PLEDGE ALLEGIANCE TO TEXAS FLAG

PUBLIC HEARING – BUDGET: The City Commission of the City of Pampa will conduct a Public Hearing at 5:30 p.m. at City Hall, 201 W. Kingsmill Street, Pampa, Texas on the 3 rd Floor in the City Commission Chambers. This will be a Public Hearing for the purpose of receiving public comments concerning the City’s proposed Operating Budget for the 2017-2018 fiscal year. A copy of the proposed Budget is on file in the office of the City Secretary and on the City of Pampa website at www.cityofpampa.org for public review. Citizens are encouraged to attend this public hearing and express their views. 17-095

Mayor Pingel opened the public hearing for the 2017-2018 Proposed Operating Budget at 5:32 p.m. Robin Bailey, Finance Director and Shane Stokes, City Manager gave a recap of the Proposed Budget. Mayor Pingel asked if there was anyone present who wanted to speak concerning the Budget; there was no one who wanted to speak. With no one wanting to speak Mayor Pingel called for a motion to close the Public Hearing, a motion was made by Commissioner Dixon and Seconded by Commissioner Porter, to close the Public Hearing at 5:34 p.m.

PUBLIC HEARING – TAX RATE: The City Commission of the City of Pampa will conduct a Public Hearing immediately following the Budget Hearing on a proposal to increase total tax revenue from properties on the tax roll in the preceding tax year by 1.98% (percent by which proposed tax rate exceeds lower of rollback or effective tax rate, calculated under Chapter 26 of the Tax Code). Your individual taxes may increase at a greater or lesser rate, or even decrease, depending on the change in the taxable value of your property in relation to the change in taxable value of all other property and the tax rate that is adopted.

If the governing body adopts the proposed tax rate of $0.677000 per $100.00 of taxable value, the amount of taxes imposed this year on the average home would be $417.00. Citizens are encouraged to attend this Public Hearing and express their views.

Mayor Pingel opened the public hearing for the 2017-2018 Proposed Tax Rate at 5:34 p.m. Mayor Pingel asked if there was anyone present who wanted to speak concerning the Proposed Tax Rate; there was no one who wanted to speak. With no one wanting to speak Mayor Pingel called for a motion to close the Public Hearing, a motion was made by Commissioner Dixon and Seconded by Commissioner Winton, to close the Public Hearing at 5:35 p.m.

PUBLIC HEARING – REZONING: The City Commission of the City of Pampa will conduct a Public Hearing immediately following the Tax Rate Hearing. This will be a Public Hearing for the purpose of receiving public comments concerning the following request: Troy Reeves requests to rezone Tract 147 of the Suburbs of Pampa in Section 114, Block 3, I&GN RR Co. Survey, Gray County, Texas. The request is to rezone the aforementioned tract from Single Family-3 Residential to Agricultural District. The applicant proposes to rezone to allow for the construction of a private shop building. The public is encouraged to attend this Public Hearing and express their views.

Mayor Pingel opened the public hearing for the Rezoning request at 5:35 p.m. and asked Jildarda Aries, Engineer give an update on the rezoning request. Following the update Mayor Pingle asked if there was anyone present who wanted to speak concerning the Rezoning request; there was no one who wanted to speak. With no one wanting to speak Mayor Pingel called for a motion to close the Public Hearing, a motion was made by Commissioner Winton and Seconded by Commissioner McLain, to close the Public Hearing at 5:36 p.m.

PUBLIC COMMENTS: NONE

RECOGNITIONS:

 Police Department Promotion – Lance Richburg, Chief of Police Chief Richburg announced the promotion of Billy Corley from Patrol Officer to Corporal.

 Citation of Merit to Captain Jerry Tomaschik – Greg Lee, Fire Chief Chief Lee awarded Captain Jerry Tomaschik the Citation of Merit for orchestrating a department wide survival and rescue training exercise. DISCUSSION:

 Fire Opps 101 – Craig Harkcom Craig Harkcom invited Commission Members to attend Fire Opps 101 training course on November 4, 2017.

AUTHORIZATIONS BY CITY COMMISSION:

1. Consider approving the minutes of the August 14, 2017 Regular City Commission Meeting as presented.

A motion was made by Commissioner McLain and Seconded by Commissioner Dixon to approve the minutes of the August 14, 2017 Regular City Commission Meeting as presented, with each Commission Member voting AYE, the motion carried.

2. Consider adopting on second and final reading Ordinance No. 1674, an Ordinance of the City of Pampa amending the monthly rates to be charged for water within and outside the corporate limits of the City of Pampa.

