The Board Chair called the Board to order, the roll was called and the following Representatives were found to be present:

Frazier, Powers, Clark, Murphy, Koren, Lindberg, Rosenthal, Kosmer, McCarty, Schwerd, Koutnik, Rothenberger, Rowinski, Stuligross.

Under Privilege of the Floor, Edward Dawyot, Town of New Lisbon, requested that the Board compare the early 1970's county population with current population together with the number of county employees during those years. He asked that the results be made public. Mr. Dawyot expects that the comparison would indicate an increased number of employees providing services for less population. He said that it may be less expensive to outsource or privatize services.

Dianne Dirig, Family & Consumer Science Program Leader, Cornell Cooperative Extension Schoharie and Otsego Counties, reviewed the benefits of the Eat Smart New York nutrition education program. She asked for continued budget support through the Department of Social Services.

The minutes of August 7, 2013 were approved.

New York State Office of Parks, Recreation and Historic Preservation – Letter stating the Springfield Patent Historic District will be considered by the State Review Board for nomination to the National and State Registers of Historic Places.

Notice of Claim – Angelo David Pacherille vs County of Otsego and Town of Otsego. Damages include, but are not limited to, false arrest, malicious prosecution, cost and expenses incurred in defending cases, damage to claimant's reputation, impairment of claimant's earning power, and impairment to his health. No monetary amount is stated.

The following reports are on file with the Clerk of the Board: Montgomery-Otsego-Schoharie Solid Waste Management Authority – Monthly Operations Report for July 2013 daily records of Solid Waste Deliveries and itemized Statement of July 2013 Revenues.

The reports of the Standing Committees were given and ordered filed.

Acting County Treasurer Russ Bachman discussed fund balance, 2013 unbudgeted expenses, and 2014 projected expenses, not including department requests.

Representative McCarty moved for an executive session at 12:13 p.m. to discuss potential litigation regarding the County Route 11C bridge. Seconded, Koutnik. Total: 6,227; Ayes: 6,227. Motion carried.

The Board Chair declared a break at 12:13 p.m.

The Board reconvened at 12:54 p.m.

Representative Lindberg moved to dispense with the reading of all resolutions. Seconded, Koutnik. Total: 6,227; Ayes: 6,227. Motion carried.

Representative Stuligross, based on action taken by the Otsego Manor Committee at the September 4, 2013, 9:45 a.m. meeting, withdrew Resolution 330- 20130905 – Unfunding a Certain Position at Otsego Manor (Neighborhood Manager), as it is no longer necessary.

Representative Murphy, with majority consent of the Administration Committee, withdrew Resolution No. 331-20130905 – Creating a Position at Otsego Manor (Staffing Coordinator), as it is no longer necessary.

Board Chair Clark asked if any representative wished to remove a resolution(s) from the consent agenda so it can be acted upon separately.

Representative Rosenthal removed Resolution Nos. 336 and 337.

Board Chair Clark called for action on the consent agenda, excluding Resolution Nos. 330, 331, 336, and 337. Representatives Lindberg and Stuligross moved to act upon the consent agenda, Resolution Nos. 320 through 329, and Nos. 332 through 335.

RESOLUTION NO. 320-20130904

RESOLUTION – AUTHORIZING CHAIR OF THE BOARD TO CONTRACT WITH NEW YORK STATE DEPARTMENT OF HEALTH TO RECEIVE GRANT FUNDS (CHILDHOOD LEAD POISONING PREVENTION PROGRAM)

LINDBERG, SCHWERD, KOUTNIK, ROSENTHAL RESOLVED, that the Chair of the Board, on behalf of the Otsego County Department of Health, be and hereby is authorized to execute an agreement with the New York State Department of Health, to receive grant funds in the amount of $28,095 for the Childhood Lead Poisoning Prevention Program, for the period beginning October 1, 2013 to September 30, 2014; and be it further RESOLVED, that said agreement shall contain such other terms and provisions as are in the best interest of the County of Otsego.

RESOLUTION NO. 321-20130904

RESOLUTION - AUTHORIZING CHAIR OF THE BOARD TO EXECUTE AGREEMENT WITH ENGINEERS FOR CONSTRUCTION INSPECTION OF BRIDGE BIN 3353930, COUNTY ROUTE 11C OVER SUSQUEHANNA RIVER, TOWNS OF HARTWICK/MIDDLEFIELD, OTSEGO COUNTY

MCCARTY, FRAZIER, MURPHY

RESOLVED, that the Chair of the Board be and hereby is authorized to enter into an agreement with Shumaker Consulting Engineering and Land Surveying, P.C., 143 Court Street, Binghamton, New York 13901, for the construction inspection of bridge BIN 3353930, located on County Route 11C over the Susquehanna River, in the Towns of Hartwick/Middlefield, Otsego County, New York; these services being professional engineering services and not requiring public bidding, at a cost not to exceed $47,500.00 for construction inspection; and be it further RESOLVED, that said agreement shall contain such other terms and conditions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funds for this project are available in the 2013-2014 Highway Budget under D5112.2020, D5113.2121 and D5113.2104.

