Model Licensing Ordinance Plug-in: No Sales of Tobacco Look-Alike Products 1 Introduction

The Technical Assistance Legal Center (TALC) developed this optional Plug-in for TALC’s Model California Ordinance Requiring a Tobacco Retailer License to assist cities and counties that would like to prohibit sales of tobacco “look-alike” products, such as candy cigarettes, bubble gum cigars, and “Big League Chew,” which are all food items that are packaged to resemble tobacco products.

How to use this Plug-in When adding this Plug-in to TALC’s Model Licensing Ordinance, be sure to fill in any blanks that have been provided (e.g., [ ____ ] ) to customize the language. Additionally, in some cases, options are offered (e.g., [ option one / option two ] ). Some options are followed by comments describing the legal provisions in more detail. Some degree of customizing is always necessary to make an ordinance consistent with a community’s existing laws. Note that if a term is capitalized in the Plug-in, it is a term that is defined in TALC’s Model Licensing Ordinance.

After adding one or more Plug-ins to the basic retail licensing ordinance, please verify that all the internal references to other sections are correct. Your city attorney or county counsel will likely be the best person to accomplish this for you.

Model Licensing Ordinance Plug-in: No Sales of Tobacco Look-Alike Products 2 Amendments to TALC’s Model Licensing Ordinance

In SECTION II:

In Sec. [ ____ (*1) ]. DEFINITIONS, add the following definitions in alphabetical order:

(__) “Edible” means any substance or thing designed, intended, or prepared to be eaten, drunk, chewed, or otherwise ingested by humans or that is, in fact, commonly eaten, drunk, chewed, or otherwise ingested by humans.

(__) “Tobacco Look-Alike Product” means any product other than an image that is not a Tobacco Product but is designed so that it readily appears similar to a Tobacco Product as judged by a reasonable consumer.

In Sec. [ ____ (*2) ]. REQUIREMENTS AND PROHIBITIONS, add the following subsection:

(__) TOBACCO LOOK-ALIKE PRODUCTS PROHIBITED. No Person shall sell, offer for sale, or exchange for any form of consideration, or deliver or cause to be delivered for consideration, any Edible Tobacco Look-Alike Product within the [ City / County] including, without limitation, candy cigarettes, bubble gum cigars, and chewing gum packaged to resemble tobacco products.

COMMENT: This prohibition could be expanded beyond “candy” to include toys that simulate tobacco products by deleting the word “Edible” and the definition of “Edible.” Please contact TALC for help if you wish to extend a look-alike ban beyond edible products, as there are additional legal considerations with such a broad ban.
