPARD Agency for SAPARD/IPARD programme implementation” was implemented in the DMSSA, aimed to strengthen preparations of the Croatian public administration and institutions with a view to ensure the Common Agricultural Policy (CAP) implementation after the accession, having a specific objective to support the SAPARD/IPARD Paying Agency in improvement of SAPARD/IPARD programme implementation. 6) The only EU-financed project that had a component dedicated to the preparation of DMSSA for the implementation of CMO system was PHARE 2005 project “Institutional capacity building and support for implementation of SAPARD/IPARD programme in the Republic of Croatia” (carried out in DMSSA from October 2007 to July 2009). Its main purpose was to strengthen capacities of the Program Managing Authority for SAPARD and IPARD programmes, enabling them to carry out tasks and responsibilities linked to coordination and management of EU co-financed rural

3 development programmes, and also to build up and strengthen institutional capacities of the SAPARD/IPARD Paying Agency, enabling implementation of EU co-financed rural development programmes and preparation for the transfer of nationally funded schemes to an EU-compatible paying agency. One of the Project's components was the CMO component, which covered four chosen commodity systems (cereals, milk-with the emphasis on milk quota, fruit and vegetables and wine), and trade mechanisms as a horizontal activity (import/export licensing and quota management). Main outputs of this component were trainings held for relevant MAFRD/DMSSA staff in respect to selected CMOs and trade mechanisms, as well as guidelines provided in respect to drafting relevant national legislation in line with the EU CMO and operational procedures as a part of preparation for the PA’s accreditation. When it comes to the wine sector, the proposed Project will work out in details issues that were not covered by the PHARE 2005 (due to the wine CMO reform in 2008/2009). Likewise, the proposed fruit and vegetables agenda brings new items (such as school fruit scheme and licensing) and gives details to recognition and monitoring of producer groups and organisations beyond the scope of the former project.

3.3 Results:

The results to be achieved by this Twinning contract are as follows:

1. Administrative system for the implementation of the CMO in sugar sector is established:

1.1 detailed knowledge regarding CMO in sugar gained, particularly in respect to quota system, quota allocation, management of production charge, excess of quota, interventions and price reporting; practical experience of other MS acknowledged; 1.2 guidelines for drawing up procedure manuals for management of sugar quota system drafted, including basic control plan and provisions on transmission of information to the Commission; 1.3 administrative system set up and procedure manuals drafted for the approval of operators (producers and processors) in the sugar system including management of production charge; 1.4 administrative system set up and procedure manuals drafted in respect to use of out-of- quota sugar for chemical industry; 1.5 guidelines drafted (with critical points included) in respect to on-the-spot controls of operators in the quota system; 1.6 existing procedure manuals for trade mechanisms in sugar sector (export/import licences and export refunds) reviewed and commented

2. Administrative system for the implementation of the CMO in beef and veal sector is established:

2.1 detailed knowledge regarding CMO in beef and veal gained; practical experience of other MS acknowledged; knowledge regarding other meat sectors enhanced; 2.2 administrative system set up and procedure manuals drafted for the buying-in, storage and disposal under public intervention of beef and veal products; 2.3 procedure manuals for management of aid for private storage drafted; 2.4 guidelines (with critical points included) drafted in respect to classification of beef carcases and reporting of prices thereof; 2.5 guidelines (with critical points included) drafted in respect to on-the-spot controls in beef and veal sector; 2.6 existing procedure manuals for trade mechanisms in beef and veal sector (export/import licences and export refunds) reviewed and commented.

4 3. Administrative system for the implementation of the CMO in milk and milk products outside milk quota is established:

3.1 detailed knowledge regarding milk CMO outside milk quota gained (school milk system, public intervention in butter and skimmed milk, private storage, distribution to most deprived persons, use of casein); practical experience and critical points in other MS acknowledged; 3.2 administrative system set up and procedure manuals drafted for the school milk scheme; 3.3 administrative system set up and procedure manuals drafted for distribution to most deprived persons; 3.4 guidelines and critical points drafted in respect to intervention on the market in butter and skimmed milk powder, private storage aid for butter and use of casein in the manufacture of cheeses; 3.5 guidelines (with critical points included) drafted in respect to on-the-spot controls in milk and milk products sector 3.6 existing procedure manuals for trade mechanisms in milk and milk products sector (export/import licences and export refunds) reviewed and commented.