RESOLUTION NO. 322-20130904

RESOLUTION – AUTHORIZING SUPERINTENDENT OF HIGHWAYS TO CONTRACT FOR PURCHASE OF CERTAIN SERVICES (REPLACEMENT OF BIN #3353930)

WHEREAS, bids have been requested and duly received by the Purchasing Agent for certain services for the Highway Department; and WHEREAS, the Purchasing Agent has made a report to the Public Works Committee of this Board, and this Committee has made a recommendation to this Board that the lowest responsible bid be accepted; now, therefore, be it RESOLVED, that the Otsego County Superintendent of Highways be and hereby is authorized to contract with the following firm as set forth below, in accordance with the specifications and bids heretofore received; said bid proposals being on file at the Highway Department and in the Office of the Clerk of the Board of Representatives: PROJECT : Replacement of Bridge BIN #3353930 CR #11C over Susquehanna River, Towns of Hartwick & Middlefield, Otsego County, NY

COST: $1,654,400.00

RESOLUTION NO. 323-20130904

RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD TO CONTRACT FOR HEALTH CARE SERVICES AT OTSEGO MANOR

STULIGROSS, LINDBERG, KOREN, KOSMER

RESOLVED, that the Chair of the Board be and hereby is authorized to execute a contract with the following individual to provide health care services at Otsego Manor for a term beginning August 20, 2013 and terminating December 31, 2013: PROVIDER/SERVICES RATE

Randelle McUmber (MSW) $50.00 per hour and be it further

RESOLVED, that said contract shall contain such other terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funds for this contract are included in the 2013 Infirmary – Enterprise Budget (6020-E) at line 4900 Contracts and are reimbursable as follows: Federal 50%, State 40%, and County 10%.

RESOLUTION – AUTHORIZING CHAIR TO ENTER INTO AN AGREEMENT WITH I.M. SOLUTIONS, INC. FOR ACCOUNTS RECEIVABLE, BILLING AND RELATED SERVICES

STULIGROSS, LINDBERG, KOREN, KOSMER

WHEREAS, Otsego Manor has a need for accounts receivable, billing and related services; and WHEREAS, I.M. Solutions, Inc. can provide such services; now, therefore, be it RESOLVED, that the Chair of this Board is hereby authorized to execute an agreement with I.M. Solutions, Inc., 109 Chatham Avenue, Buffalo, New York 14216 to provide accounts receivable, billing and related services to Otsego Manor, for a term of two (2) months (3 days a week/every other week), at a cost of $15,000 per month, beginning October, 2013; and be it further RESOLVED, that the agreement shall contain such other terms and provisions as may be in the best interest of the County of Otsego; and be it further RESOLVED, that the funds for the above agreement are included in the 2013 Infirmary – Enterprise Budget (6020-E) at line 4900 Contracts.

RESOLUTION – AUTHORIZING COMMISSIONER OF SOCIAL SERVICES TO CONTRACT WITH OPPORTUNITIES FOR OTSEGO, INC. TO PROVIDE HOME ENERGY ASSISTANCE PROGRAM (HEAP) FOR NON-PUBLIC ASSISTANCE HOUSEHOLDS

KOREN, ROTHENBERGER, KOUTNIK

WHEREAS, the Commissioner of Social Services is required to provide services to assist people in applying for benefits associated with the Home Energy Assistance Program (HEAP); and WHEREAS, the County is required to establish eligibility for HEAP benefits through an application process; and WHEREAS, the County is required to have an outside certifier for the program; and WHEREAS, Opportunities for Otsego, Inc. (OFO) has indicated that their organization can provide this service for the County of Otsego; now, therefore, be it RESOLVED, the Commissioner of Social Services is hereby authorized to contract with Opportunities for Otsego, Inc., having its principal business office located at 3 West Broadway, Oneonta, New York, for the purpose of client HEAP application processing and eligibility determination for the term September 1, 2013 through August 31, 2014; and be it further RESOLVED, that this contract is for an amount not to exceed $85,718 for the 2013-2014 HEAP season; and be it further RESOLVED, that said contract shall contain such terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2013 Social Services Administration Budget (6010-A) at line 4900 Contracts and is 100% Federal reimbursable.

RESOLUTION NO. 326-20130904

RESOLUTION – AUTHORIZING COMMISSIONER OF SOCIAL SERVICES TO CONTRACT WITH OTSEGO COUNTY OFFICE FOR THE AGING TO PROVIDE HOME ENERGY ASSISTANCE PROGRAM (HEAP) OUTREACH AND CERTIFICATION SERVICES

KOREN, ROTHENBERGER, KOUTNIK

WHEREAS, the Commissioner of Social Services is required to provide services to assist people in applying for benefits associated with the Home Energy Assistance Program (HEAP); and WHEREAS, the County is required to establish eligibility for HEAP benefits through an application process; and WHEREAS, the Otsego County Office for the Aging (OFA) has indicated that it can provide this service for persons over age 60 in the County of Otsego; now, therefore, be it RESOLVED, that the Commissioner of Social Services is hereby authorized to contract with the Otsego County Office for the Aging, for the purpose of client HEAP application processing and eligibility determination for the term September 1, 2013 through August 31, 2014; and be it further RESOLVED, that the Office for the Aging shall be paid $21.00 per application received by the Department of Social Services for the 2013-2014 HEAP season; and be it further RESOLVED, that the funding for this contract is included in the 2013 Social Services Administration Budget (6010-A) at line 4900 Contracts and is 100% federal reimbursable.

