Indemnity Agreement and Agreement to Arbitrate READ CAREFULLY BEFORE SIGNING
The undersigned desires to participate in the sport of ski racing on the property of Peter E. O’Dovero, Inc./ DBA Marquette Mountain. We, individually, and as parents, recognize that THERE ARE RISKS AND DANGERS INVOLVED IN THE SPORT OF SKI RACING, AND WE DESIRE TO PARTICIPATE IN THIS SPORT EVEN THOUGH WE ARE AWARE OF SAID RISKS.
In consideration for the use of the property of Peter E. O’Dovero, Inc./ DBA Marquette Mountain and the equipment and instructional personnel of the Marquette Mountain Racing Team, we hereby absolve Peter E. O’Dovero, Inc./ DBA Marquette Mountain and the Marquette Mountain Racing Team, it’s employees and agents from any liability for injuries that might be received while participating in said sport. We agree to indemnify and hold Peter E. O’Dovero, Inc./ DBA Marquette Mountain and Marquette Mountain Racing Team harmless from any injury to the undersigned or the individuals shown below, from any liability for injuries caused or alleged to be caused by the acts of those stated below, and damage to property which arise or are alleged to have arisen by the undersigned or others out or participation in the sport of ski racing.
All claims, disputes, and other matters in question arising out of participation in said sport or relating to this agreement shall be decided by arbitration in accordance with the rules of the American Arbitration Association then in effect. This agreement shall be specifically enforceable. Demand for arbitration shall be made within a reasonable time after the claim, dispute, or other applicable Statute of Limitations would bare legal proceedings. The award rendered by the arbitrator shall be final and judgment may be entered upon it in any court having jurisdiction thereof.
This also releases all officials, agents and members of Peter E. O’Dovero, Inc./ DBA Marquette Mountain and the Marquette Mountain Racing Team from any claim whatsoever of account of first aid, treatment, or service rendered during participation in ski racing.
It is agreed that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Michigan. If any portion hereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Execution of this agreement represents to Peter E. O’Dovero, Inc./ DBA Marquette Mountain and the Marquette Mountain Racing Team that the member is In good health and physical condition and the racer and parent agree to the Racing Team Conduct standards in the MMRT Handbook.