AN ORDINANCE OF THE CITY OF PAMPA, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES BE AMENDED BY REVISING CHAPTER 13, SECTIONS 13.02.038 AND 13.02.039 OF SAID CODE PROVIDING FOR THE MONTHLY RATES TO BE CHARGED FOR WATER WITHIN AND OUTSIDE THE CORPORATE LIMITS OF THE CITY OF PAMPA, TEXAS, RESPECTIVELY, AND PROVIDING FOR AN EFFECTIVE DATE.

A motion was made by Commissioner Porter and Seconded by Commissioner Winton to adopt on second and final reading Ordinance No. 1674, an Ordinance of the City of Pampa amending the monthly rates to be charged for water within and outside the corporate limits of the City of Pampa, with each Commission Member voting AYE, the motion carried.

3. Consider adopting on second and final reading Ordinance No. 1675, an Ordinance of the City of Pampa amending the Solid Waste Disposal rates for residential and other customers within and outside the corporate limits of the City of Pampa.

AN ORDINANCE OF THE CITY OF PAMPA, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, BE AMENDED BY REVISING CHAPTER 6, SECTION 6.05.010, PROVIDING FOR RATES FOR SOLID WASTE DISPOSAL FOR RESIDENTIAL AND OTHER CUSTOMERS WITHIN AND OUTSIDE THE CORPORATE LIMITS OF THE CITY OF PAMPA, TEXAS, RESPECTIVELY, AND PROVIDING FOR AN EFFECTIVE DATE.

A motion was made by Commissioner Winton and Seconded by Commissioner Dixon to adopt on second and final reading Ordinance No. 1675, an Ordinance of the City of Pampa amending the Solid Waste Disposal rates for residential and other customers within and outside the corporate limits of the City of Pampa, with each Commission Member voting AYE, the motion carried. 17-101

4. Consider adopting on second and final reading Ordinance No. 1676, an Ordinance of the City of Pampa amending the fees to be charged at the City’s Sanitary Landfill.

ORDINANCE NO. 1676 AN ORDINANCE OF THE CITY OF PAMPA, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, BE AMENDED BY REVISING SECTION 6.06.004 OF SAID CODE PROVIDING FOR FEES TO BE CHARGED AT THE CITY’S SANITARY LANDFILL; AND PROVIDING AN EFFECTIVE DATE.

A motion was made by Commissioner Porter and Seconded by Commissioner McLain to adopt on second and final reading Ordinance No. 1676, an Ordinance of the City of Pampa amending the fees to be charged at the City’s Sanitary Landfill, with each Commission Member voting AYE, the motion carried.

5. Consider adopting on second and final reading Ordinance No. 1677, an Ordinance of the City of Pampa amending its Code of Ordinances by adding Division 6 “Service Provider Use of Public Right(s)-of-Way” to Chapter 3, Building Regulations, Article 3.12.

AN ORDINANCE OF THE CITY OF PAMPA, TEXAS, PROVIDING THAT ITS CODE OF ORDINANCES, CHAPTER 3, BUILDING REGULATIONS, ARTICLE 3.12, BE AMENDED BY ADDING DIVISION 6 SERVICE PROVIDER USE OF PUBLIC RIGHT(S)-OF-WAY, PROVIDING FOR PENALTIES, PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE.

A motion was made by Commissioner McLain and Seconded by Commissioner Winton to adopt on second and final reading Ordinance No. 1677, an Ordinance of the City of Pampa amending its Code of Ordinances by adding Division 6, “Service Provider Use of Public Right(s)-of-Way” to Chapter 3, Building Regulations, Article 3.12, with each Commission Member voting AYE, the motion carried.

6. Consider approving on first reading Ordinance No. 1678, an Ordinance of the City of Pampa adopting its Operating Budget for the 2017-2018 fiscal year.

AN ORDINANCE MAKING APPROPRIATIONS FOR THE SUPPORT OF THE CITY OF PAMPA FISCAL YEAR BEGINNING OCTOBER 1, 2017, AND ENDING SEPTEMBER 30, 2018, APPROPRIATING MONEY TO A SINKING FUND TO PAY INTEREST AND PRINCIPAL DUE ON THE CITY’S INDEBTEDNESS; AND ADOPTING THE ANNUAL BUDGET OF THE CITY OF PAMPA FOR THE 2017-2018 FISCAL YEAR.

A motion was made by Commissioner Winton and Seconded by Commissioner Dixon to approve on first reading Ordinance No. 1678, an Ordinance of the City of Pampa adopting its Operating Budget for the 2017-2018 fiscal year, with Mayor Pingel and Commissioners Winton, Porter, Dixon and McLain voting AYE, the motion carried.