RESOLUTION NO. 327-20130904 RESOLUTION – AUTHORIZING FILLING OF POSITION IN E911 DEPARTMENT (PART-TIME DISPATCHER)

POWERS, MCCARTY, ROTHENBERGER, ROSENTHAL

WHEREAS, Resolution No. 265-20110907 froze the filling of current vacant employment positions, funded or unfunded, and filling of other previously created positions as yet unfilled without the formal approval of the Parent Committee, the Administration Committee and a County Board Resolution; and WHEREAS, both the Public Safety and Legal Affairs Committee and the Administration Committee of this Board approved the filling of a certain position in the E911 Department, as set forth below; now, therefore, be it RESOLVED, that the Sheriff is hereby approved to fill the following vacant funded position, effective immediately:

One (1) part-time Dispatcher, Grade 10Z, $14.4505 per hour and be it further

RESOLVED, that the funding for this position is included in the 2013 Public Safety Communications Budget (3020-A) at line 1000 Personal Service; and be it further RESOLVED, that the Clerk of the Board is authorized and directed to forward a copy of this resolution to the County Treasurer and to the Personnel Officer.

RESOLUTION NO. 328-20130904

RESOLUTION – APPROVING ADDITIONAL COMPENSATION FOR ECONOMIC DEVELOPMENT SPECIALIST

MURPHY, POWERS, STULIGROSS, SCHWERD, FRAZIER

RESOLVED, that the Economic Development Specialist shall be paid an additional compensation of $5,000, to be prorated by the Treasurer, for the period of August 12, 2013 through December 31, 2013; and be it further RESOLVED, that the funding for this additional compensation is included in the 2013 Economic Development Budget (6425-A) at line 1000, Personal Service; and be it further RESOLVED, that the Clerk of this Board be and is hereby directed to forward a copy of this resolution to the County Treasurer and to the Personnel Officer.

RESOLUTION NO. 329-20130904 RESOLUTION – AMENDING RESOLUTION NO. 268-20130703 – CREATING A POSITION AT OTSEGO MANOR (CLINICAL SERVICES COORDINATOR)

WHEREAS, Resolution No. 268-20130703 created the position of Clinical Services Coordinator, Grade 21M, $57,428 - $67,518 ($2,018); and WHEREAS, the grade code 21M for this position needs to be changed to 21N to reflect the correct grade code; now, therefore, be it RESOLVED, Resolution No. 268-20130703 is hereby amended to change the grade code for the Clinical Services Coordinator position as set forth above.

RESOLUTION NO. 332-20130904 RESOLUTION - AUTHORIZING SALE OF COUNTY OWNED PROPERTY MURPHY, POWERS, STULIGROSS, SCHWERD, FRAZIER

RESOLUTION – AMENDING RESOLUTION NO. 133 OF 1967 - INCREASING TAXES ON SALES AND USES OF TANGIBLE PERSONAL PROPERTY AND OF CERTAIN SERVICES, ON OCCUPANCY OF HOTEL ROOMS AND ON AMUSEMENT CHARGES, PURSUANT TO ARTICLE 29 OF THE TAX LAW OF THE STATE OF NEW YORK

BE IT RESOLVED, by the Otsego County Board of Representatives, as follows: SECTION 1. Section 4-A of Resolution No. 133 of 1967, enacted by the Otsego County Board of Representatives on December 7, 1967, imposing sales and compensating use taxes, as amended, is amended to read as follows: SECTION 4-A. Imposition of additional rate of sales and compensating use taxes. Pursuant to the authority of section 1210 of the Tax Law, in addition to the sales and compensating use taxes imposed by sections 2 and 4 of this resolution, there is hereby imposed and there shall be paid an additional one percent rate of such sales and compensating use taxes, for the period beginning December 1, 2003, and ending November 30, 2015. Such additional taxes shall be identical to the taxes imposed by such sections 2 and 4 and shall be administered and collected in the same manner as such taxes. All of the provisions of this resolution relating to or applicable to the administration and collection of the taxes imposed by sections 2 and 4 shall apply to the additional taxes imposed by this section, including the applicable transitional provisions, limitations, special provisions, exemptions, exclusions, refunds and credits as are set forth in this resolution, with the same force and effect as if those provisions had been incorporated in full into this section and had expressly referred to the additional taxes imposed by this section. SECTION 2. Paragraph (C) of Subdivision (1) of Section 11 of Resolution No. 133 of 1967, enacted by the Otsego County Board of Representatives on December 7, 1967, imposing sales and use taxes, as amended, is amended to read as follows: (C) With respect to the additional tax of one percent imposed for the period December 1, 2003, and ending November 30, 2015, in respect to the use of property used by the purchaser in this county prior to December 1, 2003. SECTION 3. This enactment shall take effect December 1, 2013.
