The Board of Zoning Appeals (BZA) was scheduled to hold a public hearing on Monday, August 15, 2011 to consider the following:

(1) Application of American K-9 Interdiction LLC, applicant, for the following property owners, for a Temporary Special Use Exception as specified in Sec. 18-482.6.B.8 of the Zoning Ordinance to operate dog training facilities.

a. Tax Parcel 111-26A, the former Boykins Elementary School site. The property is located at 17219 Pittman Road (US 186) and is owned by Southampton County. The property is zoned R-1, and is in the Berlin-Ivor Voting and Magisterial Districts. b. Tax Parcel 15-59A, the former Ivor Elementary School site. The property is located at 7486 Proctor’s Bridge Road (SR 616) and is owned by Southampton County. The property is zoned R-1, Residential, and is in the Berlin-Ivor Voting and Magisterial Districts. c. Tax Parcel 89-47, located on Melon Field Road (SR 744), approximately 2,130 feet southwest of its intersection with Ridley Road (SR 731) and is owned by J.C. Bunn III and Denise Benton. The property is zoned A-1, Agricultural, and is in the Boykins Voting and Newsoms Magisterial Districts. d. Tax Parcel 100-44, located on Three Bees Road (SR 721), approximately 4,480 feet west of its intersection with General Thomas Highway (SR 671) and is owned by J.C. and Denise Bunn. The property is zoned A-1, Agricultural, and is in the Boykins Voting and Newsoms Magisterial Districts. e. Tax Parcel 92-5, 26433 Crossroads Drive. The property is owned by Green Waste Recycling LLC, is zoned M-2, Industrial, and is in the Franklin Voting and Magisterial Districts. f. Tax Parcel 101-59, located on Odom Chapel Road (SR 716), approximately 1,740 feet south of its intersection with Cross Keys Road (SR 665), and is owned by Joan B. Bunn Life Estate. The property is zoned A-1, Agricultural, and is in the Newsoms Voting and Magisterial Districts. g. Tax Parcel 89-29, located on East Depot Street (CR 1402), approximately 2,930 feet east of its intersection with South Main Street (SR 673), and is owned by Joan B. Bunn Life Estate. The property is zoned A-1, Agricultural, and is in the Newsoms Voting and Magisterial Districts. h. Tax Parcel 89-30. The property is not located on a public right-of-way, but is approximately 715 south of General Thomas Highway (SR 671) and approximately 3,054 feet west of Cypress Bridge Road (SR 674) and is owned by Joan B. Bunn Life Estate. The property is zoned A-2, Agricultural, and is in the Newsoms Voting and Magisterial Districts. i. Tax Parcel 15-43A, located at 36465 General Mahone Boulevard (US 460). The property is owned by Charles and Kathleen Clark, is zoned B-2, Business, and is in the Berlin-Ivor Voting and Magisterial Districts.

However, the meeting was postponed due to the lack of a voting quorum. (5 members were present, but only 3 members could vote.) Commissioners Present: Peter F. Copeland, Chairman * David Holland, Vice-Chairman Elma Brown * Jeb Bradshaw Glenn Updike

Commissioners Absent: Doug Chesson Marie Sykes

* David Holland was told that morning by Rick Francis, Clerk of the Circuit Court, that he had not been sworn in and could not vote unless he was sworn in by 5:00 PM that day. Mr. Holland was unable to make it to Mr. Francis’ office by 5:00 PM, thus could not vote.

* Jeb Bradshaw owned property (his wife’s veterinary clinic) adjacent to one of the properties subject to public hearing. He chose not to vote to avoid a conflict of interest.

The meeting was postponed until Monday, September 15, 2011.