4. Administrative system for the implementation of the CMO in fruit and vegetables sector outside marketing standards is established:

4.1 detailed knowledge regarding CMO in fruit and vegetables outside marketing standards gained; practical experience and critical points within other MS acknowledged; 4.2 system of recognition and monitoring of producer organisations and producer groups set up and respective procedure manuals drafted; case-study developed for an operational programme: (drafting, evaluation, approval, monitoring, reporting); 4.3procedure manuals for managing producer organisations and producer groups’ payments (including lodging of security for advance payments) drafted; 4.4 school fruits scheme set up and respective procedure manuals drafted; 4.5 guidelines (together with critical points) drafted in respect to the on-the-spot checks, recovery of undue payments and communication with the EC; 4.6 existing procedure manuals for trade mechanisms in fruit and vegetables sector (export/import licences) reviewed and commented. 4.7 guidelines drafted for establishment of communicating prices of imported products for the application of the entry price system

5. Administrative system for the implementation of export refunds for Non-Annex I products is established:

5.1 knowledge regarding export refunds system for Non-Annex I products enhanced, especially in respect to calculation of export refunds according to particular ingredients of processed products; 5.2 existing procedure manuals for the management of export refunds of Non-Annex I products revised and commented; 5.3 guidelines for the calculation of export refunds and control in case of by-products declared in declarations of ingredients provided; 5.4 recommendations and guidelines regarding additional declarations of origin of basic products used in processed products provided; 5.5 pilot IT application for the management of export refunds analysed and commented.

5 6. Administrative system for the implementation of the CMO in wine sector is established:

1.1 Preparation and delivery of trainings for the PAAFRD staff on the issues concerning CMO in sugar sector (quota system, quota allocation, management of production charge, excess of quota, interventions and price reporting; practical experiences, critical points); 1.2.1 Drafting guidelines (including the basic control plan) for management of sugar quota system and relevant transmission of information to the Commission; 1.2.2 Simulation of the process flow for management of sugar quota and intervention system; 1.3 Collaboration in drafting procedure manuals for the approval of operators in the sugar quota system (producers and processors) including management of production charge; 1.4 Collaboration in drafting procedure manuals in respect to use of out-of-quota sugar for chemical industry; 1.5 Drawing up guidelines (including critical points) for on-the-spot controls of operators in the quota system; 1.6 Reviewing and commenting procedure manuals for trade mechanisms in sugar sector (import/export licences and export refunds), that are already drafted by the Trade Mechanisms Department (hereinafter: TMD)

Component 2: Establishment of the administrative system for the implementation of the CMO in beef and veal sector

2.1 Preparation and delivery of trainings for the PAAFRD staff in respect to CMO in beef and veal (all applicable measures, practical experience and critical points according to other MS), including other meat sectors under the single CMO; 2.2.1 Collaboration in drafting procedure manuals for the buying-in, storage and disposal under public intervention of beef and veal products; 2.2.2 Simulation of the process flow for the buying-in, storage and disposal of beef and veal; 2.3 Collaboration in drafting procedure manuals for management of aid for private storage; 2.4 Drawing up guidelines (including critical points) in respect to classification of beef carcases and reporting of prices thereof; 2.5 Drawing up guidelines (including critical points) for on-the-spot controls in beef and veal sector; 2.6 Reviewing and commenting procedure manuals for trade mechanisms in beef and veal sector (import/export licences and export refunds), already drafted by the TMD.

