REGULAR AGENDA:

1. CASE NO. DA 2013-01 (QUASI JUDICIAL)

REQUEST: Consideration of a proposed Development Agreement between the City of Pinellas Park, Park and Belcher LLC and Tin Timmy and Polly Danh dba ABC Tires, all owning certain parcels of land generally located west of Belcher Road, east of 72nd Street, south of Park Boulevard and addressed as 7100 and 7150 Park Boulevard. Land uses available to the owners shall be uses permitted as either permitted or conditional uses in the CH Heavy Commercial District and specifically as provided in the agreement for drive-thru restaurant, drive-thru financial institution or general retail, and light automotive repair. Building heights may be permitted up to, and including 40 feet, however, heights above 40 feet may be approved through the conditional use process. A base floor area ratio for nonresidential development is .55 or 55 hundredths. As part of the agreement, variances are requested to parking, vehicular stacking distance, setbacks, lot coverage, and landscaping. Copies of the agreement for public inspection are December 6, 2012 Planning & Zoning Commission Agenda Page 1 located in the Office of the City Clerk, 5141 78th Avenue or at the Technical Services Building, Zoning Division offices located at 6051 78th Avenue, Pinellas Park, Florida.

Letters should be addressed to the Zoning Division, City of Pinellas Park, P.O. Box 1100, Pinellas Park, Florida, 33780-1100. For more information, please contact the Zoning Division.

Please note that if a person decides to appeal any decision made by the Planning and Zoning Commission, with respect to any matter considered at the above-cited (meeting or hearing), they will need a record of the proceedings and, for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

FOR THE HEARING IMPAIRED - An interpreter for the hearing impaired will be made available upon requests made at least 72 hours in advance. Also, an Assistive Hearing Device (magnifier) is available from the City Clerk for use in Council Chambers and all meeting rooms throughout the City.
