Monthly Meeting Minutes For April 7, 2010

Also Present: DNREC staff: Dawn Baker, Jack Hayes, Sue Marsett, Kathy Wright, Secretary O’Mara; Bruce Bagley (license applicant); Hans Scheing (licensee)

 Meeting began at 9:15 a.m.

 Gerry made a motion to accept the amended agenda items (marked with a ¤ on the agenda); Ken seconded, all approved.

 February 2010 Meeting Minutes reviewed; Dave made a motion to approve with changes, Gerry seconded, all approved.

 Secretary O’Mara entered meeting and was introduced to OSSAB; Secretary O’Mara thanked all the OSSAB members for their commitment and dedication to the OSSAB.

 Bruce Bagley entered meeting @ 9:15 am. Mr. Bagley explained the results of his recent field practicum and asked the OSSAB to approve a course (a 50-hour refresher course of soil morphology and classification, under the direction of Ian Kaufman, Class B, D #2175), in order to be able to re-test only the failed section of field practicum. Phil explained that the Regulations require applicants to take a training course if the applicant fails the written exam or field practicum. Phil suggested that Mr. Kaufman submit an agreement letter to OSSAB, providing details of the course; Phil made motion to allow Mr. Bagley to complete training course with Mr. Kaufman as instructor; Paul seconded, all agreed; Mr. Bagley requested four (4) credit hours of Continuing Education Training (CET) for the 50-hr course, if he passes field practicum; the OSSAB approved the four (4) hr CET request; Phil recommended Bruce redo only failed sections of field practicum (three (3) failed sections), and completed practicum be reviewed and evaluated by Site Interpretation Advisory Council (SIAC); Mr. Bagley explained that he will have Mr. Kauffman submit requested documentation to the OSSAB and requested that the review by SIAC be quicker than the last review. Mr. Bagley left meeting @ 9:50 am.

 Hans Scheing (Class B, E, H # 4599) entered meeting @ 9:40 am. Byron introduced OSSAB members to Mr. Scheing and gave overview of reason for requested appearance to meeting; Byron read letter of complaint from a customer (property buyer); Sue gave overview of concerns of letter (1) concerns of poor business practices; (2) pumped old tank into new tank, etc.; (3) little supervision on-site; (4) lift station was not operable; Mr. Scheing responded to (1) delay was due to lack of payment from property owner and poor weather conditions, Mr. Scheing explained that his business requires 50% down and does not continue work until partial payment received; Mr. Scheing submitted letter stating payment was not made as of March 1, however payment was received Feb 25; (3) Mr. Scheing disagreed with the concern of little supervision; he claimed the information in the customer’s letter is not accurate and explained that he is on- site most of the time during installation; (2) Mr. Scheing explained that his employee pumped the old tank into new tank and assured the OSSAB that this event had never happened before and won’t happen again; ON-SITE SYSTEMS ADVISORY BOARD April 2010 meeting minutes Page 2 of 3

(4) Mr. Scheing explained that the electrical work for the lift station could have been done immediately but was due to customer’s delay for wanting seller to pay to upgrade; Mr. Scheing explained to the OSSAB that the owners were difficult to work with and explained added costs to clear driveways, etc. to complete work; Mr. Scheing left meeting @ 10:10 am; OSSAB discussed situation and DNREC did not request any action; no action taken at this time.

 Class D Representative on the OSSAB:  OSSAB members reviewed six (6) résumés from the following Class D licensees: Ralph Downard; Lāf Erickson; William Gangloff; Ian Kaufman; Tom Nobile; Charles (Chip) Toner.  Paul made motion to recommend Lāf Erickson, Phil seconded, all approved.  DNREC to submit letter of recommendation to DNREC Secretary.  OSSAB to thank all applicants for submitting résumés.