4.1 Preparation and delivery of trainings for the PAAFRD staff on the issues concerning CMO in fruit and vegetables sector outside marketing standards, with practical experience of other MS and critical points; 4.2 Collaboration in drafting procedure manuals for the recognition and monitoring of producer organisations and producer groups; developing a case study for an operational programme (drafting, evaluation, approval, monitoring, reporting); 4.3 Collaboration in drafting procedure manuals for management of producer organisations and producer groups’ payments (including lodging of securities for advance payments); 4.4 Collaboration in drafting procedure manuals for the implementation of the school fruit scheme; 4.5 Drawing up guidelines in respect to the on-the-spot checks, recovery of undue payments and communication with the EC; 4.6 Reviewing and commenting procedure manuals for trade mechanisms in fruit and vegetables sector (import/export licences), already drafted by TMD. 4.7 Drawing up guidelines for establishment of communicating prices of imported products for the application of the entry price system

Drawing up guidelines for the calculation of export refunds and control in case of by-products declared in declarations of ingredients; 5.4 Drawing up guidelines and recommendations in respect to additional declarations of origin of basic products used in processed products;

5.5 Analysing and commenting the existing pilot IT application for the management of export refunds.

3.5 Means/ Input from the MS Partner Administration

3.5.1 Profile and tasks of the Project Leader

One of the experts may act as a Project Leader for general coordination 3.5.1.1. Profile of the Project Leader:

a) Requirements

- University degree - Proven contractual relations to public administration or mandated body, as defined under Twinning manual 5.3.2 - 5 years of experience on the practical application of CAP legislation in the field of CMO in the Paying Agency - Experience in project management - Fluency in written and spoken English - Computer literacy

b) Assets

- Experience in EU-financed projects - Experience in the region, especially in terms of preparation for the PA accreditation - Authority to influence on decision making at the highest level - High-ranking official with ability to call on short term experts to support of the efficient implementation of the project and full support to PAAFRD staff

3.5.1.2. Tasks of the Project Leader In addition to the tasks performed in course of the activities, the Team Leader shall execute the following tasks:

The proposed pool of short-term experts is expected to cover all CMO sectors targeted under this project.

- University degree - 5 years of working experience in respect to one or more of the following CMO sectors: sugar, milk, beef and veal, fruit and vegetables, export refunds for Non-Annex I products, wine; - Proven contractual relations to public administration or mandated body, as defined under Twinning manual 5.3.2 - Fluency in written and spoken English - Computer literacy

b) Assets

- Experience in EU-financed projects - Experience in the region, especially in terms of preparation for the PA accreditation

3.5.2.2. Tasks of the short-term experts

- Participation and counselling in drafting written procedures for the implementation of selected market organisations (control plans, procedure manuals, check lists, application forms and other supporting documents); - Simulation of process flows and recommendation for improvement of working procedures; - Drafting guidelines in respect to on-the-spot controls in selected market regimes; - Transmission of experience of other MS and drawing attention to critical points in the implementation of selected market support measures; - Preparation and delivery of trainings in field of CMO in the following sectors: sugar, milk and milk products (outside milk quota), beef and veal (including other meat sectors under the CMO), fruit and vegetables (outside marketing standards), wine (support programmes and promotion), export refunds for Non Annex I products, and general set-up and implementation of CMO in EU member states. 4. Institutional Framework

According to the Act on Agriculture (OG 66/01, 83/02), the operative implementation of market and structural support measures in agriculture is under the supervision of the Directorate for Market and Structural Support in Agriculture (DMSSA), as an organizational unit of the Ministry of Agriculture, Fisheries and Rural Development (MAFRD). The Directorate is engaged in following work: implementation of measures of market-pricing policy, implementation of measures of structural policy, implementation of programs of international support for the sector development, preparation of expert background and analysis, keeping records on the activities concerning the operative implementation of measures of market-pricing and structural policies and submitting them to the agricultural Information Centre, as well as establishment and carrying out the Integrated administration and control system. Besides the above mentioned national support scheme, part of DMSSA was accredited for the SAPARD programme implementation – the SAPARD Agency. Establishment of SAPARD Agency was completed on 29 September 2006, by Commission Decision on conferral of 11 management of aid for SAPARD Measure 1 “Investment in agricultural holdings” and Measure 2 “Improving the processing and marketing of agricultural and fisheries products”. According to the Ordinance on internal organization of the MAFRD and Decree on internal structure of the MAFRD (published in Official Gazette no. 35/08), new organizational structure of the DMSSA was established (see Annex IV of Twinning Project Fiche). DMSSA is comprised of eight (8) Sectors, two (2) independent Departments and one (1) independent Service. New structure requires the total of 210 work posts. Recruitment is planned to be conducted in 2009. SAPARD/IPARD Agency is at the moment part of Directorate for Market and Structural Support in Agriculture which is within our Ministry of Agriculture. Croatian Government has recently adopted new Law on establishment of the Paying Agency for Agriculture, Fisheries and Rural Development which will take over functions of the SAPARD/IPARD Agency as well.

