1 CITY OF BLUE EARTH 2 MINUTES 3 CITY COUNCIL BOARD OF APPEAL MEETING 4 Wednesday, May 4, 2011 4:30 P.M. 5 6Mayor Hammond called the meeting to order at 4:30 P.M. 7 8Mayor Hammond noted that Councilmembers Gaylord, Scholtes, 9Erichsrud, Gartzke and Aukes were present. Councilmember 10Huisman was excused. Staff present: City Administrator 11Kathy Bailey. 12 13County Assessor Joe Udermann and Gertrude Johnson were 14present from the County. 15 16Mayor Hammond summarized the process for the Board of 17Appeal. Rob noted that sometimes letters are received 18about the properties in question while some people come to 19the hearings. Rob stated that once contact is made or we 20meet with the individuals regarding each respective 21property the hearing will be continued for Monday, May 16th 22at 4:30 P.M. 23 24Joe noted that the State order all Commercial buildings 25have valuation inspections. Joe noted that based the 26inspections the Commercial were between 90 to 100%. Joe 27explained that the assessors tried to be fair during the 28inspection process. Joe Udermann noted that agriculture 29land is up 12% across the board. Gertrude noted that the 30agriculture is tillable acres. 31 32At this time Mayor Hammond recognized Kenneth John Stewart. 33Kenneth explained that his concern was for Ankeny Radiator 34shop located at 116 West 6th Street. Parcel number R 21-200- 357471. Kenneth questioned what the $115.00 fee was on his 36tax statement. Joe Udermann explained that fee is the 37Commercial solid waste fee that every business is charged. 38Kenneth explained that his abstract had been held by a 39trustee for the last couple of years. Kenneth noted that 40that the trustee told him that there was not enough value 41in the property to make enough in bankrupts’ court. 42Kenneth explained that his Market Value ($19,900.00) from 432010 payable in 2011 reflected an increase of $5,800.00. 44The Market Value from 2011 ($25,700.00) payable in 2012 45reflects an increase of $3,800.00. Kenneth said the 46property is in need of a new roof and other repairs and 47said that the building is not worth the listed market

1 1 1value. Kenneth invited Joe Udermann to look at the 2property himself to see the actual condition of the 3building. Joe responded that he would be glad to do a walk 4through but also stated that the State has stepped in and 5told the assessors that the market value on the commercial 6property is to low. The State said if the County did not 7raise the valuation on commercial property they would. Joe 8added that Sue Wiltse determined the commercial valuation 9last year before she retired so every commercial building 10took an increase. Kenneth stated that he already owes for 112 years and he can walk away at any time. Mayor Hammond 12asked that the assessors to set an appointment with Kenneth 13Stewart to determine the property valuation. Rob continued 14the Board of Appeal meeting for Monday, May 16th at 4:30 15P.M. 16 17It was determined that Assessor Joe Udermann would do a 18walk through for Kenneth Stewart’s property at 116 West 6th 19Street on Thursday, May 5th at 9:00 A.M. 20 21Additional discussion related to commercial property 22valuation. Joe stated that there have not been sales of 23businesses over the last 6 years to do commparable worth of 24properties. 25 26Having no other public present and time being 4:56 P.M., 27Mayor Hammond continued the hearing to Monday, May 16th at 284:30 P.M.
