Section 594840 of the 1976 Code is amended to 33 read: 34 35 “Section 594840. (A) The school shall admit students in 36 accordance with criteria, standards, and the procedures established 37 by the board. To be eligible to be considered for admission, an 38 applicant must be a legal resident of this State. Eligibility to 39 remain enrolled in the school terminates when a student becomes a 40 nonresident of this State. The board shall ensure, insofar as 41 possible without jeopardizing admission standards, that an equal

[3351] 2 1 number of students are admitted from each of the state’s 2 congressional districts. 3 (B) In addition to the requirements of subsection (A) and in the 4 interest of promoting access to the school by diverse student 5 populations, the racial composition of the school enrollment must 6 reflect that of the State, differing from that statewide composition 7 by no more than twenty percent. A student enrolled in the school 8 pursuant to this subsection must be included in the average daily 9 membership of the student’s district of permanent residence for 10 purposes relating to the allocation of all state and federal education 11 funding, and the student’s membership district of permanent 12 residence must receive one hundred percent of the base student 13 cost from the State for this student. For the purposes of this 14 section, ‘membership district of permanent residence’ means the 15 district of the permanent residence of the student and where the 16 student ordinarily would attend public school.” 17 18 SECTION 2. Section 595040 of the 1976 Code, as last amended 19 by Act 84 of 2005, is further amended to read: 20 21 “Section 595040. (A) The school shall admit students in 22 accordance with the admission criteria, standards, and procedures 23 as established and approved by the board. To be eligible for 24 admission to the school, an applicant must be a legal resident of 25 South Carolina unless a special exemption is established to accept 26 outofstate or international exchange students. Students must be 27 identified as artistically talented and possess a high level of 28 commitment, motivation, and maturity. The board shall assure, as 29 far as possible and without jeopardizing admission standards, that 30 an equal number of students are admitted from each of the state’s 31 congressional districts. Outofstate or international exchange 32 students admitted to the school shall pay tuition as determined by 33 the board. 34 (B) In addition to the requirements of subsection (A) and in the 35 interest of promoting access to the school by diverse student 36 populations, t he racial composition of the school enrollment must 37 reflect that of the State, differing from that statewide composition 38 by no more than twenty percent. This act takes effect upon approval of the Governor 7 and is applicable to students seeking admission for the 20182019 8 School Year. 9 XX 10