The Law on establishment of the Paying Agency in agriculture, fisheries and rural development (PAAFRD) was published on 09 March 2009. According to the NPIEU a fully established Paying Agency with regional offices is mentioned as a priority by the end of 2010. The project will help to employees of PAAFRD (Sector for Market Support: Market Measures Department, Market Interventions Department – Plant part and Market Interventions Department – Animal part; Control Sector, Financial Sector as well as other organisational units of the PAAFRD) in preparation for implementation of the Common organization of the agricultural markets.

Recruitment, as well as enlargement of PAAFRD`s work space, is planned to be conducted in 2009. For the time being department for commercial measures has 3 employees out of 7 positions planned and department for market interventions has 4 employees out of 6 positions planned.

Two Steering Committee meetings will be held for the purpose of reviewing the progress made under the project as well as to discuss results achieved and/or problems occurred. The first Steering Committee meeting will be held during the third month of project activities implementation in order to discuss and comment the draft start-up report. The second Steering Committee meeting will be organised during the last month of the implementation period to discuss the draft final report. It should be noted that the participation of the Member State Project Leader in Steering Committee meetings have to be combined with expert missions, in case the Member State Project Leader is also a short-term expert in the twining light project. If the Member State Project Leader is not short-term expert in the twining light project then his visits to Croatia (one visit every three months), as part of his overall task to ensure coordination and political steering of the project, should be organised at the same time as the two Steering Committee meetings of the Project. The exact participants of the Steering Committee meetings will be defined during the implementation of the project, but will at least include the following members:

The beneficiary is committed to provide all necessary infrastructure such as office space and desktop computers with internet connection for experts, venue for holding seminars and workshops, and to ensure the necessary local staff/experts inputs.

Interpretation costs will be reimbursed from the budget only for the purpose of workshop and seminars, up to 7% of the budget can be used for translation and interpretation purposes. Provisions for visibility costs and expenditure verification costs should be included in the budget.

6.3 Contracts

It is envisaged that the Project will be implemented thorough one Twinning light contract, with an indicative amount of 230.000,00 EUR.

6.4 Reporting Start-up Report The Start-up Report will cover first two months of the contract and will be submitted during the third month. The Start-up report should: - Clearly define the aims and purpose of the aid provided by the project, - Give detailed description of the content of particular parts of the project, - Work out in detail the activities conducted and the results achieved, - Work out in detail all modifications agreed with the beneficiary institution, - Review difficulties met during the implementation of the project and measures that were undertaken for their removal, - Provide all findings obtained in the meanwhile and preliminary conclusions, and - Contain a general plan of activities for the implementation of the remained duration of the project.

Final Report The Final Report shall be submitted within three months upon the completion of the project activities and in any case within the legal duration of the project, and it should contain the following:

14 - Complete review of all activities conducted by MS experts during the implementation of the project - Achieved progress concerning each activity, - Summary of all project results, with particular emphasis on mandatory results, - Estimation of the project impact compared with the project aims and measures of the achieved progress, - Identification of all important problems met during the implementation of the contract and solutions that have been applied, - Lessons drawn from the project, and - Recommendations for further steps in future projects Reports shall be submitted to MAFRD, the Central Finance and Contracting Agency, the EC Delegation in Croatia and to the Central Office for Development Strategy and Coordination of EU Funds (NIPAC Office) in a form of 4 hard copies and in an electronic version. All reports should be written in English.

8. Sustainability

This project will provide functionality of the management and control of agricultural funds system, the sustainability of which will be ensured by the existence of the required management for the agricultural funds. The project will provide better control through the integrated system which will be continuously maintained. Croatian agricultural sector use the support for the agriculture now and that process has to continue after the accession of Croatia to EU.