7. Consider approving on first reading Ordinane No. 1679, an Ordinance of the City of Pampa amending Section 3 of Ordinance No. 690 changing from a Single Family-3 Residential to Agricultural District, Tract 147 of the Suburbs of the City, Section 114, Block 3 of I&GN RR Co. Survey, Gray County, Texas. ORDINANCE NO. 1679

AN ORDINANCE OF THE CITY OF PAMPA, TEXAS, AMENDING SECTION 3 OF ORDINANCE NO. 690 (APPENDIX A TO THE CODE OF ORDINANCES, CITY OF PAMPA, TEXAS), PASSED AND APPROVED ON APRIL 8, 1969, CHANGING FROM A SINGLE-FAMILY 3 DISTRICT AND PLACING IN AN AGRICULTURAL DISTRICT TRACT 147 OF THE SUBURBS OF THE CITY OF PAMPA, GRAY COUNTY, TEXAS, IN SECTION 114, BLOCK 3, I&GN RR CO. SURVEY, GRAY COUNTY, TEXAS, AND PROVIDING FOR AN EFFECTIVE DATE.

A motion was made by Commissioner Dixon and Seconded by Commissioner Porter to approve on first reading Ordinance No. 1679, an Ordinance of the City of Pampa amending Section 3 of Ordinance No. 690 changing from a Single Family-3 Residential to Agricultural District, Tract 147 of the Suburbs of the City, Section 114, Block 3 of I&GN RR Co. Survey, Gray County, Texas, with each Commission Member voting AYE, the motion carried.

8. Consider approving the Reeves Addition Unit 1 Plat.

A motion was made by Commissioner McLain and Seconded by Commissioner Winton to approve the Reeve Addition Unit 1 Plat which will create three (3) lots in the Reeves Addition, with each Commission Member voting AYE, the motion carried.

9. Consider approving a replat of the Walnut Creek Estates Unit II Subdivision.

A motion was made by Commissioner Porter and Seconded by Commissioner McLain to approve a replat of the Walnut Creek Estates Unit II Subdivision, with each Commission Member voting AYE, the motion carried.

10. Consider approving the Pampa Economic Development Corporations Operating Budget for the 2017-2018 fiscal year. The PEDC’s Budget includes 2017-2018 Operating Budgets for Las Pampas and Pampa Energy Center, LLC.

Gary Sutherland, Board President for the PEDC gave and update and answered questions concerning the PEDC’s, Las Pampas and Pampa Energy Center’s 2017-2018 Operating Budgets.

A motion was made by Commissioner Winton and Seconded by Commissioner Dixon to approve the Pampa Economic Development Corporations Operating Budget for the 2017-2018 fiscal year. The PEDC’s Budget includes 2017-2018 Operating Budgets for Las Pampas and Pampa Energy Center, LLC., with each Commission Member voting AYE, the motion carried.

11. Consider extending a Farm Lease Agreement for three (3) years with Richard and Linda DeVuyst, dba Red River Dairy aka DeVuyst Farms for land (surface only) located on Section 53, Block 3, I&GN RR Co. Survey, Gray County, Texas.

A motion was made by Commissioner Porter and Seconded by Commissioner Dixon to extend the Farm Lease Agreement for three (3) years with Richard and Linda DeVuyst, dba Red River Dairy aka DeVuyst Farms for land (surface only) located on Section 53, Block 3, I&GN RR Co. Survey, Gray County, Texas, with each Commission Member voting AYE, the motion carried. 17-109

12. Consider authorizing the City Manager to enter into an amended Solid Waste Agreement with the following Cities, Counties and Businesses: Allied Waste, City of Canadian, City of Clarendon, Hemphill County, City of Higgins, City of Lefors, City of McLean, City of Skellytown, Wasteco, Inc., City of Wheeler, City of White Deer and Waste Wranglers, Inc.

A motion was made by Commissioner McLain and Seconded by Commissioner Porter authorizing the City Manager to enter into an amended Solid Waste Agreement with the following Cities, Counties and Businesses: Allied Waste, City of Canadian, City of Clarendon, Hemphill County, City of Higgins, City of Lefors, City of McLean, City of Skellytown, Wasteco, Inc., City of Wheeler, City of White Deer and Waste Wranglers, Inc., with each Commission Member voting AYE, the motion carried.

13. Consider approving the List of Disbursements dated July 2017.

A motion was made by Commissioner McLain and Seconded by Commissioner Winton to approve the List of Disbursements dated July 2017, with total Disbursements being $2,252,370.11 and the amount after balance sheet and income accounts being $1,378,869.33, with each Commission Member voting AYE, the motion carried.

ADJOURNMENT There being no further business on the Agenda, the meeting was adjourned at 6:20 p.m. by Mayor Brad Pingel.
