Instruction to Bidders
1.0 Bidder Requirements
Bids must meet all terms and conditions of this Invitation for Bid, and the laws of the State of Arkansas to be considered for evaluation. Bids will be opened on Tuesday, April 23, 2013, at 2 pm in Overstreet 301 on the Southern Arkansas University Campus, Magnolia, Arkansas.
The failure to make any disclosure required by Governor’s order 98-04 or any rule regulation or policy adopted pursuant to that Order, shall be a material breach of the terms of the contract. Any contractor, whether an individual or entity, who fails to make the required disclosure or who violates any rule, regulation, or policy shall be subject to all legal remedies available to Southern Arkansas University under the provisions of existing law.
Bid must be sealed and indicate the following bid number on the outside of the sealed bid: CB2013-90.
Bid submission by fax will not be accepted.
3.0 Contractor’s Insurance Requirements
The contractor shall purchase and maintain such insurance as will protect him from claims set forth which may arise out of or result from the contractor’s operations under the Contract, whether such operations be by himself or by anyone directly or indirectly employed by any of them, or by anyone for whose acts he may be liable.
a. Claims under Workmen’s Compensation, Disability Benefit and other similar benefit act; b. Claims for damages because of bodily injury, occupational sickness or disease, or death of his employees; c. Claims for damages because of bodily injury, sickness or disease, or death of any person other than his employees; d. Claims for damages insured by usual personal injury liability coverage which are sustained, (1) by any person as a result of an offense directly or indirectly related to the employment of such person by the Contractor, or (2) by any person for any other reason; e. The contractor shall provide and maintain during the term of this contract, at the contractor’s expense, Comprehensive Automobile Liability Insurance at limits no less than the statutory requirements and it shall be shown on the Certificate in per person, per accident for bodily injury and per accident for property damages. f. Claims under comprehensive general liability for damages because of injury to or destruction of tangible property including loss of use resulting there from. g. Amount of coverage as follows: Employer’s Liability $ 500,000
Bodily Injury Liability (except Automobile) $ 500,000 each occurrence $1,000,000 aggregate
Property Damage Liability (except Automobile) $ 500,000 each occurrence $ 500,000 aggregate
Automobile Bodily Injury Liability $ 500,000 each person $1,000,000 each occurrence
Automobile Property Damage Liability $ 500,000 each occurrence
The policy shall be written by a casualty company authorized to do business in the State of Arkansas. The Certificate of Insurance shall show the agent’s signature, business name, address and telephone number and be submitted to Southern Arkansas University-Magnolia, after Contract Award but prior to formal issuance of contract. The Certificate shall stipulate fifteen days written notice be given prior to policy coverage cancellation. Southern Arkansas University-Magnolia shall be shown as the certificate holder.
4.0 Interpretation of Contract Documents Prior to Bidding
a. All references to the Owner shall be interpreted to mean Southern Arkansas University-Magnolia. b. If any person contemplating submitting a bid is in doubt as to the true meaning of any part of the contract documents, or finds discrepancies in or omission from any part of the contract documents, they may submit to Southern Arkansas University in a written request for an interpretation or correction thereof not later than five (5) days before the bids will be opened. c. Address all communications regarding the contract documents to Office of Financial Services, P. O. Box 9403; Magnolia, AR 71754. d. The person submitting the request will be responsible for its prompt delivery. e. Any interpretation or correction of the contract documents will be made only by addendum and will be mailed or delivered to each bidder of record. Southern Arkansas University-Magnolia will not be responsible for any oral explanations or interpretation of the contract documents. f. All addenda issued during the bidding period will be incorporated into the contract.
5.0 Proof of Competency of Bidder
a. Attention is called to the fact that the bidder, in signing the proposal, represents that he has the financial ability and experience to perform the work specified. b. A bidder whose proposal is under consideration shall upon request, promptly furnish satisfactory evidence of his financial resources, his experience, and the organization and equipment he has available for the performance of the contract.
6.0 Responsibility of Contractors
Contractors are presumed to be familiar with all federal, state, county, and city laws, ordinances and regulations that affect those persons engaged or employed in such work, materials, or equipment used and the other conditions affecting the work. Bidder shall comply with all such laws, ordinances, and regulations.
7.0 Taxes
The contractor shall include in his bid all State Sales Tax, Social Security Taxes, State Unemployment Insurance and all other items of like nature. It is the intent that the bid shall represent the total cost to the owner of all work included in the contract. There are no provisions for a contractor to avoid taxes by using the tax-exempt number of a state agency, board, commission or institution.
8.0 Payment to the Contractor
The owner shall make quarterly payments. The contractor shall bill the owner for service rendered by the twenty-fifth of the month, and the owner shall pay the contractor on or before the end of the following month.
9.0 Antidiscrimination Clause Required in Contracts
In accordance with the Arkansas Code Annotated 25-17-101:
All agencies of the state, or any department thereof, shall include in all contracts negotiated or renegotiated by them, for and on the behalf of the state, a provision obligating the contractor not to discriminate against any qualified employee or qualified applicant for employment because of race, color, creed, national origin, or ancestry and shall require the contractor to include a similar provision in all subcontracts. 10.0 Term of Contract
The Contract shall be for a period beginning July 1, 2013 and ending June 30, 2014. The initial Contract shall be extended for four (4) successive additional one (1) year terms, with an option to extend two (2) additional years, unless either party notifies the other party in writing, not less than ninety (90) days prior to the expiration of the initial term or any one (1) year term, of intentions to terminate the Contract. Any such written notice shall be served by certified or registered mail, return receipt requested. Pest Control S P E C I F I C A T I O N S
GENERAL:
The following comments are listed to assist the prospective contractors in preparing their bids:
1. Southern Arkansas University-Magnolia presently has under contract pest control for campus facilities.
2. The Faculty/Staff housing units are included in this proposal.
3. This contract shall consist of :
. Inspection of high risk areas to tailor the appropriate treatment strategy. . Initial interior/exterior treatment . Quarterly exterior treatments . Call back services shall be performed or scheduled within 24 hours of receiving notification from owner at no additional cost . Provide 24-hour, 7-day a week emergency response at no additional cost
4. Contractor is required to submit pricing showing the cost of each building separately. Owner also request, a cost breakout for Donald W. Reynolds Center to separate cafeteria/kitchen area from remainder of building.
5. Owner shall be provided copies of labels and MSDS for all products that may be applied on the property.
6. All materials used in pest control service will comply with federal, state, and local laws, and shall be acceptable to the owner.
7. All pest control service shall be performed in accordance with the most effective scientific pest control procedures.
8. Coordination of interior treatment shall be made at least 5 working days in advance with the owner.
9. It is essential for the successful contractor to comply with SAU-M standards of conduct and safety relating to faculty, staff, and students. Campus speed limits must be observed.
10. After notice to proceed is given to the successful contractor, a meeting will be held to formulate the plan for proceeding.
11. In the event additional facilities are added, the owner will request pricing.
